Planner White left the room during the discussion. Mr. Flueriel told the Board that the work is 90% complete. It has all been loamed and seeded. A bond is being held on the project. He noted that the bond'is up for renewal this week and he would like the Board to inspect the project and make a decision on the renewal or release of the bond. He noted they are working on a minor "punch" list of things to be completed. The work left to be done is not covered by the bond. Chairman Flynn told the Board she had viewed the pond and noted that there are still things to be done. Planner Seifert noted that the applicant or his agent must come before the Board and ask for the release of the bond. Chairman Flynn told Mr. Flueriel to submit the "as built" plans of the pond, plus a letter from the applicant requesting the release of the bond. It was also rioted that the original special permit for the development of the pond expired on September 18, 1980. (Parsons - Seifert, all in favor) VOTED 11) Planner Genatossio gave a report on the gravel by-law meeting she and Chairman Flynn and Planner White had attended at Stoney Brook Nature Center with Gary Hollands. She stated that it was suggested that gravel removal permits should be required for removal of material from location to location within a site as well as removal from one site to another. The purpose of an earth removal by-law is to prevent the land from becoming a wasteland after removal .of the earthen material. Applicants should have a plan for the future use of the land and it should be stated on the plan. It was felt that wetland regulations should be in the Zoning By-law as well as under Conservation Commission. The excavation of material can cause changes in the water table. The area to be excavated should have the same size watershed after the removal of the material as before. The access road should be paved, not just oiled to eliminate dust. It was felt that hydrological surveys and seismic exploration should be done eventhough this would be expensive for the applicant, it is the duty of the Board to protect the Town and not the applicant. Planner Genatossio felt that the Board should look into hazardous wastes also. She stated:that he mentioned aquifer zoning and that Falmouth and Dartmouth both have aquifer zoning in their by-laws. It was decided to send letters to Falmouth and Dartmouth and ask for copies of their aquifer zoning regulations. 12) The Board reviewed the letter from Town Counsel Charles D. Mulcahy on the Morse earth removal project on Elm Street. The letter stated that the Planning Board would have concurrent jurisdiction over this project with the Building Inspector, and suggested that they contact Mr. Cook to deter- mine what he intends to do regarding the project. Motion: To send a letter to the Building Inspector and ask for his comments on the letter from Town Counsel and ask what he intends to do about the situation. (Parsons - Seifert, all in favor) VOTED 13)_ Mrs. Margot Jellinek told the Board that if the sludge from the new wastewater treatment plant in Norton is hauled into Mansfield it will Minutes October 29, 1980 Paye 5 cost the Town $200 per day to rent a tank truck.
