5) At 8:00 P. M. a hearing was held on the application of Robert E.
Chavaree for a Definitive Subdivision Plan entitled "Colonial Heights",
located on East and Mill Streets. A complete transcript of the hearing
is on file.
6) Mr. Leo Wolf and Mr. Vladimar Ouroussoff appeared before the Board to
discuss a possible "Cluster Zoned" project for property Mr. Wolf owns
on Tremont St., the former Chalifoux property. Mr. Wolf explained when
he purchased the property there was a valid Special Permit for 432 apart-
ment units with the property, but construction had to begin within two
years. He requested a change in the number of units, to fewer units,
before the permit expired, but the Zoning Board turned him down!. He noted
the case is in Court. He stated he would like to develop a Cluster Zoning
concept for the property to allow him to get the best possible use of the
land even if the Court allows him the 432 units. He doesn't feet there
is a need for 432 units. Under present zoning he is limited to 30,000
sq. ft. lots.
Planner Mahana asked how many buildings would be involved under his pro-
posal. Mr. Wolf said eighty. He noted there is a need for multi -family
housing in that area, and he doesn't want to go to Court, but wants the
highest and best use of the land for himself and the Town. He noted he
would be very interested in cluster zoning if he could build 80 to 100
units.
Chairman Parsons asked how large the total parcel involved was. Mr.
Ouroussoff stated there are 34 acres and they would be limited to 50
single family homes.
Planning Director Maurer noted the case has been in Court for five or six
years and during the last month they have been in contact with him to see
if it would be possible to approach the Board of Appeals to modify their
decision. Mr. Maurer said he suggested they make a proposal to the Town
Meeting for Cluster Zoning, but noted it would not be used as a negotiating
chip for the Court case, but it would be independent. Mr. Wolf noted if
the Town lost the case he would have to build the 432 units according to
the plan, but if the Town won he would be limited to the present zoning
for single family homes only. He said Cluster Zoning would allow him to
put in tennis courts, pool, and recreation area for the residents.
The Planning Director noted the Cluster Zoning proposed by the Town
limited the number of units to the same as a conventional development
while Mr_ Wolf's proposal" had one building for each 30,000 sq, ft., but
each building would have four units. Mr. Wolf left a copy of the pro-
posal for the members to study. Mr. Wolf also showed the Board drafts
of two different proposals on how the cluster zoning would be set up on
the; property.
7) The date for the next meeting was set for March 14, 1979 with three hearings
for that night.

8) Planning Director Maurer told the Board he would be meeting with Michael
Whalen on March 8, 1979 to get a copy of the new wetlands map. It was
decided to change the time of the March 14, 1979 meeting to 7:00 P. M.
to give members a change to study the map before the public hearing.
9) Planner Grant stated there were three things about the Colonial Heights
that he would like to discuss. The water problem on the other side of
the street; the Deed for the Cemetery; and the Simonds problem with the
lights and the possibility of broken windows. Chairman Parsons asked
the secretary to make a list of the high points of the hearing for the
members to 'discuss at the next meeting. Clerk Lesuer noted his concerns
were the lights on the greenhouses; the drainage involving the Shaw
property; the cleaning of the culvert under Mill St.; and the drainage
in back of the Holske property.
10) Planner Mangiaratti asked the Board for their formal support of the
Fairfield Optical Property Article in the Annual Town Meeting. Planner
Grant questioned the time limit for the acquisition of the property and
Planner Matoian questioned using downtown'' business space for residential
purposes instead of business. It was decided to further discuss the
article at a later date.
11) The meeting adjourned at 10:25 P. M.
