(Matoian - Hartmann, all in favor) VOTED 5) Motion: To approve the warrant for $5.67 for supplies from Bristol Office and School Supply.VOTED (Hartmann - Morrison, all in favor) 6) Attorney Joseph Santos appeared before the Board representing Norman Gray to speak on the proposed rezoning of the Gray property on South Main Street to industrial for Thomas Flatley. He told the Board that Flatley has the Gray property under agreement and he would like to be able to control the non-residential growth in that area. He wanted to know if the Minutes January 23, 1980 Page 2 Planning Board would sponsor the article or would Mr. Gray have to, and if Mr. Gray did, would the Board support it. Chairman Parsons told Mr. Santos that the Board wouldn't be in favor of an article that included just the Gray property, and wouldn't really be in favor of a rezoning article in that area at this time. He noted that the utilities in that area are a problem and that there is enough land zoned for industry in Town. Attorney Santos stated that the land would not lie fallow, it would be developed. He noted that the Flatley people would make a substantial contribution to the Town to offset the cost of bringing the utilities to that area. Planner Kaufman asked how many acres of buildable land there would be. Attorney Santos stated 106 acres. He noted that Flatley would be prepared to transfer title of a portion of the backland'to the Conservation Commission. He stated that there was also a group that was interested in access to the Great Woods. They would deed access to the Great Woods to the Town. Attorney Santos stated the land would be developed over a period of 5 to 6 years. He stated there is an area is excess of 250 acres that could be developed under different ownership. Chairman Parsons asked wha the contribution would be to the utilities. Atty. Santos said he couldfsay exactly at this time, but it would be substantial on water and something for sewer. He noted that he had talked to the Town Planner on restrictions greater than required in the By-law especially on land coverage and they would go along with that. Planning Director Maurer told the Board that he felt that Cabot, Cabot and Forbes restrictions exceed those of the Town and he feels that this one should too. Attorney Santos noted that Flatley has done substantial development and mentioned the Dedham Mall and Cobbs Corner Mall as having been taken over and improved by Flatley. Chairman Parsons polled the Board on their feelings on rezoning South Main Street and everyone agreed that they do not want to rezone at this time. Planning Director Maurer noted that the CC & F development is only 50% complete and the concern was that we have received substantial benefit on that and the concern was expressed for us not to become a totally industrial community and that the balance might tip the other way. Attorney Santos noted that he would recommend to Mr. Flatley that the warrant article be brought and prior to the public hearing he would like to bring to the Board ultimate layouts and methods of developing the land. He noted they would be willing to put in a water line even larger than what they would need. Planning Director Maurer noted that the new treatment plant wouldn't be completed until 1983. Attorney Santos noted that by the time they get the roads and utilities in, and that the sewer lines would be put into the development so that when the sewer became available they could hook into it. Minutes January 23, 1980 Page 3 7) Chairman Parsons told the Board that there are 300 acres of land zoned for industrial on Branch Street and Gilbert Street that could possibly be rezoned from industrial to something else and then possibly the land on South Main Street could be zoned industrial and the balance would stay the same. Planner Flynn suggested that the Board write to the Industrial Development Commission and ask their opinion on the proposal. It was the consensus of the Board to write to the IDC. 8) The Board discussed the Day/Blandori subdivision plan. Planning Director Maurer noted that as a result of the meeting at the site with Engineer Ralph Maloon on Saturday the pitch on the pavement where it joins the paved portion of Webster Street has been revised on the plan. It was mentioned that the largest outstanding item is the documentation on the street. Town Counsel stated in his letter to the Board that the appli- cants for this subdivision proposal should run a comprehensive title search to determine what was retained by the common grantor of all of the land, and evidencing the chain of title for all of the surrounding land including plans for the laying out of Morrow Street, Webster Street, and Perkins Avenue. Motion: Send a letter to Day/Blandori asking them to submit to the Board a comprehensive title search evidencing the chain of title for all the surrounding land including the laying out of Noonan Street, Morrow Street, Webster Street and Perkins Avenue. (White - Hartmann, all in favor) VOTED Chairman Parsons noted that the Board had walked the entire piece of property on Saturday morning and found it to be a good piece of property. 9) Planning Director Maurer told the Board he had talked to Whitman and Howard about pond development. He showed the Board a tracing of a map from SRPEDD showing the acquifiers in Mansfield. He also showed a map from Whitman and Howard that shows the tests done in the past 30 years for new well sites. He explained the recharge areas as shown on the map. Mr. Maurer noted that the main source of water the Town has is the Cate Spring well and explained that the Town is going to develop 2 new wells in the area, but they can't pump all three together. East Mansfield is the best source and the land is all owned by the Town. The Planning Director noted that the high yield acquifier areas shown on the acquifier map from SRPEDD correspond with the testing done by Whitman and Howard. Mrs. Margot Jellinek noted that the Cate Spring Canoe River Basin contains about 8 million gallons. She stated that Norton is pumping 3 million, Mansfield is pumping 1 million and Easton pumps 2 million. She stated Mansfield should look elsewhere for water supplies. Minutes January 23, 1980 Page 4 Planner Kaufman stated that he felt that the article to eliminate pond development as submitted by the League of Women Voters would not stand up in Court. He noted he would like to see pond development prohibited in acquifiers pumping more than one hundred gallons a minute. Planning Director Maurer explained that none of the ponds that have been developed under the pond development requlations have been in acquifers. Motion: That the Town prohibit the development of ponds in acquifier areas of greater than one hundred gallons per minute as shown on the map from SRPEDD in brown and orange, and the USGS study map. (Kaufman - Flynn,) Planner Kaufman felt that this would be a safety measure to protect the water supply until a comprehensive plan is developed. (Kaufman, Flynn, Morrison, White, Hartmann in favor; Matoian opposed) VOTED 10) Planner Morrison left the room while the Board reviewed the Form A - Approval Not Required plan submitted by Arthur Morrison to divide a parcel of land on Willow Street into two lots. It was noted that a portion of the property would be used by the Willowdale Golf Course. Motion: To approve the Form A - Approval Not Required Plan submitted by Arthur Morrison for land on Willow Street. (Hartmann - Matoian, all in favor) VOTED Planner Morrison took the Plan with him after the meeting. 11) The Board reviewed the Annual Report draft that was sent to members with their minutes. Motion: To approve the Annual Town Report as written. (Hartmann - Flynn, all in favor) VOTED 12) Richard Curley of Webster Street told the Board he was concerned about the Board approving a subdivision with a non -conforming lot and quoted Section IV, Schedule "B" to the Board. Chairman Parsons told Mr. Curley that a variance from the Board of Appeals would have to be obtained before that lot could be built on. 13) The date for the next meeting was set for January 30, 1980. 14) The meeting adjourned at 9:50 P. M. Date
