(Matoian - Hartmann, all in favor) VOTED *Planner Grant entered the meeting at this time. 5) The Board met with Mr. and Mrs. Fouracre of 73 Stearns Avenue to discuss a drainage problem on their property in relation to Bristol Arms apartment complek. They told the Board they had been to the Conservation Commission two weeks ago. They said they have had a problem with water ever since they moved into the house, but the water has come 10 to 15 feet into their yard. The water flow is fine from Stearns Avenue, into their ,yard, but then it stops. There are culverts, but it stops after it goes through their property. Planning Director Maurer noted that the ponding area was there before there was any development behind them. He also noted that Minutes October 10, 1979 Page 3 the ditch is very restricted and the water sits and is slow to get out of their property. He said the original plans just called for culverts and made no provision for keeping them cleaned out. Mrs. Fouracre noted the developer is filling the pond on his side of the property which pushes the water towards her property. Chairman Parsons felt the Board should talk with Mr. Stivaletta while the project is still bonded. Planner Flynn suggested the Board invite Mr. Stivaletta in to talk to the Board and find out his schedule for completion. 6) Mrs. Margot Jellinek appeared before the Board to discuss the Henley - Lundgren gravel removal permit on South Main Street. She questioned the amount of gravel to be removed as mentioned in the July 25, 1979 minutes, the amendment that said the amount to be removed shall not exceed 300,000 cubic yards, and wanted to know where that figure came from. Chairman Parsons explained that the 300,000 figure came from the plan. She also questioned where the amendments to the permit came from and Planning Director Maurer noted they were in a memorandum he sent to the Board. Mrs. Jellinek stated that Dr. Carr said they only had to remove 250,000 cubic yards and she felt that Planner Grant had strongly suggested that the Board give them 300,000. She objected that the minutes were not clear, and are not complete. Chairman Parsons stated the members of the Board feel they are complete and explained that on June 27, 1979 Dr. Carr said 250,000 cubic yards would be a bare minimum and the plan would have to be revised to arrive at that figure. 7) The Board discussed the ERE Corp. gravel removal application. The Planning Director reviewed the letter the Board sent to ERE Corp. on September 10, 1979 and the changes RIM had made on the plan. He noted the only concern he had about the plan was the location of the monitoring wells that were installed that were not within the area to be excavated. The By-law doesn't state the number of wells you have to have and where they have to be. Ralph Maloon explained to the Board that he couldn't get a machine large enough to put a well in at the top of the hill. He said they would stay with the curve of the hill for the ground water levels. 8) The Board discussed the site plan application submitted by James O'Brien for land on Copeland Drive. It was noted that the Board had sent a letter on the plan on August 28, 1979 noting the inconsistency in the drainage. The new plan shows the drainage in the same location as shown on the 1975 plan submitted by Karl Clemmey. It was noted that they have a permit to tie into the sewer system, but there is a cesspool on the property. It was the consensus of the Board that the drainage system should meet the ten year storm frequency requirements. Motion: To return the plan to have .the engineer put on the plan the data on the drainage systems capability to handle a ten year storm frequency. (Hartmann - Flynn, all in favor) VOTED Minutes October 10, 1979 Page 4 9) The Board discussed the memorandum from the Planning Director concerning the Foxfield Estates Subdivision "as built" plans. It was noted that the stone bounds have been set, but the loam and seeding is not complete. Motion: To release $600. in securities for the stone bounds. (Grant - Hartmann, all in favor) VOTED 10) The Board discussed the memorandum from the Planning Director concerning the Spruce Acres Subdivision "as built" plans. It stated that everything has been completed that is required. It was the consensus of the Board that the retaining wall to be built by the developer should be shown on the plan after it is completed. Motion: To release $10,397.50 from Foxboro National Bank Certificate of Deposit #739-3, plus accrued interest; and $5,300.00 from Mansfield Cooperative Bank Account #502531, plus accrued interest. A balance of $585.52 will be held until next spring to be sure the loam and seeding properly establishes itself. (Grant - Hartmann, all in favor) VOTED Motion: To return the plan for Spruce Acres to the developer to have the retaining wall shown on the plan. (Matoian - Hartmann, all in favor) VOTED 11) Planning Director Maurer told the Board he had reviewed the plan for an earth removal project in Foxboro behind Beaumont's pond. He noted that according to the plan all of the run-off will still run toward Beaumont's pond after the operation and he didn't see that there would be a problem with the watershed. It was noted that Foxboro is planning to require all truck traffic from this operation to exit into Mansfield. Motion: To write letter to Foxboro Board of Selectmen that they not require the gravel trucks to be routed through Mansfield. (Grant - Hartmann, all in favor) VOTED 12) The Board discussed the letter from Norwood Engineering Co. concerning the culvert under Otis Street for Plantingfield Road Subdivision being developed by Robert Rizzo. He is requesting that the proposed 18" x 28-1/2" R.C. arch culvert be changed to an equivalent capacity C.M. pipe arch culvert. The Planning Director noted he had reviewed the request with the Town Engineer and he said it would be satisfactory. Motion: To approve the revision to the plan and approve the request. (Grant - Hartmann, all in favor) VOTED 13) The Board discussed the request of Richard A. Morse for a gravel permit for an existing pit located at 581 Elm St. It was the consensus of the Board to hold the request until recommendations are received from the Planning Director. Minutes October 10, 1979 Page 5 14) Planner Grant told the Board because of questions raised about a possible conflict between his pond development project and those of David White and Henley -Lundgren, even though he didn't believe he had been influenced in making a decision that he felt he shouldn't sit on the Board any longer. He told the Board he appreciated their confidence in him, but he stated he was resigning from the Board effective immediately. 15) The Board discussed Leon C. Grant's pond development project. The letter from Town Counsel stating that Mr. Grant does not have to comply with our special permit process was discussed. The Planning Director sent a memo- randum to the Board stating the procedure he felt Mr. Grant should follow in removing the material and that Mr. Grant should file the necessary application under the surplus material provisions of the By-law. Mr. Grant explained to the Board that he had no problem with the proposed restrictions for the operational standards of the project, but he said he was not preparing a plan of the proposal. The Planning Director said he felt there should be a plan on file. It was the consensus of the Board to wait to discuss the proposal until the Planning Director and Building Inspector review the proposal. 16) Motion: To table action on the proposed letters to Town Counsel and Leon C. Grant concerning Mr. Grant's activities in view of the t fact that Mr. Grant has resigned from the Board. (Hartmann - Matoian, all in favor) VOTED 17) Mrs. Jellinek told the Board that Mr. Colby from the DEQE wants to see a plan from Mr. Grant that shows all the land, buildings, trees and swamp area and they will come out to view the property. She stated that Mr. Grant falls under the earth removal provisions of the By-law. She stated that the DEQE will make the decision as to whether he can have a pond. 18) It was the consensus of the Board to set the date for the next meeting for October 24, 1979 at 7:30 P. M. 19) Chairman Parsons told the Board he would call Planner Kaufman and ask him for his resignation because after discussion the Board found that it created problems being a member short each week. 20) Planner Flynn suggested the Board write a letter to the Selectmen telling them that we need new members. 21) Motion: To nominate Planner Parsons as Chairman; Planner Flynn as Clerk. (Matoian,- Hartmann, all in favor) VOTED 22) The meeting adjourned at 10:40 P.M. Clerk Date
