in the wetland zoning amendment a motion was made to define the motion
better.
Motion: To reconsider the vote on wetland zoning and define the motion
better.
(Mangiaratti - Lesuer, Motion withdrawn)
Planner Grant wanted it recorded in the minutes that he is not totally
opposed to the Fairfield project, but he wanted to see a larger mixture
of commercial and residential development than the Downtown Advisory is
proposing.

(Mangiaratti - Lesuer, all in favor) VOTED
4) The Board reviewed the Planning Director's recommendations for bond
releases for streets in Cabot, Cabot and Forbes. He stated the $60,776
bonds that are being kept in force are more than adequate to cover the
amount of work remaining to be done on Forbes Boulevard and Plymouth
Street. He explained they are continuing to carry bonds that are already
in effect rather than take out new ones.
Motion: To approve the Planning Director's recommendations on the Bond
release for Cabot, Cabot and Forbes as follows:
#06SB6892 Cabot Blvd./Hampshire St. $8,945.
#06SB11882 Berkshire Road 1,650.
#06SB025712 Suffolk Road 2,500.
#06SBO25272 Oxford Road 5,170.
(Grant - Matoian, all in favor) VOTED
5) Robert Chavaree appeared before the Board to discuss the changes the
Board requested in the plan for Colonial Heights Subdivision. He stated
his attorney has found an easement crossing the 20 ft. strip of land he
owns across Starlin's property for access to the cemetery. He said he
is willing to grant a 10 ft. strip for the Town to maintain the cemetery,
but not for the general public to pass through for sight-seeing. Planner
Mangiaratti suggested Mr. Chavaree have his attorney write a letter to
the Board explaining the location of the right-of-way and an opinion on
who can use it to clear up the matter of the right-of-way.

Mr. Chavaree told the Board he has discussed Mr. Shaw's drainage problem
with him and his engineer and he is planning to drop the drain pipe down
so the top of it will be 6" lower than Mr. Shaw's cellar which should
relieve his problem and he will also put crushed stone around the pipe
and give Mr. Shaw an easement to clean the culvert. He said Mr. Shaw has
tentatively agreed with the plan but want's to check it with his engineer
first. Mr. Chavaree told the Board he has gone as far as he can in regard
to solving Mr. Shaw's problem, which actually is separate from the subdivision's
drainage problems, and if he cannot come to an agreement with Mr. Shaw he will
redirect all his surface water down Ephriam Drive which will result in the
loss of a large number of trees that he would like to keep. Mr. Shaw wanted
to know when the drainage will be put in. Mr. Chavaree explained the complete
water system, drainage system and base asphalt must be approved before he
begins development of the subdivision. He also noted that the dwelling that
Mr. Shaw is concerned about is not part of the subdivision and is right on
Mill St. and could be built without any drainage being installed. Mr.
Chavaree also noted that he needed the easements from Mr. Shaw and Starlin
before work was started and presently draft copies of the easements to the
Board.
Mr. Chavaree explained he is working on a land '_swap arrangement with Joe
Gonsalves for the drainage, to bring the actual drainage in line with the
easement. He said he is also changing the location of the stump dump.
Chairman Parsons asked if he intended to take out the 55 gallon drums and
replace them with regular drainage pipe. Mr. Chavaree said he would clean
It up and correct it.
Mr. Chavaree's engineer Ralph Maloon was also present during the discussion
along with Mr. Francis Shaw.
Planner Mangiaratti left the meeting at this point.
6) It was the consensus of the Board to work on the recommendations for the
Zoning Articles at the next meeting.
7) Motion: To endorse the "Approval Not Required" plan submitted by WRC
Properties for Lot 254 on Forbes Blvd. and Lots 255 and 256 on

Appeal from Decision of the Inspector of Buildings denying him a surplus
material permit and the application for Variance from the Pond Development
Section of the By-law that were submitted to the Board of Appeals. A lengthy
discussion followed in which Planner Grant stated he felt there was nothing
wrong in letting him have the variance because it was on his land and wouldn't

that the larger house be removed within a time period to be
specified by the Board of Appeals, after which the lots shall

(Parsons - Grant, all in favor) VOTED
Chairman Parsons returned as Chairman at this point.
11) Mrs. Margot Jellinek questioned the Board concerning Town Meeting Warrant
Articles. It was discovered that the warrant she had been given was for
the 1978 Town Meeting, not the 1979 Meeting.
