He again apologized for this outburst. 2) Letters were read from the following: Massachusetts Division of Nater Pollution Control to Board of Selectmen approving application for sewer funding. Fire Department of Planning Board regarding Granada Park Memorandum from Planning Director to Planning Board regarding regardingTranscript of'PUblic Hearing of March 8, 1978 'Robert Tighe to Planning Board regarding` resignation from the Board National Endownment for the Arts to the Planning Board regarding application for grant. It was noted that there was correspondence received from the Town Engineer, Fire Chief and Conservation Commission. Planning Director Maurer noted that an application was submitted to the State for connection to the municipal sewer system and that approval was received. Planning Director Maurer noted that when the Town Engineeri;sent the Planning Board letters that he forwarded copies to RIM Engineering and they have been making some of the corrections. Chairman Parsons, questioned the State . approving ` the sewer connection as there is a moritorium on sewer. Planning Director Maurer noted that back in 1975 the State allowed the Town to connect 150,000 gallons. Immediately the Board of Selectmen assigned 75,000 gallons to Cabot, Cabot and Forbes and the balance to any other construction. 15,000 gallons is going to Codex, 10,000 to the American Fabric, 8,000 to the Foxboro Company,(provided the facility is built within 2 or 3 years), and 15,000 towards the hotel. The Selectmen agreed that the other 15,000 for the hotel would come out of the other construction alotment. 7) At 8:00 P.M. the Planning Board held the required Public Hearing on the proposed amendment to Section V -G, Earth Removal, regulations of the Mansfield Zoning By-law. Transcript of that Public Hearing is on file. 8) Board discussed the Hobbit Hollows preliminary subdivision plan. Planning Director Maurer noted that he would review this plan with the Town Engineer and have something prepared for the Planning Board at the next meeting. Planner Grant noted that he was advised that the applicant had approached the Planning Board two years ago and was told a subdivision would not be allowed. Planning Director Maurer noted that the applicant never approached the R -tanning Board or anyone else in the Town Hall, but had approached RIM Engineering and Ralph Maloon advised the applicant against it because it was a waste of money because the highway was going theough there and there would be considerable expense involved to have the subdivision prepared. Subsequent to that the State talked to the applicant and advised him it would be of greater value if it was in the form of a subdivision and it did not make any difference if it was an approved subdivision or not, that he only needed a plan before the Planning Board showing the number of lots. The appaisers from the State mate the same comment in this office. 9) Board discussed the proposed Business Zoning to be presented to theTown Meeting. Planner Grant noted that he would be in favor of having the Town immediately adopt the classification of General Business in case the rest of the article failed. It was noted that unless the provisions for General Business were adopted that it was not practical. The Board reviewed the proposal as it appeared in the warrant and made the following revisions: Minutes March 22, 1978 Page 3 Item F-6 to be eliminated in its: entirety (Planned business development in accordance with the provisions of Section V -M.) (aesuer-Mahana, all in favor) VOTED Planner Mangiaratti felt that the people who ahgued against this rezoning are innocently ignorant as their property value will increase. He noted that nobody would be forcing them to sell their homes because it is a business zone and felt that they would be doing the Town a favor because it is a likely spot for commercial development. Planner Mahana noted that by rezoning this they will be expanding the triangle into more business uses and felt that they should wait and see what happens in the Sears mall. Planner Lesuer noted that rezoning this would aGDellorate development. Motion: To approve the amendment as noted (Mahana-Hartmann-Lesuer in favor, Grant, Mangiaratti opposed) VOTED Motion: To recommend favorable Town Meeting action on Article 36 of the 1978 Annual Town Meeting, as amended. (Mangiaratti-Grant, all in favor) VOTED Planning Director Maurer noted that in the past, based on the recommenda- tions of the Town Moderators, they will prepare a presentation on the articles for business zoning that will include all the amendments that were made at this meeting and they will make their m0:t4*'Wj, on the amendment. Planner Mangiaratti felt that the tape should be made available to those who wish to hear it. It was noted that the tape is to be left at the Town Hall in the care of the Planning Director. 20) Mrs. Jellinek came before the Board and noted the night of the hearing she had an icy driveway and therefore had only a small recorder in her purse with Planner Mahana's voice and that the entire Board heard what he said and that they are now denying it. She noted that it was just as missing as the watergate and she is not taking it. Planning Director Maurer questioned whether Mrs. Jellineks remarks on this is to they way the memorandum was prepared were her remarks on the way the secretary transcribed the tape recording. Mrs. Jellinek noted that she did not say who erased it and that she would not name anyone. 21)Meeting adjourned at 10:45 P.M. C erT k Date
