(Hartmann - White, all in favor) VOTED Mr. Mangiaratti took the linen of the plan with him after it was signed by the Board. 6) Mr. Richard Curley appeared before the Board to discuss the proposed subdivision of land on Webster Street and Perkins Avenue owned by Day and Blandori. Mr. Curley asked when the transcript of the hearing would be completed and was told there is a problem with the machine that is used and there is no way of telling when it will be available. Mr. Curley noted that he had mentioned at the hearing that two of the proposed lots did not have the required frontage and the letter the Board wrote to the developer stated only one lot did not have frontage. He was told the matter was discussed and it was the opinion of the Board that only one lot had a frontage problem. Mr. Curley noted the Board had asked resi- dents of the area how their deeds read at the hearing and stated that when he bought his house he was told that when the deed is described by street name instead of in numbers it runs to the center line of the street. This is found in Chapter 183, Section 58 of the General Laws. He also referenced Chapter 82, Section 23 of the General Laws on accepting streets and asked the Board to determine if the streets had been accepted. He noted his primary concern with the subdivision is the drainage. The soil association maps were reviewed by those present at the meeting. Minutes January 9, 1980 Page 3 7) The letter from the Mansfield Co-operative Bank telling the Board that $9,409.95 is being held in Account #C-357 for Securities for Meadow Lane in the Strawberry Meadow Subdivision owned by A. L. Willis Co., Inc. was reviewed by the Board. The Board is being asked to release Lots # 2, 3, 8, and 9 as shown on a plan entitled "Strawberry Meadow, a sub- division in Mansfield, Mass. dated February 1, 1977" Motion: To accept the Letter of Credit from the Mansfield Co-operative Bank Account C-357 for $9,409.95 and to release Lots #2, 3, 8 and 9. VOTED (Hartmann - Kaufman, all in favor) 8) Planning Director Maurer reported to the Board that Olividio Scarpellini requested more money released for the loam and seeding on his subdivision on Fox Street. Mr. Maurer noted that the loam is piled up and ready to be spread but can't be done until spring. He noted that it is his recommendation to not release any more money until the work is done. Motion: To go along with the Planning Director's recommendation and not release any money until the work is completed. VOTED (Hartmann - Kaufman, all in favor) 9) The Board reviewed the Memorandum from the Planning Director on possible articles the Board could sponsor the the 1980 Annual Town Meeting. Planning Director Maurer told the Board that street acceptance plans for Rustic Acres, Spruce Acres and Riverside Park have now been received. Mr. Maurer told the Board they should consider if they wish to sponsor the article on pond development as presented by the League of Women Voters or look into strengthening the existing regulations or possibly just leave it as it stands now. 10) At this point the Board adjourned to the Selectmen's Meeting Room to parti- cipate in the joint meeting between the Planning Board, Board of Health, Conservation Commission and Board of Selectmen, including Town Counsel Charles D. Mulcahy. Chairman Ed Tartufo, Clerk Fran Gasson and member Louis Diamond were present from the Board of Health. Chairperson Doris Webb, Jane Sheehan and Paul Boyden were present from the Conservation Commission. Chairman Lyman Avery, Clerk Norman Mahana, Tony Caponigro and Robert DeLong were present from the Board of Selectmen and all members present for the Planning Board meeting attended the joint meeting. Chairman Flynn gave a presentation on the responsibilities of the Planning Board for Form A Plans, Site Plans and Subdivisions. Selectman Caponigro explained that the reason for bringing the Boards together was to clarify what each Board is supposed to to in certain situations and to see if the Boards could coordinate their activities. Selectman Chairman Avery asked if there is conflict between the Boards as far as wetlands go or if everything is running smoothly. Mrs. Sheehan noted that what was in the paper was not what was actually said at the meeting that brought about this joint meeting. She noted that there is Minutes January 9, 1980 Page 4 a timetable set down by the State that the Commission has to follow. She also noted that in some cases by the time a plan gets to the Conservation Commission a lot of money has been spent on engineering. Planning Director Maurer explained that when a preliminary or definitive subdivision plan is submitted to the Planning Board copies of that plan are forwarded to various Boards, Committees and Town Departments for their comments, including the Conservation Commission and Board of Health. He noted that the State law had read that a person had to get all other local approvals before going to the Conservation Commission, but that law has been changed. Mr. Maurer told the gathering that the Board of Health has 45 days after a plan has been received to make a recommendation to the Planning Board. The Planning Board has 60 days to make a decision. He noted that the Board of Health requires perc test results to be submitted with a definitive subdivision plan. Conservation Commission member Paul Boyden felt that the developer should go before the Conservation Commission before any work is done. Health Board Chairman Tartufo noted that their Board doesn't have a_policy on when to go to the Conservation Commission. He noted that he feels each Board should take care of their own commitments, but he felt there are things the Board of Health could do to make it easier for the Conservation Commission. Mr. Boyden felt that a member of the Board of Health, Planning Board and Conservation Commission could all review the plan at one time and let the developer know what his problems were. Selectman Mahana asked the Board of Health if they were working on setting guidelines on what could be done to firm up Board of Health regulations. Health Board Chairman Tartufo stated that his Board is working on it. He stated that they have guidelines, but their problem is when to send a plan to the Conservation Commission. Selectman Caponigro noted that since the new charter has gone into effect, the average person buying a lot is well protected. Selectman Chairman Avery stated that he feels there is still coordination to be done, but he would hope that the Boards would continue to cooperate among themselves. Selectman Caponigro stated he felt it would be a good thing if the Chairman of all three Boards came to the Selectmens' Bi -monthly meeting at the same time to give their reports. Town Counsel Charles D. Mulcahy noted that the Planning Board works under specific rules and time specifications and the Conservation Commission is the same. He noted that Board of Health rules and regulations are more flexible. He stated he felt that all three Boards should work independ- ently and not get involved in the other Boards responsibilities. Chairman Avery thanked everyone for attending the joint meeting and noted that he had learned from it. Minutes January 9, 1980 Page 5 11) Planning Director Maurer reminded the Board that there is a meeting on January 14, 1980 with members of Byron Matthews staff concerning the commercial area revitalization plan for Mansfield. 12) The date for the next meeting was set for January 16, 1980 at 7:30 P.M.
