(Hartmann, Matoian, all in favor) VOTED 3) Michael Whalen of the Soil Conservation Service met with the Board prior to the Wetland Zoning hearing to explain the new map to the Board. Mr. Whalen noted most of his information was obtained from two booklets, "Soils and their Interpretations for Various Land Uses" and "Soil Survey of Bristol County, Massachusetts, Northern Part". He explained that the map he prepared is a combination of a soil survey map and a topographical map. They have the two originals and could make an original for the Town if it is needed. He stated, they outlined the very poorly drained soils and the poorly drained soils. (Planner Grant entered the meeting at this time) Mr. Whalen told the Board they should adopt the very poorly ;drained soils only for their zoning. He also noted they should change the wording of the article where it refers to Soil Association 21(Muck, Whitman, Scarboro, Ridgebury) to Muck, Whitman and Scarboro, deleting the reference to Soil Association 2 and Ridgebury. Ridgebury is a poorly drained soil. (Planner Mangiaratti entered the meeting at this time) Chairman Parsons noted this would open more wetland to development. Mr. Whalen said they could add poorly drained soils to the Article and it would be up to the developer to determine whether the area in question was wetland or not. He noted his survey just de£ines.the wetland areas. The difference between very poorly drained and poorly drained is the length of time the water table stays close to the surface. Mr. Whalen noted for the welfare of the community it would be more effective to add poorly drained soils to the article. Planner Mahana stated he would go along with the two classifications with a disclaimer that the poorly drained shouldn't be built on. Motion: To define areas that are very poorly drained, Muck, Whitman, Scarboro as wetlands, and poorly drained, Ridgebury with a disclaimer. Minutes March 14, 1979 Page 2 4) At 8:00 P. (Mahana - Hartmann, all in favor) VOTED 10) The Board discussed the Colonial Heights Subdivision plan. Planning Director Maurer stated a letter should be sent to Mr. Chavaree explaining what the Board wants corrected. Mr. Chavaree is in the process of reviewing the title of the cemetery and the right-of-way. The Planner felt there should be a plan of the Shaw's drainage. The cleaning of the culvert under Mill Street was also mentioned. It was noted that other developers had been made to clean culverts as a part of their drainage plans. The Planning Director noted that in those cases the ;culvert involved was downstream from the development and was necessary for the drainage. In this case the culvert is upstream from his development and his drainage is not affected. Motion: To send a letter to Robert Chavaree outlined changes to be made on the plan as follows: 1) Proper description of the easement that goes to the cemetery. 2 Amendment to the plan showing the revised drainage pattern adjacent to the property of the Shaw's. 3) The installation of a replacement culvert under the cart road that goes on the Starlin property. 4) The clarification of the drainage flow from behind lot #9 between the development and the Canoe River. An estimate of the amount of surplus material to be removed is also requested. (Grant - Matoian, ) 11) At 9:00 P. M. a public hearing was held on the Housing Authority Rezoning proposal. A complete transcript is on file. 12) After the hearing a vote was taken on Planner Grant's motion on Colonial Heights. (all in favor) VOTED 1.3) Planner Mangiarattl explained the Downtown Advisory Committee's proposal for the Fairfield Optical Property that will appear as Article 11 of the 1979 Annual Town Meeting warrant and asked for a vote of support from Minutes March 14, 1979 Page 4 Motion: Move the Planning Board endorse and recommend in favor of Article 11. (Mangiaratti - Mahana) Planner Mahana questioned if this was to be subsidized elderly housing, and if they could make sure it would always be available for the elderly. Planner Mangiaratti stated the way it is set up there aren't any guarantees that it will be used for the elderly, but it will be an attractive complex which is the only guarantee. To set it up strictly for the elderly the Town would have to build it itself. The idea is to not make the Town spend any money and to make the property tax generating. We would like this to be a downtown renewal project. Planner Mahana then questioned if the developer would qualify for any tax breaks. Planning Director Maurer said no, the purpose of the project is to get that property and the property around it to provide increased tax revenue. Planner Hartmann asked if the Fairfield property could be sold by itself. He stated his concern was that the price of the properties involved would increase the cost of development to a point that the units would be high rent units. Planner Mangiaratti stated if the proposal was of a high quality they would sell Fairfield alone at less than fair market value. The Planning Director noted the proposal was sent to twenty developers. They suggested that we limit it to one bedroom units. The developer must come in with a financing plan. Planner Mangiaratti noted the Downtown Advisory Committee has worked hard on this proposal to make sure we have the best possible plan. Planner Grant stated the maximum rent for subsidized unit would be $235. a month. Figuring out construction costs and cost of the land the rent they would have to charge would be around $600. monthly. Planner Mangiaratti replied that the concept has been looked atbya lot of developers and no one has come back and said this isn't feasible because of cost. This is a good way for the Town to control and supervise development in the downtown area. We put in as many assurances as we could that this will be for the elderly. The Planning Director added that there are enough checks and balances built into the project that the Town can say no up to the start of construction. Planner Matoian felt it was the wrong use for the down- town area, that it should be for commercial use. (Hartmann, Mahana, Mangiaratti in favor of the motion, Matoian, Grant opposed) VOTED 14) The Board reviewed the application of Nicholas Vicino for a Board of Appeals variance to construct an addition to Vicino Buick Pointiac GMC, Inc. Motion: To recommend that the variance not be granted because the extension of the building would create a safety problem at Minutes March 14, 1979 Page 5 intersection of Pratt and Chauncy Streets from visibility and access. M. 20) The meeting adjourned at 10:40 P. M.
