Foxboro may be giving Mansfield a -water problem, not that Foxboro
has 'a water problem. On Page 9 under public discussion, she should
be changed to Mrs. Jellinek. Also it should be added that Planner
Boldrighini's last statement refers to Eastland Estates.

tisement of the public hearing for Cedar Meadows`'

5. Cabot's 'Pond
Chairwoman Genatossio had prepared ;a synopsis of the correspondence
of Cabot's Pond 'since the beginning. She 'presented each board member
with a handout and reviewed it. **During this review, Planner
Boldrighini entered the meeting. Chairwoman Genatossio read the
letter which the board sent to Mr. Willis and Mr. Chavaree requesting
they attend tonight's meeting and present proposals and plans for
completion. Mr. Willis was present; however, Mr. Chavaree was not.
At this point, John Smith appeared before the board. He informed
them that he has been negotiating with Mr.Chavaree on the purchase
of the pond. He bought Riverside Estates from Mr. Chavaree previously,
and he needs the, material left in the pond to finish the subdivision.
He also is interested in the, project as he hopes to build a home for
himself within Riverside Estates. He has been negotiating for the last
two or three days only. He will be ;going to New Hampshire this weekend
to speak with Mr. Chavaree. Mr. Willis was unaware of 'Mr. Smith's
negotiations with Mr. Chavaree until tonight; however, he did feel
they could work together. At this point, Chairwoman Genatossio read
the letter which ,the board received from Mr. Willis, dated Oct. 14th,
regarding Mr. Willis' willingness to complete the pond and stating
his concerns regarding his ability to complete the project. The Cabot
Pond plan was presented. Allen Willis showed the board the ,property
line which,splits his one-third and Mr. Chavaree's two-thirds. Allen
Willis is within the prescribed depth on his end of the pond.,' He
explained that in order to get to the elevation he is at now, he took
approximately 6 feet of ledge out. He informed the board that the
whole bottom is ledge. The bottom of his portion also meets the con-
tours. The bottom elevation of Mr. Willis' portion is approximately
106, and the water level is at 122. The pond is roughly 16 feet deep,
and roughly 20 feet deep at the far end of the pond. He did all the
sloping and shaping he could without ruining the berms.' On the plan,
he showed where the accessroadis. Some information which needs to
be obtained regarding Mr. Chavaree'rs portion is how much has to be
excavated, what type of material will be 'excavated, and some type of
time schedule. Dianne Royle said that the developers' will have to
go back to the Conservation Commission because the order of conditions
has expired. As soon as Mr. Smith has negotiated with Mr. Chavaree,
he will be getting in touch with Mr. Willis. When the pond is pumped
down, the Town Engineer may determine the depths and type of soils.
The money for the pond will be released when the Town Engineer and
the Planning Director have made a satisfactory inspection and an
"as -built" as been submitted. Mr. Willis agreed to this.

**It was the concensus of the board to send a letter to Mr. Chavaree
stating that Mr. Smith appeared, before the board and as soon as their
negotiations are confirmed, the board would .like to know what their
plans are before February 1, 1984.
**It was the concensus of the board to ;send a letter to Mr. Willis
thanking him for appearing before the board and for his good
efforts.

7. The public hearing for Cedar Meadows began at 9:30 A.M. A copy-
of the transcript is available at the Planning Department.
8. Around the 'Table
Planner Doucette informed the board that he and Planner Bachman attended
the site walk of downtown last Saturday. He found this very informational
and is in favor of; what is happening downtown. Ralph Seifert conducted
the site walk. Planner Doucette also 'informed the board that he went to
the Planning Department last Friday to review plans to make site walk
inspections of subdivisions. He appreciated it when the Planning
Director took time out of his 'daily schedule and put on his coat to
accompany him. Together they made inspections of isubdivisions, and
Joseph Mannarino was very explicit as to informing; him of what was going
on in each one. These inspections took approximately two hours. He
informed the board that they were a very informative two hours, and he
recommended that if any board members have some time, to do the same.
He also feels Joseph Mannarino puts clot of time and effort into his
job, which was very impressive to him. It was pointed out that the
Planning Director's six-month performance review is on February 1, 1984;
and the board should send an evaluation/recommendation to the Town
Manager.
Planner Bachman informed the board that the site walk opened his eyes.
He said there are`alot of problems with abutters on Court/Park 'Streets,
people abutting the Old 'Colony Way, i.e., extending the parking lot.
There was also controversy on the proposed walkway. He feels this will
be turned over to the Planning Board.
9. Public Discussion
Margot Jellinek requested to be placed on the board's agenda ,for
the next meeting. She will be talking about the Zoning By-law and
part of the letter regarding the gravel removal behind the DPW
garage.
10. Date of, next meeting is Wednesday, December 14, 1983, at 7:30 P.M.

Norman Landry, an abutter to the pond, stated that he had a problem
with people driving in and out the access road all hours of the night.
This problem occurred during the summer months. The police were
notified, and they did ;patrol this. If it becomes a problem again
this coming summer, Mr. Willis will 'block off the access road.'
The developers will need the dead of the summer to complete the
project. At this point, the Board thanked Mr. Willis and Mr. Smith
for their attendance and cooperation.
Cabot Pond Discussion - Board Members Only
Chairwoman Genatossio stated that the board's two alternatives are:
(1) Do we still want to consider pulling the bond and have
the town complete the pond?
(2) Do we want to wait to see what happens with Mr. Smith
negotiating with Mr. Chavaree; and wait to see if '
Mr. Willis and Mr. Smith can work together towards
completion?
Motion: To send a letter to Mr. Chavaree and Mr. Willis informing
them that the board voted to extend the ;special permit for
Cabot Pond until February 1, 1984, and they hope that all
problems are resolved by then.
(Doucette - Boldrighini) VOTED
Opposed Bachman
Planner Boldrighini said the board needs to determine the acceptable
bottom elevation and also try to resolve if the board is going to insist
of ledge 'being removed. For example, the water 'level is at 122 feet,
and Mr. Willis is at 106 feet on his end. On Mr. Chavaree's side, we
don't know what the bottom is. If we said.106 feet as well for
Mr. Chavaree for his bottom elevation, what happens if ledge is hit`
at 110 feet or 112 feet. The Planning Director referenced a letter
dated September 15, 1983, which he sent to Mr. Chavaree and Mr. Willis.
This proposed that the .'depth of the pond would follow the ledge as
determined by the Town Engineer, and the contours would be followed as
closely as possible. The board still feels this is a very reasonable
proposal.
The board needs to send letters to the applicants to insure that they
will renew their securities: cc.to the banks.
Motion: To have Joseph Mannarino write letters to both applicants
requesting that they extend their,' securities.A copy of
the letters will be sent to the 'banks.'
(Doucette - Flynn, all in ;favor) VOTED
Planner Fiore said that when the project starts moving, there should
be a statement of work ,program. Chairwoman Genatossio suggested
writing to Mr. Chavaree stating that the board is aware he is
negotiating with Mr. Smith, and they would appreciate being 'informed
as to what has been accomplished. A certain deadline date should be
set. Planner Boldrighini suggested sending a letter stating at a
certain date, we would like to have an answer as to when the work will
be started/completed. Planner Fiore said he doesn't feel there is a
need to send any letters at this point, but rather have the Planning
Director watch to progress closely.
