The Board discussed the letter from Ropes '& Gray concerning Industrial -
revenue bonds for Corrofab, Inc. - Second series. Planning Director
Maurer noted that Corrofab has not had site plan approval and has
started paving and construction on the building without a permit. He
recommended that the Board withhold approval on the financing until
local zoning regulations have been complied with.
Motion: To send a letter to Ropes & Gray with a copy to Corrofab,
Inc. noting that they haven't met the provisions of the
Town's zoning By-law.
(Brugliera - Parsons, all in favor: VOTED
6) ,Planning
Director Maurer reviewed his memorandum on the application
for funding for comprehensive planning assistance. He outlined the
criteria and noted that to be eligible the Board has to select a
project to be submitted by the first of June. There would be '$10,000
coming from the 'Federal Government and the Town would have to match
thel.grant with in-kind services. Planning Director Maurer suggested
two possible projects that would be eligible. An analysis of the
development pattern and land use standards along the Canoe River and
a follow-up on the preliminary water quality management plan prepared
by SRPEDD last fall. Planner Parsons felt the water quality management
plan would be the best to attempt. No action was taken as members
wanted to think about it for a week.
7) Robert E. Chavaree and Allen L. Willis, Jr. appeared before the Board
to discuss their proposal to restore Cabot Pond. Mr.`'Chavaree, showed

the Board a plan that has been drawn of the pond including the
additional information requested by the Conservation Commission.
The Plan was drawn to be in conformance with Corps of Engineers
standards because they have requested that Chavaree & Willis go
through, the permit process. Mr. "Chavaree ,reviewed the Conservation
Commissions order of conditions and showed on the plan where the.
conditions have been addressed. He noted on the request for additional
borings that Dr. Carr had reviewed the borings and didn't feel that
the area required additional borings. He noted that they will stop
work within 30 feet of Willow St. and then with the slopes it will be
effectively 90 feet from Willow St. Mr. Willis told the Board that
the IEP report noted that during a flood the dam ;failed, and he stated
he was there at the time and it was the culvert that failed not the
dam.
Planner Genatossio played a tape on comments Dr. T. T. Chaing had made
on general pond development including flushing and the need for a lower 6
outlet to draw the water down. Mr. Willis noted that the comments were
of a general nature and not specifically about Cabot Pond and felt that
Dr. Carr had adequately addressed the problems.
Planning Director Maurer reviewed the comments in his memorandum to the '
Board dated May 14, 1980 on the Cabot Pond restoration and noted that
the 100 year flood elevation is not shown on the plan and the 'report
on the dam isn't complete.Mr. Chavaree noted that the 100 year flood
elevation is available on other documents,' It was decided to give Mr.
Chavaree and Mr. Willis a copy of'the ,memorandum.
`
8) The Board discussed the Wind Chime Acres subdivision plan. Planner l
Brugliera left the meeting during the discussion. Planning Director
Maurer reviewed his memorandum on the criteria for an engineering
evaluation of Wind Chime Acres. He told .the Board he has contacted
three engineering firms to discuss the possiblity.of their doing
consultant work on the project and gave the Board background information
on the three which include, Dr. T. T. Chaing of Whitman & Howard,
IEP, Inc. of Wayland and Walter Amory Engineering ,of Duxbury. He noted
the cost ranged between $500 and $1,000. They would all, bill: the Town
on a per hour basis. They all noted they could better determine the
cost after they got the information. Planner Genatossio told Planning
Director Maurer she would give him the names of firms she had contacted
during the time the League of Women Voters was working on the pond
article. A consultant was not chosen because 'a quorum of the Board was
not present.
It was the consensus of the Board to send a letter to the Town Manager
asking him to have the Town Engineer to submit' information on Wind ¢
Chime Acres to the Planning Board before he goes on vacation.

The letter from Robert S. Mangiaratti concerning the amendment to
Massachusetts General Laws, Chapter 41, Section 81L which now reads.
"Drainage, shall mean the controlofsurface water within the tract
of land to be sub -divided" was discussed, as it relates to the Wind
Chime Acres Subdivision plan. It was the consensus of the Board
members present to write a, letter. to. Attorney Mangiaratti telling him
the date the preliminary plan was submitted was ;prior to the effective
date of the new law and that the (Board is aware of the regulation.
The Board discussed the letter from the Conservation Commission to the
Board on the ditch in Wind Chime Acres that is -within 50 feet of an
abutting property line. It was the consensus of the 'Board members
present to send a letter to the Conservation Commission to tell them
the Board thinks it is a part of the water body and therefore should
be 50 feet from the property line.
Planning Director Maurer told the Board he didn't think they should
send Mr..Bonvie a list of recommendations to be complied with at this
time because if he complies with'them the plan has to be approved. He
felt the Board should wait until they get their consultants report.
Planner Parsons noted he would like to have Mr. Bonvie outline how the
pond ownership is going to be handled and the elevation of the septic
r systems on Rustic Drive in relation to the pond and the elevation of
the Shell Oil Company easement. It was the consensus of the Board to
write a letter to Mr. Bonvie asking for this information. Planning
Director Maurer noted that ;the letter should state that this is not a
final list ibecause ;of the independent evaluation planned.'
Mr. Bonvie told the Board that the shoreline of the pond is 50 feet from
abutting property and he doesn't feel that the ditch is part of the pond.
9) The Board discussed the site plan application from Cabot, Cabot and
Forbes for land on West Street to be used by Texas Instruments. It was
noted that the correction :requested at the last meeting had been made.
There is only one entrance onto West Street.
Motion: To instruct the :'Building Inspector that the Site plan presented
by Cabot, Cabot and Forbes for land on West Street meets the
site plan requirements of the Zoning By-law and recommend
that he issue a building permit.

Planner Parsons told the 'Board that the issue that the 'Board advertised
for suspension of the subdivision approval was the ditch. He noted
that the, ditch has been filled. Therefore, the situation is as it was '
before. He stated he doesn't think the Board now has any grounds to
go forward for the removal of the permit. He recommended that the
Board vote against the motion. Planning Director Maurer noted that
he and the Town Engineer viewed the site on Monday and the ditch has
been filled. He tstated they didn't see any standing water in any of
the test holes where they walked. He noted that a question was raised
on a pipe in a pond and they saw what looked like a pipe. Mr. Stanzione
went into the water and the "pipe" turned out to be a birch log.
Chairman Flynn noted that there are four:perc holes that were three
feet deep. Mr. Wiezorek of Williams Street stated that the pipe is
under where the ditch was dug this spring and then filled. Planning
Director Maurer showed Board members the plans of Camelot which had
the original restrictions set by ,the Board incorporated into the plans,
for the subdivision approval.
Motion: To amend Planner Parsons motion to read, "to have Mr. Antosca
agree to dig up the area or prove to the Board that a pipe
does not exist in the area under question.
{Genatossio - no second.
