Minutes of September 28, 1983 Motion: To approve (Brugliera - Fiore, all in favor) VOTED 4. Ronald Bonvie - Fairfield Park Chairman Genatossio informed Mr. Bonvie that the board walked Fairfield the other day, and they discovered that there is a problem with the grade levels. Fairfield is higher than the Housing Authority. Mr. Bonvie said he is 1" higher than the plan approved by the special permit. He can get certifiecation from the engineer confirming this. He feels the Housing Authority is 7" low. He is at 152.6, and according to the plan dated January, 1982, which the special permit was approved on, he should be at 152.5. Mr. Bonvie pointed out that if he has to lower the grade, he will have to redesign the parking lot grades; and there may not be enough cover over the pipes. He said he did get together with the Housing Authority and agreed on some grades. He is 4" over what he agreed on. The reasons for this is that if he lowers it any more, he will have a drainage problem. At this point, Joanne Colella, Housing Authority Director, read a letter she prepared explaining her views on this situation. References were also enclosed with the letter. Please find a copy of this attached at the end of the minutes. Planning Board's minutes Page °3 October 5, 1983 Mr. Bonvie said that he feels one reason there is a problem is - because the plans were approved for a total brick courtyard; however, due to the state funding, the Housing Authority couldn't put brick on their portion of the courtyard, although there is brick on the Fairfield side. He again pointed out that he can't lower the grades because he will have a drainage problem. He would have to lower the grates 8". He pointed out on the plan what would happen if it were lowered. The Housing Authority also presented a plan; and according to their plan, they said they are correct in their calculations. The Planning Board said they did not see this plan; however, Joanne Colella said she submitted a copy to the Planning Department. Ronald Bonvie suggested to raise the floor walkway on the Housing Authority's side by 5". It was pointed out that the State will not provide the funds. Motion: To have the Town Engineer check the topo of both plans and make sure the elevations are correct as per both plans. (Brugliera - Fiore, all in favor) VOTED The Planning Director will go out with the Town Engineer on a field. inspection. Mr. Bonvie showed on the plan where the walkway will be going. He informed the board that they will be putting in PVC for better drainage. He will present the board with the as -built plan which locates the buildings exactly. He has a construction schedule to fix the bricks. There was discussion regarding why the transformers are not shown on the plan although they are located on the site. Mr. Bonvie explained that James Hall, the Light Director at the tiem, located all the transformers. The old Electrical Inspector did not require a fence around the transformers; but the new Electrical Inspector has mentioned it. A 4' vinyle fence will be installed. A final fencing plan has to be submitted. The plan dated January, 1983 of the elevations of the apartments should have been presented to the board. It was pointed out that the doorways and -.windows are different. The windows are square, not round as shown on the plan. Mr. Bonvie explained that the doors are on the side instead of in the front becuase there is 3 feet from the jog to the sidewalks. Therefore, the doors would have opened to the edge of the town's property. Also you can't have the doors opening inward due to fire codes. Planner Flynn said that she does not feel that ordinarilly, the changes would be a big deal; but because of the location, she feels it is. Mr. Bonvie informed the board that he is looking into putting brick on the town sidewalk into the courtyard. There would also be plantings. In reference to the downstream drainage, Mr. Bonvie informed the board that it was done once and inspected by George Wey and Paul Folkman, and it was signed off. Since that time, it has deteriorated, and he will probably have to go in and do it over, i.e., loam and seeding and some rip rap. He feels that the maintenance of this is important. Planner Brugliera suggested running a pipe with perforate on the bottom, similar to the french drain type. Motion: To table the special permit renewal until the board receives the required information (Flynn - Fiore, all in favor) VOTED Planning Board's minutes Page 4, October 5, 1983 5. Margot Jellinek - Cannon Forge Development Margot appeared before the board to discuss a proposal for 1,045 condominiums to be located on the Foxboro/Sharon town line. She present the board with copies of newspaper articles dated May 19 and September 22, 1983, regarding this proposal to be called Cannon Forge. There would be 780 condominiums built in Foxboro; and 265 in Sharon. She pointed out that the effluent will flow to the Rumford River. She said she does not think the board received a copy of the legal notice for the September 22, 1983 hearing. She suggested writing to the Foxboro Planning Board informing them that the board is most interested in this project and requesting that they send a copy of the legal notice and any other material regarding this prior to the next hearing. Motion: To send a letter to Foxboro requesting the above. (Brugliera - Fiore, all in favor) VOTED 6. Datel - Site Plan Mr. Dom Giampietro of Beta Construction appeared the board to explain the site plan. They would like to construct a 59,000 sq. ft. addi- tion to be used for the same purpose as the existing building. He informed the board that everything will be according to the Zoning By-law and the State Building Code. The have also created new parking spaces. The addition would consist of a cleaning room and a research and development center. It would be the same facade and roof type. This addition will not create any added output into the chemical trap in the existing building. The landscaping will be con- structed to what there is now. He informed the board that the company has been bought by General Electric. They purchased the building approximately six to eight months ago. It was pointed out that this site plan was just sent to the department heads for their review; therefore, the board will wait until next week to make a decision. 7. Form A - Carine - Stearns Avenue This Form A consists of Lot A and Lot B located on the northerly side of Stearns Avenue. Both lots have the frontage and area required by zoning. All the items on the checklist were complied with. Motion: To sign (Brugliera - Flynn, all in favor) VOTED 8. Planning Director's FY 84 Work Program The Planning Director gave each member a copy of his proposed work program schedule. The main topics are: Master Plan, Subdivision, Grants, Capital Improvements Program, Zoning, and Other. Under the main topics were several items. The board reviewed the work program. They would like to address the zoning for the next town meeting. There was discussion regarding esthetic zoning regulations. Motion: To approve the work program for FY 84 for the Planning Director as shown in a memorandum dated October 4, 1983. (Brugliera - Fiore, all in favor) VOTED Planning Board's minutes Page 5 October 5, 1983 9. Master Plan The Planning Director prepared a memorandum which consisted of an outline to follow for the master plan. This outline was broken down into elements as follows: Goals and Policies, Public Facilities and Services, Transportation, Housing, Economic Development, Recrea- tion, Land Use, Downtown Plan, and Zoning Amendments. His proposal is to have the board work on this together as a board. The board would take one element, complete it, and then go to the next. He informed the board that he would normally put land use as Element No. 1 or 2; however, because he doesn't know if the board still has the money to do the essential map working, he has put it as No. 7 until it is clarified as to whether the board has the money. The land use consists of surveying each parcel of land from the 52 plat maps, and putting a land use on each parcel. This field survey is usually done by Carr. Planner Flynn pointed out that there isn't a specific section for Conservation Commission. Joe said Conservation would come under various elements. She pointed out that they can't obtain self-helf funds unless there is an updated master plan. She suggested making Conservation an element itself. Joe informed the board that the goals and policies is first as it will provide a summary of each of the elements. Public facilities and services is next. He feels that this is one of the most important elements besides land use, i.e., locating water and sewer lines in town. Transportation, Housing, and Recreation can be switched around. He would like this presented to the Selectmen at their bimonthly meeting. He also pointed out that the master plan should serve as a central document for the entire town to be used as a tool for development. At this point, Joe informed the board of a Special Town Meeting to be held on October 24, 1983. Each department has to cut 2.1 percent from their budget. He can cut this 2.1 percent through salary, as he did not start until August 1, 1983; therefore, there is one month's salary unused. Items to be presented to the Selectmen at the bimonthly meeting are: The Planning Director's work program for FY 84, and the Master Plan. Joseph Mannarino would like to work on the defini- tion section of the by-law, as well as providing regulations for the Agricultural Zone. He would also like to accomplish revising the site plan review process, and work on the downtown zoning. There was discussion regarding regulations for esthetics. It was pointed out that in Plymouth, there is a Downtown Review Board for downtown esthetics. There was discussion about holding joint meetings between the Planning Board, Conservation Commission and the Board of Health to review major site plans and subdivision proposals. Joseph Mannarino pointed out that he acts as a liason to communicate between boards. Also it would be difficult to coordinate all the boards together as they are part-time. At this point, there was discussion regarding the variance request of the Brodericks, which appeared before the board last meeting. Joe informed the board that the variance has been approved. Planning Board's minutes Page ,.6 October 6, 1983 He informed the board that the lot does not exist. What does exist is one large parcel of land, and they are proposing to subdivide it. The Zoning Board of Appeals gave a variance to anon existing lot. This lot has never been recorded. A Form A would not conform to zoning as it would not have the required frontage; therefore, it would be up to the Planning Board to determine if this should come under subdivision control. It was pointed out that two lots con- stitute a subdivision. Chairman Genatossio informed the board that she spoke to George Wojtkiewicz, Chairman of the Zoning Board of Appeals. He feels that a variance is separate from a Form A, and he doesn't feel there is a problem. He said he would bring this up before the board at their next meeting if the Planning Board would write a letter stating their concern. Joseph Mannarino will draft this letter. The Planning Director again questioned how they can give a variance on a non -existing lot. Motion: To send a letter to the Zoning Board of Appeals regarding the above. cc: Bertram Cook (Flynn - Boldrighini, all in favor) VOTED *Planner Brugliera abstained. *Planner Flynn left the meeting at this point. 10. DAC Discussion Chairman Genatossio gave a summary to new Planner Boldrighini on what was discussed last week. She said that in the 1977 Town Report, the town voted to accept the report of the Downtown Development Committee. In 1978, there was a complete rezoning plan for the downtown area. Therefore, the Planning Board appointed the Downtown Advisory Committee to work on this. This committee consists of 11 members. Chairman Genatossio researched the minutes and found that the DAC reported to the Planning Board. Since then, they have broken loose. She pointed out that maybe they feel that the Planning Board's representative to the DAC was enough to keep the board informed. Planner Boldrighini questioned whether the Planning Board should get involved with what the DAC is doing. He stated he feels the board should know what they are doing, but should not get involved, as they have alot of work themselves. At this point, there was discussion regarding the DAC requesting the Planning Director to do work for them. This creates more work for him, and he, therefore, does not have as much time for the Planning Board. The DAC is very much on their way, and the board does not feel that it is necessary for Joseph Mannarino to attend their meetings. Joseph Zeneski is administering the downtown grant. It was the concensus of the board that if the DAC needs the Planning Director's assistance, they should send a letter to the Planning Board request- ing his time. It was pointed out that the DAC is the lead agency for the grant. Motion: To send a letter to the DAC informing them that if they would like the Planning Director's assistance, they shall send a letter to the board requesting his 'i time. Also the Planning Board would like to schedule sometime to have the DAC come to the Planning Board to meet and discuss what they are going to be doing in the next six months. (Fiore - Brugliera, all in favor) VOTED Planning Board's minutes Page -7 ' October 6, 1983 11. Around the Table Some one questioned the status of the light pole within Granada Park. It was pointed out that the board is waiting for a letter from John Larch stating that the specs which were used are adequate. Also Allen Willis has installed the light within Strawberry Meadows, and it is ready for inspection. There was discussion regarding Cabot's Pond. They have until the 15th of October to return their agreement. This is also when the extension expires. Joseph Mannarino said that he was informed that Robert Chavaree hit clay, not ledge. Joseph Mannarino informed the board that Norton had a problem with Section V, of the Zoning Act, which concerns amendments to the Zoning By-laws. This states that you have to advertise 14 days prior to holding a public hearing on a zoning change. Norton advertised less than this requirement, and the Attorney General disapproved all their zoning amendments. He received this information from George Carr, a Norton Planning Board member. He will be sending Mr. Carr a thank you letter. Joseph Mannarino also informed the board of Highway Planning Assistance which is being offered through SRPEDD. This begins May, 1984. If the board has any projects, he can prepare a proposal. They are currently doing a traffic study for Mansfield and N. Attleboro. 12. Date of Next Meeting is October 12, 1983, at 7:30 P.M. 13. Public Discussion Margot Jellinek requested a copy of the letter which was sent to Sidney Covich regarding Circle C and a copy of a legal notice from Foxboro. 14.
