Planning Director Maurer noted that it may be advisable to go through the Zoning By-law from cover to cover. Planner Grant felt that they should go through the earth removal section firstas -> the Board has already noted changes that need to be made. Zoning By-law review to be considered the first major items. Comprehensive Review of Subdivision Regulations to become the second major item. Board considered the .summary of building permit process, and felt that this should be done by the Town Engineer, the Planning Director and the Building Inspector and not a matter for the Board. 2) Board began the undertaking of a comprehensive review of the Zoning Bylaw. Planning Director Maurer noted that the basis of the by-law is from major. revisions back in 1961 and were some amendments made between 1961 and 1970. Any amendments to the by-law after 1970 are so noted in the margin as to when the amendment occurs so that this can tell how old an amendment is. Chairman Parsons noted that relative to Chapter 808 that was adopted 1 1/2 years ago that it was his understanding that the Town conforms to those regulations. Planning Director Maurer noted that Chapter 808 gave the Town the option of special permits going to the Planning Board, Conservation Commission, or any Board that they wanted to go through. It also gave them the opportunity to adopt a cluster development zoning. Prior to Chapter 808 the only Board that could issue a special permit was the Board of Appeals. Planner Grant questioned if they had officially adopted Chapter -808. Planning Director Maurer noted that the Town Counsel advised three years ago that once a text change is made to the Zoning By-law that you are bound by Chapter 808. As of a year ago every Town is bound by it. Another item in chapter 808 is that a variance is only good for one year. Chairman Parsons questioned the variances granted prior to Chapter 808 adoption. Planning Director Maurer noted that attorney's, including Town Counsel has stated that it was retroactive, however there has since been legislation passed to protect the variances issued prior to 1976. Board reviewed the Zoning By-law and noted the following changes to be made: Definitions: The word shall means mandatory; (eliminate not directory) was discussed to be changed. It was the consensus of the Board that it stand as printed. Minutes September 20, 1978 Page 2 Accessory Buildings: Planner Mahana noted that anyone having a house and wants to attach a breezeway and garage they have to adhere to the side yard requirements, however if it is not attached to the house it is considered an accessory building and is allowed within 5 feet of the boundary. Planner Grant felt that they should be allowed to add breezeway and garages but that is a setback problem and fel t that it should be allowed even attached because it is not a habitable building. It was the consensus of the Board to eliminate from the definition of Accessory Buildings "where a substantial part of a wall of an accessory building is a part of the wall of the main building, such accessory building shall be counted as phrt of the main building." Multiple Residence to be eliminated in its entirety. Multiple Dwelling Complex to read as follows: "A multiple dwelling complex is a building or buildings containing three or more dwelling units located on a tract or lot." Board questioned the following definitions and felt that they would review them at a later date: Building Building, Front of Building, Height Family Dwelling, One family Garage - percentage to be eliminated. chedk wording of contradistiction Planner Mangiaratti felt that they should assign certain pages to each member of the Board for review. Planners Mangiaratti and Grant to review pages 1 through 15. Planners Mahana and Hartmann to review pages 16 through 29. Planners Lesuer and Matoian to review pages 30 through 40. 3) Planner Mangiaratti noted that he would be attending the SRPEDD meeting on September 27 and that Planner Grant was welcometo attend with him so the remainder of the Board can hold a regular meeting and Planners Mangiaratti and Grant will report back to the Board. 4) Next Planning Board meeting to be held September 27th, 1978 at 7:30 P.M. 5) Mrs. Jellinek requested to be put on the agendafor the next meeting to discuss pond restoration. 6) Meeting adjourned at 9:20 p.m. Clerk Date
