(Mahana-Hartmann, all in favor) VOTED 4. Board discussed the earth removal plans for Carl Nelson, John Smith, and John Walsh in relation to the memos prepared by the Planning Director and Town Engineer. Planner Tighe raised the question as to why the appli- cations were being considered in accordance with the provisions of the Zoning By -Law of 1965. Planning Director advised that the Town Counsel, James Grady, had given the Zoning Board of Appeals an informal opinion that when the Board of Appeals sustained the action of the Building Inspector, that the new application could be in accordance with the provisions in effect in 1965. Planner Mangiaratti felt that a compre- hensive opinion should be obtained from a Town Counsel. Minutes Page 2 February 22, 1978 f- l Motion: To write a letter to the Town Counsel requesting that he offer an opinion on the earth removal applications that were submitted in accordance with the Zoning By -Law of 1965, and to specifically ask if the earth removal pro- visions to beyond the limits shown on the registration plans in 1965, should operations now by subject to the special permit provisions now in effect? (Mangiaratti-Tighe, all in favor) VOTED *Planner Hartmann entered the meeting at this time. Planner Tighe questioned the statement on the "value of excavation" and felt that this would be difficult to determine. Planning Director advised that for the three operations, the only criteria used in his evaluation was the elevation above the watertable; and in the instance of the Nelson operation, the relationship of the operation after excavation through the 100 -,year flood. 5. Board met with Norman Gray, Sr., Norman Gray, Jr., and Ralph Maloon regarding the Preliminary Subdivision Plan for Rumford River Estates. *Planner Grant entered the meeting at this time. Discussion was held on the extension of time for the Board's considera- tion of the application and it was agreed that the applicant would apply for an extension until March 30, 1978. Mr. Gray, Sr. advised that he was not aware of the water supply problem in the South Main Street area, and suggested that one way of solving the problem would be to see if the State would pay for improving a portion of the water line through the force account as part of the consideration of Rt. 495. Mr. Gray, Jr. advised that they would be willing to install a larger main along the front of their property that would tie into a larger main that the Town would construct. Points were discussed relative to providing additional information on the topography and profile of the roads for Phase II. Chairman Parsons stated that they need additional information to determine how the whole road system for " the subdivision would drain towards the Rumford River, then the pipe size in Section I would have to be adjusted accordingly.' Ralph Maloon suggested that they only show the topography and profile information to the high points of Section II where the property would drain into Section I. The Planning Director asked if it was the developer's intention to apply for additional earth removal permits for Section II. Mr. Gray, Sr. noted that it was their intent to have only one earth removal operation and that there would be no further earth removal operations from the pro- ject. However, Mr. Gray, Jr. noted that there would still be earth material moved around Section II for the purpose of grading- in Section I, but it was not their intent at this time to remove additional material from the site other than that which is presently being removed for the present earth removal site. Chairman Parsons explained that it had been washed out by a storm last year and had not been replaced. 8. Planner Hartmann suggested on the water main for Rumford River Estates that the existing water main be left under the highway, and that the State install an additional one of the same size. 9. Board discussed the release of the security for Christian and Schromm for Village Estates. It was noted that the work has been completed and the "as built" plans submitted, and that the two streets are on the 1978 warrant for acceptance at the Annual Town Meeting.
