The Planning Director explained that they wish ,to join the two operations and remove the buffer separating the two properties,. He 3 4 of his pit. noted that Mr. Morse 'still has to finish sections and Motion: To hold the public hearings for the Ash gravel removal permit and Morse gravel removal permit on June 25, 1980. (Seifert -'Kaufman, all in favor) VOTED 7) The Board discussed the Board of Appeals application of Marc Weise to move a single family dwelling to 2 Oak St. The dwelling would be 72 ft. from Hodges Brook. Mr. Weise explained to the Board that the bottom of the cellar would be 5 feet above the 100 year flood elevation. He noted that if the house were moved forward away from the brook it would require a lot of fill and would change the contour of the land. Motion: To recommend that the Variance requested by Marc Weise be denied. (Parsons - Genatossio,,all in favor) VOTED 8) The Board discussed .the Board of Appeals application of Brenton Miller of. 366 Willow St. to build a carport attached to his garage that would be 5 ft. from his, property line. Motion: To recommend that the variance requested by Brenton Miller be granted. (Brugliera - Seifert; Brugliera, Seifert, Flynn, Kaufman, Parsons in favor;<Genatossio abstained) VOTED 9) Mrs. Margot Jellinek asked if Planning Director. Maurer would tell her what is 'going on in Maverick Drive. Planning Director Maurer brought the Board up to date. On Pinto Way they checked the grades to make sure it would drain properly. The Town Engineer made a recommendation to put more catch basins in. He noted that a lot of the work that Peter DeGirolamo has had to do is to bring the road back to a standard that it was at three years ago when the binder coat was installed. The aprons of the driveways had to be cut back and the risers from the water 'gates had to be replaced. The Planning Director noted that Peter DeGirolamo is making a responsible effort to get the work done, He also noted that one of the performance bonds had expired, but has been renewed and is still in effect. Mrs. Jellinek told the Board that the curbing on Maverick Drive is three inches too low, and the drainage is constructed wrong. She stated the covenant has expired and the work was supposed to be completed on September 26, 1976. She also stated there is not enough money in the bond to finish the project. Planning Director Maurer read Minutes May 28, 1980 Page 4 is and also noted that there is 'sufficient 10) C 11 c the General Laws on covenan 's work. He noted the work is going to money to cover Mr. DeGirolamo cost around $30,000 and there is $40,000 in the bond. Mr. Adam T. Kosciusko appeared before the Board to discuss the Corrofab Site plan application. Mr. Kosciusko noted the plan was submitted to the Board in March. He stated the Town has not surface sewer in the area, the water from the street goes into the parking lot.He said they resubmitted the plan on Apri1.14, 1980 and added a berm. He noted that they can't cross the Shell Oil Pipeline with a drainage pipe, and they are trying to get the water away from the Conservation Commission land. Planning Director Maurer read the Board's letters to Corrofab dated April lith and April 25th explaining the changes the Board wanted on the plan. He also read Corrofabs letter of May 5, 1980. Mr. Kosciusko noted that they have been waiting 2-1/2 months for an answer. He stated that two items that the Board has requested connot be done. Chairman Flynn told Mr. Kosciusko that she didn't feel, he should have gone ahead with the paving. Motion: To approve the site plan because it meets the minimum requirements of the Zoning By-law. (Parsons Seifert) Planning Director Maurer noted that the paving has been done and the building has been started without a building permit. (Parsons, Seifert in favor; Genatossio, Flynn, Kaufman, Brugliera opposed) NOT VOTED Motion: To have the Town Engineer and Mr Kosciusko review the ,plan together next Wednesday night at the meeting. (Brugliera - Kaufman, all in favor) VOTED The Board discussed the Wind Chime Acres Subdivision. Planner Brugliera left the meeting during the discussion. Planning Director Maurer reviewed the list of conditions suggested for the engineering evaluation of the _subdivision. He suggested that the Board refine the scope of services - the want completed and send it to the engineers of their 'choice and have them get back to the Board next week with their. proposals. The Planning Director recommended Whitman and Howard and Paul Gidley Laboratories. Chairman Flynn told the Board she had talked to Donald Reed from Norwell who is a geologist from MIT and has thirty years experience. It was decided that if Mr. Reed wasn't interested the Board would go ahead with the other two choices. Planning Director Maurer noted that most of the other consultants did not have the combined expertise on pond and sub- surface drainage. Minutes May 28, 1980 Page 5 Chairman Flynn reviewed the .letter received from .the Town Engineer on the project. Motion: That the Board contact Whitman and Howard; and Paul Gidley Laboratories plus Donald Reed and present them with enough information so theBoardcan get an estimate of how much it will cost to do the study. The study will have to be completed by June 18, 1980. The Town Engineer's suggestions shall be incorporated into the proposal. (Kaufman -'Parsons, all in favor) VOTED Ronald Bonvie told the Board he had received their letter on the corrections on the plan and he wanted to know how the Board will handle the easements to be owned by the Town. He noted that he is trying to get all the corrections done by the next meeting. He noted that each person abutting the pond would have ownership of the pond and one person would have control of the control structure. The ditch would be owned by the Town. Chairman Flynn wanted to know who would clean the retention area. Mr. Bonvie replied that they would have to talk to the Engineer and Dr. Carr on that. He said that three of the lots abutted the retention area. Planner Parsons noted that the easement should have some type of service road along with the ditch. Mr. Bonvie noted there would be no problem with any of that, and said there is access to the pond by the Fire Department over the Shell Oil Company easement. He stated that the Shell Oil Company is going to send a design to him on how to do the road over the pipeline. Comments were received from abutting property owners concerning the Shell Oil pipeline. The Board reviewed the letter from Mr. Marconi asking that certain conditions be considered when the hydrologist does a study of the proposed development. It was decided by the Board to .have the consultant walk the site and to have him confer with the Town Engineer. The letter from Mr. Marconi on the Shell oil line was read. R letter from Courtney Marconi was reviewed asking the Planning Board to read the denial of the Rustic Drive development. Planning Director Maurer read from.the Rustic Drive folder and explained that on ' March 12, 1974 the Board voted to turn the plan 'down because all of the information as requested by the Board was not submitted. .He noted that the plan turned down was the preliminary plan. In 1977 the developer submitted a definitive plan and made adjustments on the plan from 1974 and the plan was then approved. The Board reviewed the letter from Town Counsel in answer to a question from the Conservation Commission stating that the ditch is not a part of the pond. Mr. Bonvie noted that the reason the ditch was put on that side of the pond was to protect people from getting into the pond. If the ditch was on the other side of the pond that would mean the abutters would have a ditch between themselves and the pond. Mr. Bonvie also told the Board that Dr. Carr's design was done on the Morse-Decco method and not on the rational method. Minutes May 28, 1980 Page 6 12) The Board discussed the proposal for funding for comprehensive planning assistance. Motion: To make the application to Community Affairs on water quality management. (Parsons - Seifert) Chairman Flynn stated she felt that SRPEDD could do the study. The Planning Director stated that he felt that their study was too general. He 'noted that the water quality management study would be a town wide benefit instead of a study of the Canoe River Basin which would only benefit a small area of the town. He stated they are looking for projects that would benefit the whole town. i Vote: All in favor) VOTED 13) Under public discussion Mrs. Margot Jellinek stated she objected to the two engineers the Planning Director had suggested. 14) Motion: To write a letter to Shell Oil Company and ask for information on their regulations concerning the pipeline easement. (Seifert Genatossio, all in favor) VOTED 15) Motion: To write a letter to the Building Inspector on Corrofab and suggest that a cease and desist order be sent to them. (Brugliera - Genatossio; Genatossio, Kaufman, Brugliera, Flynn,' in :favor';?Parsons, Seifert opposed) VOTED 16) Planner Parsons asked what is happening on the Day/Blandori suit against the Board. Planning Director Maurer noted ,that the Town has filed an answer and it is now up to the attorney for the developer to carry the ball on it.. 17) The date for the next meeting was set for Wednesday, June 4, 1980 at 7:30 P.
