Also on Page 7 regarding the vote for the work session meetings, Fiore and Bachman were opposed. 5. Ralph Maloon - Compo Chemical - Site Plan Ralph Maloon appeared before the board and explained that Compo's offices are presently located in the Ispo building; however, they have sold the Ispo building. They are planning to convert an existing Planning Board's minutes Page 3 November 9, 1983 r building into their offices. They are proposing to construct a 12,000 ' square foot building to be the finished goods warehouse. There will be a fence erected between Ispo and Compo once the transaction has occurred. The trailors belong to Ispo and should be out by May of 1984 Compo has also cleaned up the site considerably. Planner Brugliera said that the access road off of Branch Street should be widened for the trailers coming in and out. This plan has been to the Conservation Commission and received approval. They had an on-site meeting today, and the road is going to be narrowed based on the latest wetland laws. The road will be 12 ft. at one point to meet the 5,000 sq. ft. limit for filling. One of Joseph Zeneski's comments was that if the drainage pipe is covered with material, this will eliminate more wetlands. Planner Boldrighini said that the catch basin on the road coming in off Branch Street, should be moved to the side of the warehouse, due to the elevations. There is an existing hydrant on the site. The Electric Light Director requests the estimate of the addition load, and he anticipates no problems. Joseph Zeneski would also like to meet with Ralph Maloon to review the calculations for the 10 year and 100 year storm drainage. Motion: To send a favorable recommendation to the Building Inspector recommending support of the following five items: 1. Truck radious be changed 2. Identify on the plan the clean outs 3. Additional catch basin in the roadway 4. Estimates on the additional load be given to the light department. 5. Ralph meets with the DPW Director to discuss the calculations. (Brugliera - Doucette, all in favor) VOTED Motion: To send a memorandum to the Conservation Commission pointing out the DPW Director's comment on the construction of the drainage pipe, and that it will disturb more wetlands if it is covered. Also inform them that the Town Engineer questions the 100 year storm calculations. (Flynn - Doucette, all in favor) VOTED 6. Ralph Maloon - Site Plan - Dance Studio - East Street Ralph Maloon, representing Cynthia Nolan, appeared before the board to explain the proposed site plan. He informed the board that there is an existing house and garage, and Cynthia Nolan would like to extend this to be use as a dance studio. They are providing 10 parking spaces. She has about 40 students per day at different times. There will also be two additional parking spaces to be used for the dwelling. There is an existing two-way road in and out. This is directly in front of Franklin Street and the set of lights. The DPW Director suggest a one-way traffic pattern, possibly out through DeGirolamo's driveway. Motion: To table until next week and request that Jesse Earls and Thomas Leonard submit their comments regarding the one-way traffic system vs. the two-way traffic system. (Flynn - Doucette) WITHDRAWN At this point, Ralph Maloon requested an extension of the site plan until next week or November 16, 1983., It was also suggested to add site plan review to the work list: 14 days vs. 21 days. Planning Board's minutes Page 4 November 9, 1983 Motion: To accept the request for an extension on the site plan. (Flynn - Doucette, all in favor) VOTED Motion: To withdraw the original motion (Flynn - Doucette, all in favor) VOTED 7. Margot Jellinek - Maple Park - Earth Removal Margot Jellinek appeared before the board to discuss the gravel removal from Maple Park. She.presented the board with a map which showed two town wells, and she pointed out where the gravel is being removed. In order to remove the gravel, the trucks have to go over the shell line. The slopes are up to 18 ft. Margot read a letter to the Board which she received from Chadwick Maurer in 1981. In this letter it states that no excavation will be permitted within six feet of the seasonal high water. Margot pointed out that at a previous town meeting, it was voted that no excavation will be permitted with ten feet within a recharge area. Also in 1953, Article 29 of the Town Report, there was a proposal for money to be transferred to the highway garage account. In the 1957 Town Report, it states that the new highway garage was constructed due to money the voters saved. Margot said that if this was a gravel pit, the voters would not have to save money. At this point, Margot Jellinek requested that the board write to Chadwick Maurer requesting an engineering plan for the removal of gravel, and test holes so the board can find out how the pit has been extended and were the water table is. The board should also request a restoration plan. Chairwoman Genatossio pointed out that the board sent a letter previously regarding this removal of gravel. Motion: To send a letter to the Selectmen indicating that Margot Jellinek has appeared before the board for the second time regarding the gravel removal from the highway garage. This letter should address the items in Mr. Maurer's letter of 1981. The board would like to know if these items are being adhered to, and if not, why? (Flynn - Doucette, all in favor) VOTED 8. Cedar Meadows Subdivision Many residents of the Cedar Meadow subdivision attended•!this meeting. Mr. Frazier, representative, appeared before the board and presented them with a petition from the residents for the completion of Cedar Meadow - Squire Avenue. The time table for completion is as follows: 1. All curbing for Squire Ave. completed by 12-9-83. 2. Completion of bituminous sidewalks by 1-1-84 3. The residents withdrew item No. 3 which was to barricade at the junction of Squire and Ephriam. 4. Denial of further permits for Ephriam Drive until Squire Avenue is completed. 5. Removal of safety hazards from the development 6. Removal of construction equipment stored on Squire Ave. 7. Restoration of grade on Lot No. 4 8. In closing the petition requests that the bond be called if the above conditions are not met by 1-1-84, and subsequently contract- ing out for completion by June 1, 1984. Planning Board's minutes Page 5 November 9, 1983 The residents informed the board that the developer has come down to the development at 10:30 to 11:00 at night and starts running his equipment. There are several complaint calls on record with the Police Department. Mr. McLaughlin said that Mr. Cannata installed the wrong curbing, and the new curbing was dropped off in the street which takes up about 8 to 9 feet. He indicated that he almost hit it coming home late one night as there are no lights. Mr. McLaughlin informed the board that Mr. Cannata has installed some storm drainage and one manhole. This is approximately 1" above the grade. He is concerned about the plowing. Joseph Mannarino said that Mr. Cannata has appeared before the Board of Health for perk tests for the back lots; however, he can not build on the lots until he has come before the Planning Board. The Planning Board would have to bond the roadway before he can get releases of the lots. It was also pointed out that there is dumping of trash in back of the Shaw's property. It was again pointed out that the hot top plants close around December lst depending on the whether. Planner Flynn suggested advertising for a hearing to consider rescinding the subdivision approval. Motion: To advertise for a public hearing on the consideration of rescinding the subdivision approval for Cedar Meadows. This hearing will be held on December 7, 1983. (Flynn - Doucette) In Favor - Bachman, Boldrighini Abstained - Brugliera The board received a memorandum from Joseph Mannarino regarding the updating of Cedar Meadows - Squire Avenue bond using the 1983 Means Cost Data. The total for all the improvements is $66,838.35. 10 per- cent is $6,783.84. The update for 1983 is $26,613.77 + $6,683.84 which equals $33,452.12 Motion: To update the performance bond to $33,452.12 (Doucette - Boldrighini, all in favor) VOTED Abstained - Brugliera 9. Variance - Karl Clemmey Karl Clemmey appeared before the board and explained his variance request to erect four additional signs for his business located at 390 West Street. Three of the signs to be located on Route 140, and one sign on Norfolk Street. All signs would be 45 square feet and double faced. Under the present zoning, he is permitted to erect a large sign on the building, but he would prefer not to do this. Chairwoman Genatossio asked if he could put everything on one sign. He informed her that if he did, the sign would be very big. Motion: To send a favorable recommendation to the Zoning Board of Appeals indicating the Planning Board would like to see one sign on Route 140 and one sign at Norfolk Street. (Boldrighini - no second Motion: To send a negative recommendation to the Zoning Board of Appeals because it derogates from the intent of the Zoning By-law. West Elm Estates Drainage Easement The original plan was presented to the board. The original drainage plan will be attached to the approved revised plan. Motion: The board accept the original drainage plan on West Elm Estates. (Doucette - Boldrighini, all in favor) VOTED F. 12. West Elm Estates Bond Estimate x The Planning Director calculated the bond estimate using 1983 Means Cost Data. The total is $33,628.46 and the 10 percent contingency is $3,362.84; therefore, the total is $36,991.30. This amount was amended because two fire alarm boxes were calculated into the total, and there is only going to be one fire alarm box. The cost of a fire alarm box is $1,300. Therefore, the amended total for the material is $32,328.46, and the 10 percent contingency is $3,232.85. The total bond estimate for West Elm Estates is $35,561.31 Motion: To accept the bond estimate of $35,561.31 for West Elm Estates. Public Discussion Margot Jellinek asked if the board ever received a reply to the letter that was sent to Mr. Covich. The board has not. In reference to Cabot Pond, she said that the Planning Board can't alter the plan, as it is under the Conservation Commission and the State's order of conditions. 19.
