The Planning Director explained the background of the bill and commented that he felt it was an invasion of privacy. The Chairman stated it would tend to keep people from wanting to serve on Boards and Committees. It was the consensus of the Board to have the Planning Director draft a strong letter of opposition to the bill and let the Board discuss it. 5) At 8:00 P. M. a hearing was held on the application of ERE Corp. for a gravel removal permit for land off Maple Street. (A complete transcript of the hearing is on file.) 6) The Board met with Steve Kelleher and Dr. Jerome Carr concerning David White's pond development application on School Street. Dr. Carr submitted copies of letters written by him to David White on August 16, 1979 and August 21, 1979. Dr. Carr stated the stagnation problem is a temporary one caused by the construction of 495 and as soon as the construction is completed the problem will disappear. Planning Director Maurer asked if Mr. White didn't use the pond for fish would there be a stagnation problem? He also noted that Mr. White had said this was the first time this had happened and the water level was higher than normal. Mr. Maurer asked what would happen when the pond was developed and the water outlet was two feet lower. Dr. Carr answered the problem would be solved because Planning Board Minutes August 29, 1979 Page 3 because in the current pond the banks have gotten so bad the water is flowing around the pond. Chairman Lesuer asked Dr. Carr what percentage Mr. White had to succeed in raising trout. Dr. Carr said there was about a 20% chance that he would be able to grow trout because of the water temperature, but he would have about a 95% change to be successful raising bass because they are a warm water fish. Mr. Kelleher submitted letters to the Board from Lanson C. Cobb and Jean Gertrude Findlater giving David White permission to construct a retention pond on their land. 7) The date for the next meeting was set for Wednesday September 5, 1979 at 6:30 P. M. for members to view the ERE gravel removal operation off Maple Street. 8) The Board discussed the "Approval Not Required Plan" submitted by Americo P. Day for land on Perkins Avenue. The Planning Director noted it was his opinion that the plan constitutes a subdivision. Land developed on an unaccepted, unimproved private way has to have drainage put in and has to be paved. The applicant must conform to Section IV -K of the Mansfield Subdivision Rules and Regulations. Motion: To send a letter to the applicant informing him that the Board does not endorse the plan because it requires approval under Section IV -K of the Mansfield Subdivision Rules and Regulations. (Hartmann - Flynn, all in favor) VOTED 9) Motion: To send a letter to the Selectmen recommending that a permit to move a house from 311 Chauncy St. to the corner of West St. and Walnut St. be granted provided that the mover and owner certify to the Town that the moving of the house will not require the cutting down of trees or the removal of stone walls within the West St. right-of-way. (Grant - Flynn, all in favor) VOTED 10) Motion: To release $18,716.00 in securities from Attleboro Savings Bank Passbooks for work completed in the Riverside Park Subdivision.
