Norman D. Murphy, John O'Donnell, and Karl Clemmey
Planning Board to Building Inspector regarding lot release for

3) Board reviewed the Minutes of July 5, 1978. Chairman Parsons noted
that the motion, on Page 4 to deny the application of Mr. Clemmey was
not legal as they cannot deny the application until a Public Hearing
has been held.
Motion: To reconsider the vote of
permit for Karl Clemmey.

P-4anner Grant noted that the Board of Appeals stated at their meeting that
in order to appeal the decision it has to be denied. Planner Mangiaratti
noted that he isnot going for an appeal but for a variance. It was noted
that the application for the variances was in the correspondence folder.
Motion: To deny the earth removal permit for Karl Clemmey for land on
South Main Street for the following four reasons:
1) It does not comply with the portion of the By-law requiring
monitoring wells (Section V -G -3-c-4).
2) The cuts shown in many places such as test holes #2, 4, 6, 9
and 10 are not 6 feet above the ground water. It was noted
that these tests were done out of season. (Section V -G -3 -a -2=d
3) Plan does not comply to the part of the by-law that no

4) Board met with Mr. Ken Larsen, Messrs. Cavallo and Signorello and a
representative cyfromStreet. Mr. LarrsemmM Engineering otedantthatview theythe planito tear down

the existing dwelling and build a Mr. Donut Shop. (Planner Grant left the
room and did not participate in any discussion.) RIM Engineering Representative
presented the drainage calculations for the parking lot, which was designed
to 'a '10 year storm frequency. Mr. Larsen noted that the existing curb cuts
are approximately 19 feet and they will be increasing them to 25 feet.
It was 'noted that a pondingarea has been designed to help eliminate the
flooding on Pleasant Street .Mr. Larsen noted that all sign requirements
will meet the requirmenets of the Town. Mr. Larsen noted that he will be
the owner and operator of the store and hopes to take his residency in
Mansfield. Planner Hartmann questioned the type of curbing that would be
in the parking lot. RIM Engineering Representative noted that it would be
asphalt berm all around the parking area. It was noted that the new zoning
requires a 5 foot buffer around the parking lot. RIM Engineering
Representative noted that this was provided for on sheet 2 of the plans.
The Boardnoted that the increase in curb cut is not shown on the plan and
that the loading area in the rear of the store was not deliniated as a
loading area. Mr. Larsen noted that there would be no exterior lighting.
It was noted that the sign on the front area of.the lot was not labelled
as such and that there were no elevations on the sewer line. The Board
suggested that the Town Engineer review the drainage calculations submitted.

It was noted that there are going to be trucks parked on both sides of
Chauncy Street in this area and there is nothing that the Planning Board
can do to eliminate this as there is no special permit procedure. Chairman
Parsons noted that perhaps the Town should limit parking on one side.
5) Board discussed the Community Attitude Survey.. Planner Mahana referred
to F-3, Do you feel that the Town should establish a program for the
improvement of local street systems to bring them up to acceptable safety
standards? , and noted that what bothered people the most was the widening
of the roads. He noted that when the Conservation Commission brought up the
suggestion of scenic roads he was impressed because they could bring the
drainage up to standard and redo the road without widening them. It was the
consensus of the Board to eliminate item F=3. Item F-4 to read "Do you know
of any other traffic hazards in Town that need to be repaired?". Items E-7 and
E-8 to be combined into one question.
Planner Mahana suggested that they have a questioned "Do you feel that Highway
Department, School Department and Recreation Department vehicles should be
housed 4n one area ?" Planner Mangiaratti felt that this would be a political
statement. (Planner Grant entered the meeting at this time.) Planner Grant
felt that they should not have them housed in one area because if there is
vandalism everything would be lost at once,
Community Attitude Survey to be reviewed further at another meeting.
6)Board discussed the Brookside Estates "as built" plans. It was noted that the
Town Engineer has found some drafting errors and will review the plans in
detail and forward a list of the errors to the Planning Board so that the
plans can be corrected before a Town Meeting.
7) Board reviewed the Form A Plan for Maurice Shribman for land on North Main
Street. It was noted that this plan had been endorsed by the Planning Board
in December of 1977 and that the new plan was submitted to eliminate the 12'
passage way. It was noted that the Zoning in that area was changed from
Business B to Downtown Business.
Motion: To return the Form A Plan to Maurice Shribman for land on North
Main Streetto have the Zoning Classification corrected.
(Grant-Mangiaratti, all in favor) VOTED
8) Board reviewed the Board of Appeals application of Norman D. Murphy to
divide a parcel of land containing two single fmmily dwellings at 41-43
Dean Street, with non -conforming frontage and setbacks. It was noted that
these dwe1lings were situated on the lot prior to zoning.
Motion: To recommend to the Board of Appeals that the variance for
Norman Murphy be granted.

# 9) Board reviewed the Board of Appeals application of Karl Clemmey for
variances from Section V -G earth removal. It was noted that the variance
was requested in accordance with the Planning Board's letter of July 7, 1978.
Motion: To recommend to the Board of Appeals that the by-law provision
requiring that excavation not go below street level (Section V -G -3-c-1)
be waived. Also the requirement for the installation of monitoring
wells during the duration of December 1st to March 30th prior to the
filing of the application be waived, with the provision that the
monitoring wells be installed if the permit is granted and that final
grading be adjusted in accordance with the measurements recorded on
those wells during the operation. (Section V -G -3-c-4). However, the
Planning Board recommends against waiving the requirement of having
the maximum depth of excavation less than 6 feet above the highest
water level as provided in Section V -G -3-c-4 and also recommends
against waiving the requirement that high water level be determined
between the petiod of December 1st and March 30th as noted in
Section V -G -3-c-4. The affect of these recommendations, if ddopted
by the Board of Appeals would be that this gravel operation would not
begin until December 1st, 1978.
(Mangtaratti-Hartmann, Mahana in favor, Grant opposed) VOTED
Planner Grant felt that it was not necessary to wait for monitoring wells to
be installed as they can tell where the high ground water is from the iron
level on the soil. He noted that it would be tying him up until next spring
because the don't build roads when there is frost in the ground. He noted
that there is no purpose of them going for a variance if they can't haul
until December 1st. Board questioned if be would need a letter of agreement
from Vazza to cross his property. it was noted that he does not show an
access road to South Main Street and that if he can't get the agreement from
Vazza he would not be able to haul.
10) Board reviewed the Board of Appeals application of John O'Donnell to establish
a CuttedrGrinder Tool Business at 150 Gilbert Street.
Motion: To recommend to the Board of Appeals that the variance for
John O'Donnell to establish a Cutter Grinder Tool Business at
150 Gilbert Street not be granted because there is not hardship
presented on theland and it would derogate from the purpose and
intent of the Zoning By-law.
(Mangiaratti-Hartmann, Mahana in favor, Grant opposed) VOTED
11) Mrs. Jellinek came before the Board and noted that the secretary sent copies
of the wetland zoning to the Board and questioned if anyone had the time
to look it over or even read it so that they could put a date for discussion.
Mrs. Jellinek noted that she would like to know by September if the Planning
Board plans to sponsor this because if they do not there is alot of work that
the other interested citizens would have to do before town meeting. Chairman
Parsons noted that Mrs. Jellinek would have an answer from the Board prior to
September lst. This item to be put on the agenda for next week and to obtain
a list of the 7 places that flooded during the February storm.

vacation and may be unable to attend.
