a request that the special permit issued by the Planning Board and filed
with the Town Clerk on July 30, 1979 be extended for a period of one year.
8) Peter DeTrolio met with the Board to discuss his application for a, variance
to pave and landscape 'a vacant 'lot next to a proposed variety store at 428
Elm St. Planning Director Maurer told the Board that the present non-
conforming garage will be converted to a variety store which is -,allowable.
It is the lot next to the store which is -non -conforming. Mr. DeTrolio
noted that he would like to have cars exit from the; parking area onto Coach
Road. He noted that the blacktopped area extends 16' from the side of the
building now and he would like to extend it 32' more. He noted he would
like to have at least six or seven parking spaces. It was noted that the
proposed driveway onto Coach Road should be place as far back from the
intersection of Elm Street as possible. )
Motion: To recommend that the Board of Appeals grant the variance for the
parking to supplement the variety store at 428 Elm Street as
requested by Peter DeTrolio.

that Mr. Ash is in the process of applying to the Conservation Commission
for a wetlands hearing and it might be a good idea for the Board to wait
until that goes through and the Order of Conditions is issued.
.10) Planning Director Maurer noted that the Board cannot issue 'a decision on
the Richard Morse gravel removal. operation until October 22, 1980 because
of the Court decision.
91) The Board discussed the letter from Home Developer's Inc. requesting the
release of securities in the Magna Vista II Subdivision for the final inch
- of bituminous concrete. Planning Director Maurer sent a memorandum to the
Board recommending that the Board release $14,072.50. It was noted that

Motion: To release the sum of $14,072.50 from Taunton. Cooperative Bank
account #CF167 plus accrued interest for the final inch of

12) The Board reviewed the letter from BayBank'Norfolk Trust regarding the
Letter of Credit #1612 issued to the Town dated June 30, 1980 for $33,225.16
- for the account of Elmwood Park Realty Trust as a substitute for their
Letter of Credit #1156. The new letter of credit expires on July 5, 1981.
No action is required by the Board.
13) The Board reviewed the letter from Charles E. Downe, community and regional
planning consultant asking that the Board consider his firm when looking
for a consultant to *assist in the preparation of a water quality management
plan under the 701 funding that Mansfield has applied for. No action was
taken. The letter will be held until the grant is awarded.
14) David White left the room during the discussion of the memorandum from Planning
Director Maurer on the Woodland Park Subdivision drainage ditch. The Planning
Director explained that part of the project involved the relocating and
deepening of the Back Bay Brook. There were problems on the way it was
being constructed. He noted that work is progressing and some of the problems
have been corrected. Mr. Maurer told the Board.that the memorandum is a
status report and doesn't require any, action by the Board.
15) The Board discussed the application of Henley -Lundgren while David White was
still out of the room. Planning Director Maurer reviewed the Conservation
Commissions Order of Conditions and noted that according to the Order of
Conditions Henley Lundgren has to apply for a Conservation Commission hearing
because there is a change. It was noted the Board would also like to have
the Conservation Commission explain their letter that stated the removal
of the buffer zone would have a detrimental affect on the Town of Mansfield.
It was thought the the Conservation Commission may be confusing the buffer
around the pond and the buffer around the property.
Motion: To send a letter to the Conservation Commission and Henley -Lundgren
notifying them that they have to go before the Conservation Commission
Minutes

before the Board can act on their gravel removal application,
and also to ask the Conservation Commission to ,explain their
statement about not being ;in the best interest of the Town.

*Planner Kaufman entered the meeting at this point.
16) The Board discussed the letter from Town Engineer Stanzione concerning
the Rustic Drive drainage ditch and general specificatiorsfor drainage
ditches. It was the 'feeling of the Board :that the letter did not answer
the questions asked by the Board. It was felt that something should be
done about the problems on Rustic Drive. Planning Director Maurer ;noted
that the ditch has been like this for years, but didn't feel it was a
serious problem. He stated all the other drainage 'problems in Town have
to be considered as to seriousness. He noted that the ditch was seeded
:twice and the growth doesn't hinder the flow of the water during rain
storms. It was the consensus of the Board to send a letter to Thomas
Bonome DPW Director on•his inspection of Rustic Drive and what plans
there are for maintenance of retention areas. .
17) The Board discussed the Wind Chime Acres Subdivision. Planner Brugliera
left the meeting during the discussion. Planning Director Maurer told
the Board that the information and.revised plans went to GHR Engineering
yesterday. They will come back with a complete report on the drainage
i which is the first phase of the review. The; second phase will be the
pond. He noted that the revised drainage calculations show that 'there
will be a retention factor held in by the pond. GHR doesn't feel that
it,will be necessary to construct the downstream retentionarea. Mr.
Maurerreported on ,his conversation with Mr. 'Cummings of GHR. He noted
that they are :going to recommend that the drain line out to Ware St
be capped at the end. They need additional information on the retaining
walls coming in from Ware St., and they wanted the<revision'dates added
to the plan. 'Mr.'Gidley is going to start 'his study and evaluation of
the environmental impact of the pond ;and will come with Mr. Cummings to
the Planning Board meeting on July 23 1980: -
Mr. Bonvie told the:Board that during the 100 year storm the water will
flow over the.berm and into the pond and will reduce the flow of water
off the property..
Mr.Powers of Rustic Drive asked about the letter the Board had received
from Shell Oil Company on regulations governing the easement. Chairman
Flynn read the letterfrom the file.
18) Mrs, Margot Jellinek asked to be put on the agenda of the next.meeting
to discuss Camelot and asked to have the entire file at the meeting.

20) Chairman Flynn noted that it might be a better idea on Board of Appeals
applications to wait until after talking to the applicant to make a
decision rather than to let the applicant get involved in the decision
making process.
