West Elm Estates Joseph Mannarino informed the board that the town wanted a 30 ft. easement instead of the 20 ft. easement shown on the Ash property; therefore, the plan was changed. 6. Bay Brook Campground Proposal All of the letters received from various department heads were read. These are as follows: Letter from Jesse Earls, Police Chief, stating he is totally opposed to this and listing his concerns: 300 additional vehicles with trailers traveling on Branch Street and additional children gravitating towards South Common; letter from Conrad Lajoie, Plumbing & Gas Inspector, stating his concerns related to water and sewer; and in summary, stating that the plans are not professionally drawn; letter from Diane Royle, Conservation Commission, stating that the applicant would have to submit a request for a determination of applica- bility under the wetlands protection act. Joseph Zeneski, DPW Director, listed his comments on the site plan. (Please refer to such.) As an outcome of the last discussion of Bay Brook Campground, a letter was sent to Ronald Bonvie stating that the plan was lacking in many essential areas. This letter requested additional information, which was listed in a memorandum dated September 7, 1983. No additional information was forwarded. Joseph Mannarino reviewed all comments from various departments, and he found the concensus to be that the plan is seriously deficient in many categories, i.e., management plan, drainage calculations, sewer and water line plans, traffic information, population density projections, sanitary facilities, landscape plan, parking and paving plan, recreation plan, and existing and proposed contours. It was pointed out that all the town department heads spent alot of time and energy reviewing this plan. Motion: To recommend against the Bay Brook Park proposal without prejudice, and to turn it down due to lack of information. (Flynn - Brugliera, all in favor) VOTED Copies of all the letters received from various department heads should be forwarded with the recommendation to the Inspector of Buildings. *Add to work list: There was discussion regarding raising the fee for site plan submittal and revising the site plan process so that an applicant must meet certain criteria before it is submitted to the board. Planning Board's minutes Page 4 September 14, 1983 7. Paula Lane Inspection`" The town is presently holding $2,500 for Paula Lane. Frank Allen requested that this money be released. Joseph Mannarino and Joseph Zeneski inspected Paula Lane and found two minor problems: All cracks should be sealed, and the water gate in the rear of the cul-de-sac should be lifted and patched. Frank Allen said he would take care of them this week. It was pointed out that the top coat has been down for two years. Mr. Allen also informed the board that he did not want the cable company going in and tearing up the street, as he still is responsible for it. There was discussion regarding plowing. Motion: To send a letter to the DPW Director requesting the policy on plowing withing an accepted sub- division, but not accepted streets. (Doucette - Fiore, all in favor) VOTED S. Strawberry Meadows Subdivision The board received a letter from Allen Willis, via registered mail, requesting the release of $21,000 being held by the town in Account No. 0100508555 with the Mansfield Co -Operative Bank. In this letter it states that the construction and installation, in connection with such security, has been completed. He again referenced the General Laws, Section 81U, Chapter 41, under "completion of ways and services", which states that the board has 45 days to release securities. Joseph Mannarino and Joseph Zeneski inspected Meadow Lane, and they found that two improve- ments need to be completed. These are: The street light needs to be installed, and a portion of the grass plot needs to be excavated, loamed and seeded. The cost of both of these items combined is $1,668, and the contingency is $1,888 for a total of $3,556. Joseph Mannarino recommended that the $3,556 be held, and $17,444 be released. Motion: To release $17,444 of the securities with the remaining $3,556 to be held pending final completion of the work. (Fiore - Doucette) WITHDRAWN Chairman Genatossio pointed out that the board should respond within 45 days. There was discussion regarding whether releasing the funds was responding or not. The outcome of the is that the Planning Director will draw up a letter answering Mr. Willis' letter dated September 8, 1983, concerning the release of funds. 9. Cabot's Pond Joseph Mannarino prepared a proposal for the board and the developers to agree upon. The original plan showed the depth of the pond to be at 100 ft. above sea level. Joseph Mannarino recommended that they go down to the 110 ft. elevation, or to a depth where it is determined by the Town Engineer that ledge has been reached. This would make the pond approximately 12 ft. deep. The USDA recommends'.. that a pond be at least 12 ft. deep to be suitable for fish. Planner Brugliera said he has two problems with Cabot's Pond. Planning Board's minutes Page 5 September 14, 1983 First, the board is not increasing the bond, which they wanted to do two years ago; and second, the board is not getting the loam. There was discussion regarding if the permit is extended and not completed by October, 1984, the bond will definately be pulled. It was pointed out that the board has been trying to negotiate a solution and has had Town Counsel in, so they should follow through, drawing the proposal to be signed by the developers. As per the proposal drawn by the Planning Director, Clerk Fiore suggested that rather than stating they only go to 110 ft'., they comply with the original plan until they hit ledge in a particular area: To keep with the depth require- ment as shown on the plan or until they hit ledge, which is cer- tified by the Town Engineer. It was pointed out that there are two borings shown in Dr. Carr's report. These borings showed refusal at 24 feet. In reference to the developers second request to release the bond upon completion of grading, loaming, and seeding, Joseph Mannarino recommend that the bond only be released after a favorable inspection by the Planning Board's agent and upon receiving the required "as -built" plan. It was the concensus of the board to have Joseph Mannarino draw up the proposal to be signed by both developers, and it will be certified by a notary republic. Motion: To extend the special permit for 30 days, or until October 18, 1983. (Doucette - Flynn, all in favor) VOTED Motion: To have Joseph Mannarino draw up the proposal to be signed by both developers, and it will be certified by a norary republic. This proposal shall be sent out to the developers, and this shall be signed by the developers within 30 days. (Doucette - Flynn, all in favor) VOTED 10. Granada Park Subdivision The board received a letter from Aldo Paglia stating that the fire alarm box has been installed and tested; therefore, he requested that $1,000 be released from the road bond. He also stated, in his letter, that the problems related to the finish coat have been corrected, and he requested that $7,470 be released. Joseph Mannarino said that alot of the problems that were discussed before have not been done. He has not taken off the wooden forms from around the light stanchion. He has reset some of the curbing. Many of the residents of Granada Park were at the meeting. Jay Schmidt was their spokesman. Some of his questions were: Is the street going to be accepted? I£ so, when? When will the street lights be on? If they will have cable? Another inspection has not been made on Granada Park as the residents' concerns wanted to be heard first. It was pointed out that the people who put in the radious markers, broke the curb. The residents showed on the plan where the curb was broken. It was also pointed out that there was a large depres- sion in the road which was filled. However, it was pointed out that the plow will catch the edges of it. The residents also Pla[ining Board's minutes Page 6 September 14, 1983 said that there is a problem with the grading. The Planning Board members will make a field inspection at 4 P.M. on Thursday, September 15, 1983. The board has not yet received a letter from John Larch, Light Department Director, regarding his inspection of the street light equipment and the transformer. After the field inspection has been made, and the problems have been discussed with the developer, Jay Schmidt will receive a letter. 11. Form A - Baker - Franklin Street This Form A was submitted last week and sent back due to lack of information. The rear measurements were added to the plan, and dotted lines, instead of solid, were used for clarification. This consists of Lots Nos. 3A, 3B, and 2. Motion: To sign (Brugliera - Doucette, all in favor) VOTED 12. Variance - Matthews and Friese — Williams Street This variance request is to construct a single family dwelling at 526 Williams Street. They would have 112 feet frontage, and the frontage requirement in the agricultural zone is 120 feet. Motion: To send a favorable recommendation to the Zoning Board of Appeals. (Fiore - Doucette, all in favor) VOTED 13. Planning Director's FY 1984 Work Program The Planning Director prepared a memorandum which listed activities he will be undertaken during the fiscal year. He said that instead of going through the Town Manager first, he has decided to go to the Planning Board. The board can discuss and amend it, and then it will go to the Town Manager. He may also amend it. If so, it will come back to the board for their review. The first item on the list was the Master Plan. This had 7 sections under it. Chairman Genatossio asked about using the money appropriated by town meeting to start the map work. Joseph Mannarino informed the board that there is a question with the money. There seems to be a budget deficiency of $480,000; and he has been requested not to spend money until they have determined where the money will be coming from. He said that all departments are also watching budget spending. The next item on the list was subdivisions. Some of the ongoing subdivision which were added to the list were: Circle C and Elmwood Park (Bristol Arms). The Planning Director will be going through the files to compose a list of all the ongoing subdivisions. The next item discussed was zoning. One section that needs amending is agricultural. The board also added to the work program, to work on the definition section. Other concerns regarding zoning that should be studied, but not this year are: gravel removal, aquifer zoning, cluster and compound developments, and multi -family development. Some of the members felt that cluster development should be addressed this year, as the board has no requlations. Revising the downtown zoning should also be added to the list. planning Board's minutes Page 7 September 14, 1983 14. Around the Table Planner Flynn pointed out that the board has not received the home owners association booklet from Bristol Arms or Fairfield.' It was the concensus of the board to send a letter requesting both of these. She also would like the site plan for Sheba's Den pulled for the next meeting, as there are two buildings, not connected, on the same lot. It was the concensus of the board to go down to Sheba's Den after the inspection of Granada Park. *To send a letter to the Board of Selectmen stating that Mitchel Seifert has resigned from the Planning Board and requesting that they advertise. The Planning Board would also appreciate a chance to review the applications and make a recommendation. Planner Doucette pointed out that the board has not yet received a letter from the Inspector of Buildings regarding Wendy's and Nabisco. The board decided to wait one more week. He also pointed out that a house was attached to another house located at 96 Walnut Street, and question whether the Inspector of Buildings was aware of this. New Appointments Motion: To appoint Ronald Doucette as the new representative for the Downtown Advisory Committee. (Fiore - Brugliera, all in favor) VOTED Motion: To appoint Tony Fiore as the representative to the Capital Improvements Committee. (Doucette - Brugliera, all in favor) VOTED Chairman Genatossio said that there was an advertisement in the paper, sponsored by the DAC, regarding an open meeting. She could not understand why the Planning Board wasn't aware of this previously, rather than reading it in the paper, as DAC is a subcommittee of the Planning Board. She suggested having them come in to discuss what they are doing. She also welcomed James Bachman to the board. She would like the East Street apartment building site plan on the agenda for next week. She requested imput from the board members for the bi-monthly meeting with the Selectmen. Joseph Mannarino informed the board of a problem in Cedar Meadows. He said that the plan called for VA4 curbing, which is 6" wide, 17 deep, and 6' long curbing. James Cannata though it was 4" curbing so that is what is in the subdivision. If the board follows the subdivision regulations, he will have to tear it up, at a cost of approximately $10,00. Joseph Mannarino asked if the board would like to enforce the regulations or waive the requirement. „Planning Board's minutes Page 8 September 14, 1983 It was the concensus of the board to follow the subdivision regulations, and inform Mr. Cannada that he will have to tear it up and replace it with the required curbing. The board will go to Cedar Meadows for an inspection after Granada Park and Sheba's Den. Motion: To send a letter to James Cannada informing him he has to install VA4” as required. (Doucette - Fiore, all in favor) VOTED 15. Public Discussion Margot Jellinek asked if the board would be good enough to pull out the bond on Circle C. She thinks it expires in November. There is more than $10,000 worth of repairs to be completed, and nothing has been done recently; and the board is only holding a few hundred dollars for this. It expires in December - Next Week's Agenda. 16. Date of Next Meeting is Wednesday, September 21, 1983, at 7:30 P.M. 17. Adjournment 10:45 P.M. CLERK
