9. Witch Pond Estates Preliminary Subdivision Plan
Planner Genatossio said she spoke with Marc McQueen of the Bristol
Soil Conservation Service regarding assistance in reviewing the above
subdivision. Mr. McQueen said that in order to review the plans, he
would need a copy of the plan, the deadline date, a topographic of the
area, and the wells and water supply protection area should be pointed
out. Planner Genatossio was informed that they use a specific form to
evaluate the subsoil erosion and drainage run-off from the site.
Concensus: To request assistance from the Bristol Soil Conservation
Service to have a data review of the subdivision done.
There was discussion regarding whether or not there has to be an access
road into the town. The sewerage is on site. They have to be 400 feet
within the water supply for Mansfield to supply water. It was pointed
out that the board should find out whether the water is coming from
Foxboro or Mansfield. Planner Genatossio has asked the Planning Counsel
this questions, and she is waiting for their response. It was suggested
to invite the Town Engineer to a Planning Board meeting to discuss this.
Also Planner Genatossio suggested arranging a joint meeting with the
Board of Health, the Conservation Commission, and the Town Engineer to
review this subdivision. It was also the concensus of the board to send
a memorandum to the Department Heads who received a copy of the plan
requesting that they review the plans and put their comments in writing
as soon as possible. Margot Jellinek pointed out that this subdivision
is located within the recharge area.

10. Surplus Material Permit Request - Richard Staples - Elm St.
Chairman Seifert read the letter from Peter O'Brien regarding this
request. They presented a plan showing the existing piles of loam
and the area which needs to be finished. Mr. Staples said that he
already spent $10,000 doing the front area. In 1979, he spent $10,000
to $20,000 to reclaim it, and he will do it again. Someone else, other
than Mr. Staples, was in there digging and stripped it. It was pre-
vioulsy seeded and limed, and now it has to be done over again. Peter
O'Brien said that any gravel that was to be removed, has been removed.
Mr. Morse has an agreement with Mr. Staples to finish. The Board of
Appeals requires that in the restoration, there are no slopes more than
4 to 1, no stumps or debris, and topsoil and subsoil has to be spread.
The amount of surplus loam was calculated by RIM Engineering. It is
a guesstimate because the piles of loam are eratic. Ralph Maloon
estimated the excess loam at 10,466 cubic yards. Mr. Staples said he
needs 2,222 yards of loam to reclaim the back section, and 324 yards
to reclaim the front section. Peter O'Brien said that some of the
neighbors were upset that it has been the way it is for so long.
Richard Staples does want to have this corrected. He has a contract with
Mr. Morse for five years to reclaim the pit and remove loam. He worked
out there on Sundays last fall. The lowest point in the pit is two feet
higher than what they could have gone down to. By the end of the summer,
he should be finished. Planner DeGirolamo asked how much loam has to
come out before the land is reclaimed. Mr. Staples said there is very
little to be remove.
Motion: To send a favorable recommendation to the Building Inspector
for the removal of approximately 7,920 cubic yards of loam
from Elm Street.
(DeGirolamo - Flynn, all in favor) VOTED
A copy of this letter will be sent to the Conservation Commission.
11. Around the Table
Planner Flynn said she would like to look at the Bristol Arms Subdivision
Plans the next time the board has a short agenda.
Planner Genatossio asked what Town Counsel was doing in relation to Cabot's
Pond. Chairman Seifert said John Dwyer is sending Robert Chavaree 'and
Allen Willis a letter. He is also reviewing the Cabot's Pond file.
Planner Genatossio also pointed out that the board has not heard' from the
Town Manager in regards to the gravel removal behind the DPW garage. She
also asked if the board had heard from David White. It was the concensus
of the board to send a reminder letter to Omar White. There was some dis-
cussion regarding where Leon Grant dumped the remains of Daggs Lounge.
12. Date of Next Meeting is Wednesday, May 11, 1983, at 7:30 P.M.
13. Public Discussion
Margot Jellinek said she would like to amend the board's recommendation to
f the Building Inspector regarding the surplus material permit. She would
like to have it specified that a certain amount of loam stay on site for
the restoration. She also pointed out that this is located next to the
Wading River. Planner DeGirolamo suggested that whatever the estimated

amount of loam is to reclaim the site, that the board members and the
neighbors are show what that certain amount of loam looks like so that
they will be aware it should stay on site. It was suggested to have
Ralph Maloon mark out how much loam should stay on site.
Motion: To suggest to the Building Inspector that the Town
Engineer go out and mark a pile of loam that is
required to reclaim the site. This pile should
stay on site.

nk Allen - Heather Lane
Frank Allen appeared before the board and said that he was out of state
when the Board of Selectmen held their meeting regarding Heather Lane.
He has made the corrections, and the Town Engineer has approved them.
He would like to have the balance of the security released. The con-
tingency has been released, and the board is only holding a small amount.
The board checked the correspondence on Heather Lane and found that they
are holding $189.99.
Motion: To release the $189.99 plus accrued interest
