Decision from the Board of Appeals concerning the application of Frederick DeLutis - Granted 4) Motion: To approve the minutes of January 3, 1979 (Grant - Matoian, all in favor) VOTED 5) Planning Director Maurer reported on his meeting with Mr. Michael Whalen of the Soil Conservation Service done at the request of the Chairman after a suggestion to the Board that they would be willing to map wetlands for the Town. Mr. Whalen explained to Mr. Maurer that they have mapped wetlands for several communities and usually wetland areas are reduced. New wetland maps would define in greater detail permanent wetland areas that would have to be protected. Mr. Maurer noted that at present a third of the Town is protected. Mr. Whalen will meet with the Board on January 24, 1979 to discuss the mapping further. It was suggested that minor adjustments be made to modify the existing Wetland Protection Provisions and not rush into major changes. Changes suggested were.:to change the setback from rivers and streams to 100 ft. from the high Minutes January 10, 1979 Page 2 water mark, not the center line; change the setback from lakes and ponds and wetlands to be measured from the high water mark not the center line; have minimum lot size determined before any permits are issued by the Conservation Commission. Planner Grant felt they could allow building 75 feet from the high water mark because it is the septic system that could cause problems, not the building itself. He felt the septic system should be at least 100 ft. away and that Planning Board regulations should coincide with Board of Health regulations. The discussion was interrupted at this point for the Visitor's agenda. 6) Mr. Richard Staples appeared before the Board and explained he is interested in opening up another gravel pit and wants to have his monitoring wells installed. He wanted an opinion as to whether it would be possible to put them in now even though they are supposed to be in by December 1st. so he wouldn't have to waste a year. Chairman Parsons explained that the purpose of having the wells is to watch the water level for the entire period to get a complete profile. He told Mr. Staples to submit a formal request in writing and the Board would vote on it. 7) There was further discussion on how to determine the high water mark of rivers and streams for purposes of measuring the setback. The final consensus was to postpone further discussion until the January 24th meeting with Mr. Whalen and to invite the Board of Health and Conservation Commission and interested persons to attend to gain further input. Motion: To table further discussion of Wetlands until January 24, 1979, (Mangiaratti - Matoian, all in favor) VOTED 8) Gravel removal amendment - There was general discussion on the proposed amendments. Planner Mangiaratti suggested adding the statement "The removal of earth not otherwise covered by this by-law" to Section 8 - Surplus Material. Motion: To amend Section V -G by deleting sub -section V -G -2-b-8 and substituting in place thereof the following: 8) Surplus Material: The removal of surplus material shall include: a) The material from the construction of building foundations and other allowable structures for which a building permit has been issued. b) As may be required in the normal maintenance of property including private domestic gardening. c) As may be required in the performance of public works under the Municipal, County or State authority. d) Any removal of earth not otherwise provided for in this by-law. and to further amend Section V -G by deleting Section V -G -3-f-1 G" in its entirety and renumber succeeding sub -sections accordingly. (Mangiaratti - Grant, all in favor) VOTED Minutes January 10, 1979 Page 3 IE Motion: To see if the Town will vote to amend the Zoning By-law by deleting from Section V -G Earth Removal the following sub -section V -G -2-a and substitute in place thereof the following; a) No earth material shall be removed from any lot within the Town of Mansfield unless a special permit has been granted pursuant to this By-law. For the purpose of surplus material removal as defined herein, the Building Inspector shall be the permit granting authority. For all other earth removal the Mansfield Planning Board shall be the special permit granting authority. (Mangiaratti - Grant, all in favor) VOTED Pl:anner Mahana stated he would like to see Commercial Operation deleted from the By -Law. He noted that would eliminate 75% of the problems. The operations already in existance in Town would be protected under a "Grandfather Clause". Planner Mangiaratti noted there are areas in Town that could be developed that are being ruined by gravel removal. Motion: To eliminate commercial gravel operations in Town. (Mahana, - Mangiaratti) Discussion on the motion - It was noted the By-law would have to be amended to eliminate use variances for gravel removal. Planner Matoian felt the Board should find out the legal impli- cations of this before anything is done. (It was the consensus of the Board to put off a vote on this until all members are present) NO ACTION TAKEN Spruce Acres Subdivision Securities Motion: To go along with the Planning Director's recommendation.
