After considerable discussion on a method to determine the high water mark and the accuracy of using the.high water mark and the effect on the Town, the following motions were made. Motion: To approve paragraph 1-a as written. (Hartmann - Mangiaratti) Motion: To amend paragraph 1-a by deleting "of said water courses." and adding in its place, "as being the stage of the rimer at the ten year storm flood stage" (Lesuer - Matoian; Lesuer, Matoian In favor; Mangiaratti, Grant, Hartmann opposed) NOT VOTED Minutes March 28, 1979 Page 3 Motion: To amend paragraph 1-a by deleting "High water line of said water courses." and adding in its place, "bank of the river channel." (Mangiaratti - Hartmann; Mangiaratti, Hartmann, Lesuer, Grant in favor; Matoian opposed) VOTED 7) The Board reviewed a Form A "Approval Not Required" plan submitted by Robert E. Chavaree for two three acre lots on Basin Street. Planner Mangiaratti noted he was concerned about access for public safety vehicles on the back lot. Mr. Chavaree said he could move the easement to the center of Basin Street to make the access easier if the Board felt it should be that way. He stated he intended to abandon Basin Street at a later date and deed it to the abutting property owners. No action was taken on the plan. Mr. Chavaree took it back with him when he left the meeting. 8) Chairman Parsons suggested that the Board might want to consider the recommendation to the Board of Appeals voted on at the March 21, 1979 meeting to grant David White a variance from the Pond Restoration and Development standards of the By-law because the Board might be setting a precedent for gravel removal. He felt the Board should not make a recommendation either way because the whole question could come back to the Planning Board and they would be prejudicing their case. There was no motion made to reconsider. 9) The date for the next meeting was set for April 4, 1979 at 7:30 P. M. 10) The meeting adjourned at 9:50 P. M.
