Minutes of September 21, 1983 Motion: To approve as amended (Flynn — Bachman, all in favor) VOTED In discussion around the table, Sheba's Den should be changed to Dr. Massand's site plan. Also it should be noted that Planner Flynn left the meeting. 5. Granada Park The Board received a memorandum from the Planning Director regarding the estimate of curb work at Granada Park. This estimate was pre- pared using the 1983 Means Catalogue. The estimate for the work that has to be repaired is $1,985, rounded off to $2,000. The money being held for the top coat is $7,470. Joseph Mannarino's recom- mendation was to release $5,470, leaving the $2,000 for the repairs. He informed the board that this has been reviewed by Joseph Zeneski, and it is alright with him. Aldo Paglia has indicated to Joseph Mannarino that he would like to do the patching and resetting of the curbing early in October. In reference to the lighting, Aldo Paglia will have to follow the regulations of the Light Department, and they will send the Board a letter on this. Joseph Mannarino would like to see him complete as much as possible this fall. He is satisfied with the finish coat on the road. Acting Clerk Brugliera said he is concerned with how it will look after the road has been patched. Motion: To release $5,470 from Account No. 118-24617 for the top coat installation. (Bachman - Brugliera, all in favor) VOTED The residents of Granada Park had concerns as to when the lights will be turned on. Chairman Genatossio informed them that the Board has to make sure that they were installed properly before they are turned on, and they have not received a letter from John Larch Planning Board's minutes. Page 3 September 28, 1983 confirming this yet. The Planning Director said that the sono tubes may need to be filled and compacted near the base. He also spoke to John Larch regarding the standards that Aldo Paglia used during installation, and John feels that they are satisfactory. It was the concensus of the board to have the Planning Director send a letter to John Larch on his inspection of the light equipment. This letter should address the instability of the poles. There was also discus- sion regarding the developer's impression that he did not have to lite the lights. In was pointed out that within Beachwood Estates, the developers paid for a light for one year until the street was accepted by the town. Motion: To send a letter to Aldo Paglia informing him of his responsibility to lite the lights. It is his obliga- tion until the town accepts the street at Town Meeting. Copies of the letters from the Fire and Police Depart- ments should be attached. cc: John Larch (Brugliera - Flynn, all in favor) VOTED At this point, the neighbors thanked the Board for taking an interest in this. 6. Variance - Natalie and Edward Broderick - Darby Drive Natalie Broderick appeared before the Board. Her variance request is to construct a single family dwelling on a 10 acre parcel of land. The required frontage is 120 feet, and they would only have 48 ft. The dwelling would be 70 X 32. She explained that Jess Realty Trust has been unsuccessful in marketing the land as a sub- division. She presented maps showing the swamp area, the land, and where the proposed house would sit on the site. Due to the proposed locatation of the dwelling, there would be alot of back land. Joseph Mannarino pointed out that there is no assurance that years from now, this 10 acres is not going to be subdivided. There was also a letter from RIM confirming that the best use of this land is a single family dwelling. Motion: To send a negative recommendation to the Zoning Board of Appeals referencing the concern of future subdivision and development. (Flynn - Genatossio, all in favor) VOTED Brugliera - Abstained *During this vote, the Chairman passed the gavel 7. Variance - Robert W. Vokey - Lakeview Avenue Robert Vokey appeared before the board. His variance request is to enclose a carport which is 6 feet from the sideyard and has been there for 26 years. He would also like to put a slanted roof on it rather than a flat roof to let the water drain off. He is not going to expand the existing carport. Motion: To send a favorable recommendation to the Zoning Board of Appeals. (Brugliera - Flynn, all in favor) VOTED Planning Board's minutes Page 4 September 28, 1983 8. Form A - Poni Corp - Elm Street The board signed this Form A, which is located on Elm Street, last week. Two changes were made on the plan. Poni Corporation was changed to Poni Corp, and Lot No. 7 was changed to Lot No. 4. 9. Circle C Estates - Margot Jellinek Margot Jellinek appeared before the Board, and she suggested that the Planning Board send a certified letter to Mr. Covich, with a carbon copy to Brookline Trust, requesting Mr. Covich to extend the Letters of Credit Nos. 108-3 and 106-9 until June 30, 1984, as requested by the Planning Board in a letter dated February 14, 1983, and signed by the Former Chairman, Mitchel Seifert, for work not completed within Circle C. A copy of the February letter should be attached. She informed the board that this was strongly suggested to her legally. There was discussion as to whether this letter should request the letters or credit be extended or the work be completed. Joseph Mannarino informed that board that he went out to the subdivision right after a rain storm. There is some puddling on Pinto Way in front of House No. 26. There is also a slight obstruction in a catchbasin which may be fixed by cutting a little around the edge of the granite curb. The cracks can be sized and sealed. Margot Jellinek pointed out that the home owners brought Sidney Covich to court and won, but they have not received the money yet. Acting Clerk Brugliera feels that the letter should be sent but not with an either or situation. Motion: To send a letter to Mr. Sidney Covich, cc to Brookline Trust, requesting that they extend the letters of credit, as per a letter sent by the board dated February 14, 1983. (Brugliera - Flynn, all in favor) VOTED Bachman - Abstained It was pointed out that Mr. Covich used to pay for a light within Circle C, but it was shut of due to lack of payment. 10. Ray Goddard - Division of Land In reference to the plan that Raymond Goddard presented previously, the Planning Director informed the board that the current regulations do not meet the needs of this proposal. Under the current regulations, he can't see the board waiving any subdivision regulations until a preliminary or definitive subdivision plan has been submitted to the board. He pointed out that this private way would be contrary to State Regulations since each lot would have to have the:required frontage on an accepted road. He recommended that the board send Mr. Goddard his plan back and ask him to submit a preliminary sub- division plan if he feels strongly about this proposal. At that time, the board may research waiving requirements. Acting Clerk Brugliera said that he feels three lots constitute a subdivision. Richard Mandell informed the board that he owns the parcel next to the private way. He asked the board if this private way were to be used at frontage for Mr. Godda_d's three lots, could he also subdivision his lot. .Planning Board's minutes Page 5 September 28, 1983 Motion: To send the plan back to Raymond Goddard with a letter noting the Planning Director's recommenda- tions. (Brugliera - Flynn, all in favor) VOTED 11. Form A - Essex Street - George Ward This Form A appeared before the board last week, and it was returned so that the remaining frontage could be shown. The remaining frontage was shown on the plan, and all the items on the checklist were complied with. Motion: To sign (Flynn - Bachman, all in favor) VOTED 12. Form A - Wood and Kane - Wilson Place This Form A also appeared before the board last week. It consists of two lots: Lot No. lA and Lot No. 2A. A portion of both of these lots is being combined to create one new lot. Wilson Place is a private way, and it was pointed out that there is adequate access to the parcel. There is also a multi -family dwelling across the street. Motion: To sign (Brugliera - Flynn, all in favor) VOTED 13. Form A - Russell - Oakland Street This Form A consists of Lot No. 61 which consists of 2.160 acres and Lot No. 62 which consists of 3.075 acres. This is located in the industrial zone. All the items on the checklist were complied with. Motion: To sign (Bachman - Flynn, all in favor) VOTED 14. Dr. Massand's Site Plan - Wood Avenue The board reviewed the site plan for the addition to Dr. Massand's building. On this site plan, it shows the two buildings being attached. These buildings are not attached yet. It was pointed out that they are not completed yet. Motion: To bring this to Bertram Cook's attention so he may remind the developers that these buildings are to be attached. (Brugliera - Flynn, all in favor) VOTED 15. East Street Apartment - Ronald Bonvie The board would like this site plan for the next meeting. Planner Flynn said she remembers that the site plan called for a fence and a 5 foot grass strip. These items have not been complied with yet. Planning Board's minutes Page 6 September 28, 1983 16. Fairfield Park - Site Plan The board reviewed the site plan for Fairfield Park. It was pointed out that there is suppose to be 20 feet between the apartments on East Street, although it doesn't look like there is. Also the plans do not exactly resemble what has been constructed. The one-year special permit which was issued for Fairfield Park is in need of an extension. After discussion, it was the concensus of the board to make a site walk of Fairfield. This will take place on Monday, October 3, 1983, at 4 P.M. Motion: To send a letter to the Bonwood Corp. requesting that they attend the Planning Board's next meeting to be held on October 5, 1983, to review the special permit and discuss any inconsistancies. (Flynn - Brugliera, all in favor) VOTED 17. Around the Table Planner Bachman questioned the relation the DAC has with the Planning Board. There was discussion regarding how the DAC was developed. It was pointed out that in 1978, the Planning Board gave the DAC a directive as to what they wanted them to do in the downtown area. Chairman Genatossio feels that the DAC should attend a meeting to discuss what has been done and what the needs are for things to be accomplished in the future. She also informed the board that she attended the DAC's Monday night meeting, and she still questions how they get the authority to hold a public hearing. This public hearing was to discuss the grant and how the various money will be spent to improve the downtown. She was upset by directives that were given to the Planning Director by the DAC. She pointed out that directives were also given to the Town Engineer. It was the concensus of the board that it is up to them to clarify the DAC's responsibilities. Previously, the Planning Board requested that the DAC attend one of their meetings. However, they did not want to, at that time, due to the lack of a Planning Director. The Planning Director informed the board that since the DAC is making requests of him, the work program, which he set up, will not go as quickly as proposed. There was discussion regarding sending a let- ter to the DAC requesting that they attend a Planning Board meeting. The board requested copies of the DAC's minutes from the last two meetings. *Concensus: To put on the agenda for next week. There was discussion regarding the curbing within Cedar Meadows as to whether the board should take it up in a few weeks. It was pointed out that Mr. Cannata was informed of what he has to do by certified letter. Joseph Mannarino informed the board that he and Joseph Zeneski went out to West Elm Estates to check on the excess loam removal. He said they are stockpiling the loam from the roadway, and there is amply material out there. Planning Board's minutes Page 7 September 28, 1983 He also informed the board of a meeting that took place this morning with Chadwick Maurer and many department heads. This meeting was with a developer who is interested in developing an entertainment place on the Cray property. The developers will be presenting their proposal to either the Planning Board or the Selectmen within the next couple of weeks. 18. Public Discussion Margot Jellinek informed the board that on October 3, 1983, there will be a wetlands hearing on Compo. The building is located in two zones, and they want to do alot of filling. She requested that a representative of the Planning Board attend. She pointed out that the plan showing the wetlands looks like the same plan the board has seen. 19.
