4. Mrs. Jellinek came before the Board and suggested that amendments be
made to the Pond Restoration and Development section of the Earth
Removal provision of the Zoning By-law. Mrs. Jellinek presented the
amendments in writing, which consisted of deleting all reference to
development projects. She noted that the purpose of this was to
delete any digging of wetland, as if you want to make a new pond you
have to dig in wetlands or swamps, and this would be a reduction of
the flood storage. She noted that if ,you dig up a pond it takes the
gravel out and all you have is a big leaching field. She neted that

swamp vegetation will hold back the oils from the roads in
subdivisions and should not be dug up. Mrs; Jellinek read an article
from a newspaper which noted that a project is proposed in Norton
by Mr. Paul Boyden and that if this passes it will be happening in
Mansfield. She noted that this is a terrible thing for a Commissioner
to do and that it will be up to the Planning Board to stop this from
happening in Mansfield.
Chairman Parsons advised Mrs. Jellinek that they would bring this up
at the next workshop meeting and will examine the material and take it
under consideration.
5. Zoning By-law review to be postponed until the next meeting.
6. Board reviewed the Form A Plan for the Clarke Estate for land on Gilbert
and West Street.
Motion: To approve the Form.A Plan for the Clarke Estate for land on
Gilbert and West Street.
(Lesuer-Mahana, all in favor) VOTED
7. Board discussed the Form A Plan for Robert Davis for land on Franklin.
Street. Planning Director Maurer noted that the owner came to the
office and took babk the linen.
8. Board reviewed the site plan for Copeland Realty Trust for land on
Wood Avenue. It was noted that the purpose of the plan was to build
a parking lot for the professional building owned by Copeland Realty
Trust on Wood Avenue across the street. It was noted that there is a
5 foot landscaped buffer as required in the zoning by-law. It was noted
that the Zoning classification on the plan is shown as Business B and
it is in the General Business District.
Motion: To recommend to the Building Inspector that the building
permit be issued subject to the changing of the toning
classification on the plan from Business B to General
Business.
(Hartmann-Matoian, all in favor) VOTED
9. Board reviewed the Form A Plan for Leon Grant for land on Ware Street.
It was noted that the linen had originally been signed by the Board on
May 3, 1978 and that they are now increasing the area of lot 16.
Motion: To approve the Form A Plan for Leon Grant for land on
Ware Street.
(Matoian-Mahana, all U favor) VOTED
10. Board reviewed the Board of Appeals application of Frederick Delutis
for a variance under Section IV, Schedule"B" of the Zoning By-law to
purchase a parcel of land containing 2,943 sq. ft. owned by Walter
Bovay located behind 98 West Street. Said transfer would leave Mr.
Bovay with 12,112 sq. ft. which is nonconforming in a Residence "A"
Zone.

Motion: To recommend to the Board of Appeals that the variance
for Frederick Delutis be granted.

(Planner Mahana leftthe room and did not participate in any discussion.)
11. Board reviewed the Board of Appeals application of Norman Mahana
for a Variance under Section IV, Schedule "B" of the Zoning By-law
to erect a single family dwelling on a parcel of land at 90 Oak
Street with fifty (50) feet frontage which would be non -conforming
in an Agricultural Zone. It was noted that the lot lines of the
two existing lots on Oak Street had been adjusted to give the
required si:deyard setback and that there is over 8 acres of land with
the fifty foot frontage. It was noted that other vamiances had been
granted of this nature, the most recent on Stearns Avenue.
Motion: To recommend to the Board of Appeals that the variance
for Norman Mahana be granted.
(Matoian-Hartmann, all in favor) VOTED
(Planner Mahana reentered the meeting.)
12. Board reviewed the letter from the Recreation Commission regarding the
Granada Park Subdivision. Planning Director Maurer advised that the
Conservation Commission made a decision on this project, which required
a retention area on site. The developer appealed that decision and the
State upheld the developers project and issued an order of conditions.
The Recreation Commission filed for a hearing in Boston for an additional
review. After the review the State is not going to persue it any
further because they found no problem with what was submitted. He
noted that the Planning Board reviewed it based on the 25 year storm
and the Conservation Commission reviewed it based on the '100 year storm.
The Recreation Commission feels that this is going to cause problems with
the Hutchinson property. He noted that the stream now picks up 150 acres
and this subdivision is only about 15 acres. Planner Mahana noted that
they provided drainage for the abuttors to eliminate some of their
water problems. Clerk Lesuer noted that when the walked the Recreation
Commissions land that it was already wetland and that if they are going
to develop this they are going to have to do something about this
anyway.
Motion: To have the Planning Director prepare the appropriate
response from the Planning Board pointing out how small
the increase is and that there is an existing problem there
and the Board does not see it being aggrivated by this.
(Hartmann-Mahana, all in favor) VOTED
13. Board reviewed the estimate of required securities for Paula Lane
within the Beachwood Estates subdivision prepared by the Planning
Director.
Motion: To approve the bond estimate for Paula Lane within the
Beachwood Estates subdivision prepared by the Planning
Direetor for work which remains to be completed in the
amount of $27,295,01.

area, about 2 or 3 feet, and that the water is clean. He noted that
there is no water in the inlet or outlet.
14. Mrs. Jellinek came before the Board and read an article from the
Friday, September 22nd edition of the Boston Herald regarding wetlands.
It noted that there would be a meeting October 12th at 7:30 p.m. in
Franklin and one on October 19th at 7:30 p.m. in Holliston. She noted
that this shows that other people are interested in not having building
on wetlands.
15. It was the consensus of the Board to hold the next Planning Board
meeting on Wednesday, October 4, 1978 at 7:30 P.M. for a workshop
meeting.
16. Chairman Parsons questioned the status of the Community Attitude
Surveys. Planning Director Maurer noted that 460 responses came in
out of 3700 questionnaires. The responses show that residents are
not supportive of building anew library and if there is to be one
build they want to expand the existing library as first choice,
build adjacent to the Town Hall as second choice, and next to the
schools on East Street asthird choice.
17. Chairman Parsons questioned the status of the Developers Kit with the
Downtown Advisory Committee. Planning Director Maurer noted that the
Committee met on Monday and reviewed a very preliminary draft on items
to be solicited. They will be refined at their meeting on the 23rd.
He noted that next Wednesday he will be meeting with persons from the
Department of Community Affairs to reivew the kit with them. They will
then prepare a list of developers and invite them to discuss it before
it goes to Town meeting. They will then present to the Town Meeting a
package to vote to sell the Fairfield property contingent upon the
total design of the project as well as the price. The person getting
the property may not be the high bidder because he may -have a better
development proposal. He met with Town Counsel today to review it
legal wise. Planner Mahana questioned if the Municipal Building
Committee is still pursuing this property for the library. Planning
Director Maurer noted that they are.
18. It was noted that the hearing has been advertised for the Henley -
Lundgren Co. earth removal project.
19. Meeting adjourned at 9:25 P.M.
