It was noted that all of the provisions of the Planning Board's letter were added-i'with the exception of the paving of the parking lot. It was noted by the Planning Director that the proposed use is for storage and does not require the expansion of the parking lot. Planner Grant felt that the intent of the Planning Board was clearly defined as it stated that any addition of 15% of the existing building would require everything else to be brought into conformity and they should not take exception to this plan. Motion: To return the Plan to the Building Inspector for Acorn { Manufacturing with an unfavorable recommendation. (Grant -Hartmann, Matoian, Mahana in favor, Mangiaratti opposed) VOTED Minutes April 26, 1978 Page 4 15. Board reviewed the Board of Appeals application of Gary and Rosemarie Austin for variances under Section IV, Schedule B of the Zoning By-law to erect a single family dwelling on a parcel of land off Pratt Street identified as Lot 69 on assessors map 30. Said lot has no frontage on a public way, access is over land owned by the Roman Catholic Bishop of Fall River. the lot contains 20,000 sq. ft. which is also non- conforming in an Agricultural Zone. Motion: To recommend to the Board of Appeals that the variance for Gary and Rosemarie Austin not be granted. (Grant -Motion Withdrawn) Planner Mangiaratti noted that it is a lot before zoning however, it has become land locked and the only access would be to obtain an easement from the church. Motion: To not make a recommendation to the Board of Appeals for the application of Gary and Rosemaire Austin. (Grant - Motion Lost for Want of a Second) Motion: To recommend to the Board of Appeals that the variance be granted to Gary and Rosemarie Austin because there is a hardship to the land. (Mangiaratti- Motion Lost for Want of a Second Motion: To recommend to the Board of Appeals that the variance for Gary and Rosemarie Austin not be granted because of the uncertainty of them obtaining a legal right of way. (Mahana-Hartmann, Matoian in favor, Grant-Mangiaratti opposed) VOTED 16. Board reviewed the Board of Appeals application of Gray Realty Trust for a variance to relieve the three minute interval of trucks leaving the gravel pit. Motion: To recommend to the Board of Appeals that the variance for Gray Realty Trust not be granted. (Mangiaratti-Mahana, all in favor) VOTED Planner Grant felt that the three minute interval should be more flexible in the regulations. Planning Director Maurer noted that in the Fall there was a different trucking company and they were not pushing the trucks out like they are now and that they can no longer use Spring Street because the bridgeload has been posted. He noted that the trucks now come through the center to the lights at 140 and felt that the 3 minutes should be maintained. Planner Mahana noted that if it was increased the traffic on Route 140 would be bottlenecked. Minutes April 26, 1978 Page 5 17. Board reviewed the letter from the Conservation Commission to the Building Inspector regarding the Earth Removal application of Leon Grant. Planner Grant advised that he did not request any permit for his pond. (Planner Grant removed himself from the table, but did not leave the room.) Board also reviewed the letter from the Building Tnspector to Planner Grant noting restrictions that would be placed on his operation and that a formal permit would be issued after a bond in the amount of $3,000 per acre had been received by the Town. It was noted that since no formal permit was issued prior to the adoption of the new zoning that he would now have to conform with the new earth removal regulations for pond restoration in accordance with Town Counsels letter. Motion: To send a letter to Leon Grant informing him that he will have to comply with the new zoning by-law. (Mahana-Hartmann, all in favor) VOTED (Planner G ant present but not voting. 18. Mrs.. Jellinek came efore;the Board and noted that she found out on Monday evening the background on the new pond restoration provisions. She noted that more than 6 months ago the Planning Director met with the conservation Commission and discussed how the wording of the pond restoration should be written and suggested strongly that there be no maximum depth and the Planning Board approved it. Mrs. Jellinek felt that with this action the Planning Director has done more damage than.` the Board of Appeals_; in the last few years. Mrs. Jellinek also felt that Planner Grant was in conflict of interest the way he was voting at the last meeting stating that Mr. Gray's operation is not a gravel removal operation as he now himself has an application in. Planner Grant advised that he was not restoring a pond that he was enlarging his pond and that it is strictly for agricultural uses. 19. Next Planning Board meeting to be held Wednesday, May 3, 1978 at 7:30 P.M. 20. Chairman Parsons reminded the Board that the League of Women Voters would be holding their Legislative Reception at the Town Hall on Friday Evening for anyone wishing to attend. 21. Chairman Parsons noted that the Bourd made substantial progress on behalf of the Town as a result of Town Meeting. He noted that the Board worked hard on this project. He noted that now is the time to consider future projects, such as the rezoning of the industrial strip along the old colony railroad bed from Fruit Street up and perhaps take another look at Cluster Zoning. 22. Meeting adjourned at 10:05 P.M. Clerk Date
