report for November it showed that Ronald Bonvie got his building permit
for the six unit apartment building on Pleasant St. Planning Director
Folkman told the Board that he had talked to the Building Inspector and
was told that the permit was granted because the Board didn't give a
specific reason for their recommendation other than the purpose and intent
of the By-law. Planner White told the Board he felt they should look into
the Downtown Business zoning requirements.
6) The Board met with Margot Jellinek about the Form A plans. She noted that
Clerk Kaufman noted that the Board is only looking to review the eight
points that have to be on the plan. She asked that the members read their
By-law. Clerk Kaufman told Mrs. Jellinek about the case that came down
from the Appeals Court two months ago which changed the Form A law and
says that the signing of the plan by the Board is a formality required by

law so that the plan can be recorded in the Registry of Deeds. Mrs.
Jellinek noted that he only heard one judges decision. The Planning
Board has to look out for the best interest of the Town not the best
interest of the developer.
7) The Board discussed the Form A - Approval Not Required plan submitted
by Bella Construction Company for land on Erick Road. Planning Director
Folkman told the Board there is no building on the lot and the Zoning
Board of Appeals decision has been put on the plan, and the wet area
has been put on the plan.
Motion: To endorse the Form A - Approval Not Required plan for land
on Erick Road submitted by Bella Construction Company.
(Parsons - White, all in favor) VOTED
8) The Board discussed the Form A - Approval Not Required plan submitted
by Theresa Pedro for 'land on Fruit Street. Planning Director Folkman
told the Board that there is frontage on a public way on one lot, but
lot #456 does not have enough frontage. He felt that it is not a
building lot, but just a transfer of land and he recommended that the
Board endorse it.
Motion: To endorse the Form A - Approval Not Required plan for land
on Fruit Street submitted by Theresa Pedro with the stamp
"Approval of this plan does not imply the approval of any
future roadway for any future subdivision."

of Beachwood Estates. They will not pave this year, because it is too
late in the season.
10) Planning Director Folkman told the Board he has talked to the Building
Inspector about the Morse Gravel Pit on Elm Street, but hasn't been
able to meet with Town Counsel yet. He will meet with Town Counsel and
report back to the Board at their next meeting. Clerk Kaufman noted
that if the Board didn't allow him to withdraw his application and
didn't do anything about the application it would be automatic approval.
It was decided to wait for Town Counsel's opinion and to invite him
to attend the next meeting of the Board.
11) Planning Director Folkman reviewed the revised proposed fee schedule.
He said he decided to leave the cost of the Zoning By-law and Subdivision
Regulations at $2.00/copy as that will cover the cost of the paper and
stencils.
On the earth removal fee it was noted that Foxboro charges .07 a yard
for gravel removed. It was decided to out .10 a ,yard for gravel removal
as Foxboro's charge has been in effect for several years.

On the subdivision preliminary fee the $100.00 will be applied as a
credit on the definitive fee. It was decided to change the inspection
fee to a lineal footage charge. The reinspection fee would be $100.
It was noted that a cul-de-sac would require additional work. Planning
Director Folkman told the Board it takes about 50 hours of his time to
inspect subdivision roads.
On the advertising fees it was decided to check with Town Counsel on
billing the applicants direct for zoning amendments.
Planning Director Folkman noted that the next step on the fee schedule
will be a public hearing.

was a problem. Chairman Flynn noted that it could be considered a
nuisance.
Cluster development was discussed. It was noted that the problem when
it was presented to the Town Meeting before was the problem of what to
do with the open spaces and who would be responsible for the land.
Planning Director Folkman told the Board he would like to get a copy of
the Plymouth Zoning By-law on their cluster zoning and PUD zoning.
It was noted that the fee for zoning violations should be raised to $100
