In regards to the Planning Boards comments in their letter it was noted that the inlets on each side of the right-of-way are shown on Granada Circle, on lot 18 as a catchbasin in an easement and on the opposite side of the street they put a catchbasin:: on the grass plot up to the Allesandri property. She noted that the Planning Board has met twice and that she expected at the meeting of the Planning Board on April 10th that it would be discussed, however it was not. Mrs. Jellinek noted that the Conservation Commission has to write the order of conditions within the 21 days after the hearing and questioned how the Board feels on the gravel removal. Mrs. Jellinek noted that the Board has an amendment to the gravel removal regulations and that the Town Meeting acted favorable on this and that the former Town Counsel has advised that the zoning takes affect just as soon as town meeting votes can it. (Grant -Hartmann, all in favor) VOTED 14. Board reviewed the letter received from the Conservation Commission regarding Gray REalty Trust's application to remove gravel from the Norton Reservoir. Board also reviewed the memorandum prepared by the Planning Director on this matter. Planning Director Maurer noted that it is his belief that the application does not meet the requirements for the old zoning because the formal permit was not issued by the Building Inspector before April 11th when the new zoning was adopted by Town Meeting. He noted that this does not prevent the Conservation Commission from taking action however they may want to delay action until they see the plan that should be prepared in accordance with the new regulations. It wasnoted by the Board that they would like a legal opinion as to whether this would come under the new regulation where it was submitted prior to the adoption of the new regulations. Motion: To request the Conservation Commission to require the plan to be redeisgned in accordance with the latest standards adopted by Town Meeting for Pond Restoration as voted on April 11, 1978 and to advise the Commission that they are requesting a legal opinion from Town Counsel as to whether a earth removal permit will be required from the Planning Board under the new regulations.
