4) The Board reviewed the plans for ERE Corp. for their gravel removal operation
on land located off Maple Street. Planning Director Folkman told the Board
That the plans now have the road elevations on them and include a separate
cross section to give an overview of the project to show how the hill is
being cut. The locus is on the plan. He told the Board the application is
now complete as submitted. He noted the removal will be six feet from the
water table on a couple of the wells. No action was taken on setting a
date for the hearing.
It was noted that an item should be added to the Work Program to have
monitoring wells and test pits located on the cross sections.
5) The Board met with Paul Dalton and David Grant to discuss a new subdivision
of land in the Cabot, Cabot and Forbes Industrial Park. Planner White left
the room during the discussion. Mr. Dalton showed the Board plans of the
subdivision which will connect Norfolk Street with the new Route 140. He
explained to the Board that the old cul-de-sac which abuts Michelin Tire
Co. and King's Warehouse will be eliminated and portions of land will be
deeded to the abutters. He explained that lot 779 is a legal lot that will
abut Norfolk Street and Route 140. Karl Clemmey will have an easement
across lot 779 for access to Route 140. Mr. Dalton told the Board that
Norfolk Street is done through the base coat, binder coat and curbing. It
will be finished next spring. Mr. Dalton explained the layout of the
drainage to the Board and stated they would comply to the drainage regu-
lations. He noted that they have to get approvals from the State DPW on the
access to Route 140. He told the Board that the Plans will be officially
filed with the Town Clerk on December 18, 1980.
Motion: That pending receipt of the appropriate forms a public hearing
be held at a most expeditious date.

6) The Board met with Karl Clemmey to discuss a rezoning petition he wishes
to submit for the 1981 Annual Town Meeting. Mr. Clemmey told the Board
that he wants to rezone a piece of land he owns located across the street
from his Industrially Zoned land on West Street. It contains 41,000 s.f.
The land abutting is owned by the Commonwealth of Massachusetts and Casa
Drive. The land is presently zoned Residence A. He wants to rezone it

to industrial to build an office building there. He told the Board he has
160 feet of access on the street on the land to be rezoned. There is an
easement between his property and the Hagg property for the sewer line to
Casa Drive that goes out to West Street. He told the Board he could put
a buffer zone between his property and the abutting property. He told the
Board he will submit his petition to the Board of Selectmen.
7) Planning Director Folkman told the Board that he had called Mr. Rizzo
concerning the street lights and street sign on Plantingfield Road, and
he is agreeable to installing the street light and sreet sign now. lie
can't get a precast base right now, but would install the light if the
residents of Plantingfield Road will pick up the light bill until July 1,
1981. lie told the Board that Mr. Rizzo stated he would pick up the bill
after July 1, 1981 as that is when he had originally planned to install
the lights. The bill would be $9.00 per light per month, if he can get
the lights in this year. The weather is against him at this point. If
they can't get the light in this year they may try a temporary light.
Mr. Michael Avallone of Plantingfield Road told the Board that if there are
assurances that he will pick up the bill on July 1, 1981 the residents of
Plantingfield Road would go along with it. Mr. Avallone told the Board
that there is a meter there that Mr. Ronald Bonvie had put there that could
be used for a temporary light on a tree. Planning Director Folkman told
the Board that he felt the road should be winterized for snowplowing this
year and also wondered about the fire alarm system.
Motion: Move that the Planning Director be authorized to contact the
developers of subdivisions that have unfinished streets
requesting them to winterize the streets.
(Kaufman - Genatossio, all in favor) VOTED
Chairman Flynn told the Board that she felt that the Board should write a
letter to Mr. Rizzo asking him to have the lights installed by the first
of the year.
8) The Board met with Mrs. Margot Jellinek on earth removal. She presented
the Board with a copy of the Foxboro earth removal by-law, that was voted
in in 1979 and amended in 1980. She told the Board it is not in the Foxboro
Zoning By-law, but enforced by the Board of Selectmen, under Chapter 40,
Section 21, Paragraph 17 of the Massachusetts General Laws. She pointed out
sections of the by-law that stated that no earth in excess of 200 cubic
yards be removed from one acre, and no earth shall be removed from any
parcel of land within the Town except with a permit from the Board of
Selectmen. She suggested that Planning Director Folkman make copies of
the By-law for members and for herself. She told the Board that there
are 24 old pits in town that have never been brought to grade. She noted
that she felt it is important to have earth removal taken out of the Zoning
By-law. She stated that the Foxboro By-law is limited to 12 months with
a six month extension. Planner Genatossio asked Mrs. Jellinek if she would

like to have the Selectmen administer the law and Mrs. Jellinek said yes.
She stated the Selectmen can require the developer to pay for a civil
engineer. The by-law states exactly how much material can be taken out
for excess material. She stated she will recommend that this article be
put into the Town Meeting as an article.
9) Planning Director Folkman told the Board that he will report on the revised
fee schedule at the next meeting and will get something to the Board over
the Christmas holidays on parking. He stated he is thinking of taking the
entire section out and inserting new standards on earth removal. He will
have something for the Board at their next meeting. He stated he has been
getting a lot of information from the State and SRPEDD on aquifer zoning
and will get a copy of Dartmouth's aquifer zoning regulation. He stated
the parking and revised fee schedule will be ready for the Annual Town
Meeting, but the aquifer zoning may have to wait. He told the Board that
the memorandum from Paul Boyden on parking has some good information in
it. There should be a section on handicapped parking and he will outline
the various aspects of the parking that he will bring to the Board. He
said the parking regulations should be more black and white.
10) The date for the next meeting was set for January 7, 1981, at 7:30 P. M.
11) Under public discussion Margot Jellinek asked the Board to read their
Zoning By-law. The industrial section is very loose. The Ryan and
Elliot Park still has 30 acres to develop. SRPEDD warned the town to be
careful. She also told the Board that Codex Corp. is taking unbroken
hypodermic needles to the dump. She also said that there are three town
wells near the Ryan and Elliot Park.
12) The meeting aojzUrvied at 9:30 P. M.
