Planning Director Maurer explained that on subdivision hearings the Board pays because when a subdivision plan is filed with the Town a fee is filed with it to cover expenses, but on Zoning applications the applicant pays the advertising fee. On the bill from the 'Press the Board will pay $37.10 for R. Bonvie and $23.85 for Camelot. >Chavaree and Willis will ;pay $25.18 for their zoning hearing. Motion: To approve the ;payment of $60.95 to the Mansfield Press for Bonvie and Camelot. (Seifert - Parsons, all in favor) VOTED Motion: To approve the payment of $127.97 to the New England Telephone Company. (Kaufman - Seifert, all in favor) VOTED 5) The Board discussed the letter from Town Engineer Stanzione concerning the application of Henley -Lundgren for an earth removal permit on South Main Street. The report on the water elevations of the test wells was reviewed. It was the consensus of the Board that they were satisfied with the information presented. Motion: To schedule:a public hearing on the application of Henley - Lundgren for an earth removal permit. Hearing to be July 9, 1980. (Seifert - Kaufman, all in favor) VOTED 6) The Board met with Peter Fontanini to discuss his request for an extension of his pond permit on South Street. Clerk Kaufman read the letter of request from Mr. Fontanini. Mr. Fontanini noted he should be able to complete the 'pond .within the next three months. He just got the water out by pumping. The dike isn't in yet. He noted that as soon at it is in he can start sloping and get the grades. He stated that he is going fence in the entire area. - D. W. White is doing the hauling. Motion: To ,extend the Special Permit for the development of the pond for Peter Fontanini for one year. (Parsons - Seifert, all in favor) VOTED 7) Ronald Dubuc of GHR Engineering Corp. introduced Robert S. Cummings, Project Manager and 'Richard R. DeBenedictis, President to the Board. Planner Parsons noted he had given his GHR report to Dr. Carr so they would have a chance to review it before the meeting. Mr. Cummings reviewed the report on Wind Chime Acres with the Board and Ralph Minutes June 18, 1980 Page 3 Maloon, Engineer for Ronald Bonvie. Also present were Ronald Bonvie,` Robert S. Mangiaratti and Dr. Jerome B. Carr. Mr. Cummings opened his report by stating that he has reviewed the subdivision regulations and the Zoning By-law and plans and found things that are questionable in their mind on how the pond is going to function. Under the recommended revisions of the report Mr. Cummings itemized and explained each point to the Board. 1. He noted the Town plans in the future to install storm drains ,on Ware Street. If the subdivision drains :are extended 140 ft. to Ware Street it would be beneficial to the Town. It was also recommended that they increase the size of the drain ;pipe and lower the drain dines six inches to accomodate the increased pipe size without decreasing the cover. Mr. Bonvie said that would be no problem if that is what the Town wants. 2. Mr. Cummings suggested that Mr. Maloon submit pipe strength calculations for the storm drain system and specify what type of pipe they are going to use. Mr. Maloon said that would be no problem. 3. Mr, Cummings stated the high points and low points on the centerline grades should be 'put on the plan. Mr. Maloon said that could be done. 4, Mr. Cummings stated the catch basins and manholes should be identified by station and offset. Mr. Maloon said that would .be no problem. 5. Mr, Cummings noted that the low water elevation of the proposed pond is shown as 117.5 feet, but is actually 118.0 feet because the spillway elevation is 118. feet. Mr. Maloon stated that they found the 117.5 ft. elevation in September or October, but the water elevation would probably be 118 ft. The calculations are done from 118. 6. Mr. Cummings stated that on Page 9 of the drainage calculations the height of the outlet was based on 117.5 when the elevation was 118. Mr. Maloon noted that could be done on the lots in question. 11. Mr. Cummings stated that the drainage area upstream of Ware Street is 150 acres coming into the pond, not 95 acres as stated in the calculations, according to the USGS map. Minutes June T$, 1980 Page 4 Mr. Maloon noted that the discharge elevation was correct, but the 117 ft. figure was put in the calculations in error. 7. Mr. Cummings stated they were requesting that they show the calcula- tions for the discharge at the 'inlet structure of the proposed pond and upstream to Ware Street, because they want to know the water level back to Ware Street after the pond is constructed. They want to know how high the water has to rise to get into the pond, and what the effect will be on the culvert at Ware Street. These figures should be projected for a 10 and 25 year storm. Mr. Maloon said that would be alright. 8. The calculations for the plan reference a coefficient that wasn't used. The equation that should have been used would be in the 0.025 to 0.030.range. It looks like 0.016 was used which is not representative of what will actually occur in the pond. He ,noted that they would like detailed calculations submitted. Mr. Maloon said that he would check that out, but he didn't think he used 0.016. Mr. Cummings noted that he was talking about the capacity of the pond to carry water from below the pond. The outlet structures may have to be revised. 9. Mr. Cummings noted that there is a portion of the swale that protects the pond from lawn run off and fertilizers that isn't shown on the plan. According, to the ,plan it looks like Lot #14 is graded directly toward the pond. Mr.'Maloon noted that they are draining to the pond at that point. Mr. Cummings noted that they felt the swale should be carried- completely around the 'pond to protect it from surface run off. He stated that they should show the detail on the plan to show how it .will be built so that it won't be graded off to the; pond. Mr. Maloon stated that would be no problem. 10. Mr. Cummings reported that the grading on certain lots could lead to ponding. For example on Lot #26 it could be graded so the owner doesn't have a buddle in his back yard. Mr. Maloon noted that could be done on the lots in question. 11. Mr. Cummings stated that the drainage area upstream of Ware Street is 150 acres coming into the pond, not 95 acres as stated in the calculations, according to the USGS map. Minutes June 18, 1980 Page 5 Mr. Maloon noted that they figured 95 acres because there are other brooks in the area that take some of the drainage. Under the general overview of the report Mr. Cummings made the following observations. 1Mr. Cummings noted that the drainage ditches are very flat and it t th 'thout endin u with puddling 2. 3. will be difficult to construc em wi g p He suggested the placement of crushed stone in the bottom of the ditches for a depth of 6" to 12". The ponding would be in the stones and it would be more aesthetically pleasing. Planner Parsons asked if the proposed 2 to 1 slope of the ditch would be adequate to hold vegetation. Mr. Cummings noted they may have to sod it to hold. They are responsible for establishing vegetation. He stated the 2 to 1 slope would hold, but a 3 to l slope would be easier. Mr. Maloon noted they could go to 3 to l slope for the sides of the ditch and it would be, easier to grow the grass. Mr. Cummings noted the grading on certain lots could easily be revised :to provide positive surface drainage at the low points of the roadway to prevent the roadway from being excessively flooded. Mr. Cummings noted that on the future ;ponding area the grades are shown as they are now. Mr. Maloon noted that this area is a swamp now and the idea is to let it go back to swamp after the construction of the subdivision. Mr. Bonvie noted they are trying to leave the trees and humocks to leave that area as natural as possible. He stated it is not going to be near any houses; Planning Director Maurer noted that the reason the future ponding area was put in was to try to minimize the .affects of the development off-site. Mr. Cummings noted that based on the calculations It seems that the pond will do a decent. job of taking care of downstream flooding. He stated they don't feel; there is a need for this ponding area. Mr. Maloon stated that the level of the swamp would be a buffer to hold the water back from reaching the Canoe River to quickly in a large storm. The retention area would slow the flow down. He noted that the pond is being placed where there is swamp and they wanted to put back the swamp that was taken away by filling in. Minutes June 18, 1980 Page 6 Mr. Cummings told the Board that they want to get the hydrologics squared away to see how the pond will function. They don't see any advantage to the ponding area. He felt they should put the loam back on the area. Dr. Carr noted that this area is a discharge wetland area as opposed to a recharge wetland area. Planning Director Maurer asked if it would be possible to grade around some of the large trees in this area rather than clearing them all. Mr. Cummings said he thought it would, work out if you had:a 2% grade. Planning Director Maurer noted that the Conservation Commission had wanted this future ponding area stripped clean. Mr. Maloon noted that they diverted a lot of water that was going into another area into this ponding area The area that was diverted comes to the same swamp, Mr. Cummings stated that they don't see a lot of benefit to having this future ponding area, but if they are going to do it use a 2% grade. 4. Mr. Cummings noted they went through Section I-2-a of the Zoning By- law on wetlands. Wetland areas are defined as soils described as very poorly drained or poorly drained ,soils by the U. S. Soil Conservation Service. He noted that Lots 14, 18, 22,`38, 42 17 21, 25,:29, 33, 37, 41 and 45 on Wind Chime Drive and Lots 24, 28 32 and 36 on Erin Drive would not be buildable, because they ;don't " meet the 25,000 sq. ft. requirements. He showed the Board an over lay of the subdivision with the wetland map. The way the By-law is written it specifically refers to the maps and not an on ground survey. He 'noted that a lot of the information on the plan is based on surficial_soils. Mr. Maloon stated they have a number :of test holes on those lots that show that it is not poorly drained soil. Attorney Mangiaratti noted that this was Mr. Cummings interpretation of the By-law. 'If sampling was done on the site you could map out the area which would be more accurate. He noted he doesn't feel the map is definitive enough. Mr. Cummings suggested that if they go to the site to take 'soil samples they have someone from the Soil Conservation Service go with them. 5. Mr. Cummings noted that the Conservation Commission's Order of Conditions has been appealed to the DEQE. He noted they now have to file and Environmental Notification Form. It is possible they may require an Environmental Impact report. The planning Board may want to delay any final decision until the drainage issue is resolved. The DEQE has 70 days to reach a decision as to whether Minutes June 18, 1980 Page 7 you need a report. He noted the DEQE wanted a copy of their report so they, could work together. Mr. Cummings told the Board he wanted to see revised calculations tosee how the pond is ,going to work. He suggested that they grade the easements and ditches on the definitive plan as well as the pond. Mr. Maloon noted he would be able to get the information Mr. Cummings wanted by next week. Mr. Cummings noted that after they get the revised calculations it would take them day or two to look at it. Mr. Mangariatti wanted to know what the Board wants them to do on the defining of the wetland area. Planner_ Parsons stated that they felt the Soil Conservation Service should be contacted to do-the survey and that the Board should contact them. Mr. Bonvie presented a request for a two week extension on the approval of his plan to the Board. Motion: To :grant a 14 day extension to Ronald Bonvie on his subdivision plan to July 9, 1980. (Kaufman - Parsons, all in favor) VOTED 8) The Board discussed the Ash gravel removal ,plan on Elm Street. Planning Director Maurer told the Board he ,had contacted Whitman and Howard, ,Inc. and they are going to come out and meet with Ralph Maloon to locate the well on the -;plan. 9) The Board discussed the letter from the Shell Oil Company on the regulations for crossing the easement. The letter will be filed for future reference. 10) Mrs. Margot Jellinek asked the Clerk to read the Board's letter to Town Counsel on Camelot. She also noted that nothing has been done ;in Circle, M in the last two weeks. She said if an extension is granted on the letter of credit the Town could lose the money. 11) The date for the ,next meeting was set for June 25, 1980 at 7:30 P. M. 12) The meeting adjourned at 10:25 P. M. Clerk Gd Date
