5. Plymouth Street Bond Estimate
Chairman Seifert informed the board that Chadwick Maurer has not had any
time to work on this. He will not have any time before town meeting.
Therefore, the board can either wait until a new Planning Director is
hired, or they can accept it. WRC is requesting that a bond amount be
set. Acting Clerk Flynn said that there are about four items missing.
These items would add up to approximately $10,000 to $20,000 more. The
amount set for Plymouth Street now is $189,200. When Planner Flynn took
the estimate home, she verified the figures and checked them. There were
four items she could not find in the Means Catalogue. She could not reach
Paul Folkman. She will take this home for one more week and come in to
see Chadwick Maurer during the week.
6. DPW Garage - Gravel Removal
Planner Genatossio said the town is removing gravel behind the DPW garage.
She thinks that the board should be concerned because it is located within
the Water Supply Protection District. She said that the board setup reg-
ulations in the Zoning By-law for this zone, and the town is not following
them. She would like to see the pit examined, have the slopes checked, and
have the water table located. Chairman Seifert pointed out that there is
an underground raver which runs from Michael -Angela Estates to the DPW
garage. It was pointed out that Chadwick Maurer had previously stated that
this pit is grandfathered. Planner Genatossio again pointed out that it is
located within a Water Protection District; and therefore, it shosild be
checked. She pointed out that in the by-law under water protection, it
states that the operation shall stay 10 feet above the water table. Chairman
Seifert said that they have been digging into that same slope for the past
15 years.**This motion was to send a letter to Chadwick Maurer stating that
Motion: The Planning Board created a Water Supply Protection District
in 1981, which was voted at town meeting. This district lists
certain stipulations to be upheld within this district—such as,
staying approximately 10 feet above the water table. The board
would like to know if the town is staying 10 feet above the water
table.. If so, how can this be confirmed. Also the board feels
that the town should uphold the Water Supply Protection District.
(Genatossio - Flynn, all in favor) VOTED
7. Cabot's Pond
The board has sent letters to Mr. Chavaree and Mr. Willis and neither
have responded as yet. It was the concensus of the board that it is time
to take action. There was discussion regarding taking the bond and the pro-
cedure involved. Chairman Seifert pointed out that in the four years that
he has been on the Planning Board, they have never taken a passbook and have
never found out the legalities of doing so. In this case, the board is
dealing with a project where there are two separate amounts in two separate
accounts. This has to be dealt with depending on how much has been done on
each half of the project. If the pond was pumped down again, Mr. Chavaree
has approximately 70,000 yards of material he could remove; but it does not
make sense to pump in down in dollars. Some of the board members felt that
a letter should have been written to Mr. Chavaree and Mr. Willis prior to
the letter being written to Town Counsel.

Motion: To have Town Counsel send Mr. Chavaree and Mr. Willis a letter
informing them that they have two weeks to respond on their
plans for Cabot's Pond; or the Planning Board will take the
money. Also ask Town Counsel how the board goes about taking
the money held in escrow..

8. Ronald Bonvie - Wind Chime Acres
Ronald Bonvie appeared before the board. He informed the board that his price
that he has for the work to be completed in $90,000, excluding the top. This
$90,000 is well under the figure the board will estimate. All of the gravel
is on site, and there will not be any purchased. There are 14 house lots on
Erin Drive and 16 on Wind Chime. He has started work down there. Bobby
Brunelle was laying pipe today. The pond has not been dug yet. It is to be
done in conjunction with the houses, as per a conservation order. He has a
slope easement from both parties so he does not have to install the wall.
Planner Flynn pointed out that there is no figure amount for the 8 X 6 reducer
or the head and tail walls. She is going to take this home with her. Ronnie
also pointed out that last year the board signed a Form A for him. This was
required because he gave Gary Nelson a piece of property. Mr. Nelson did not
file the plan; therefore, the same plan will be coming before the board again.
Ronald Bonvie received a slope easement from Mr. Nelson in return for property.
9. Ray Goddard - Rustic and Wind Chime Acres
x' Ray Goddard appeared before the board. He said that the drainage from Wind
Chimes goes to Canoe River through several streams. He has a piece of pro-
perty which has a new stream on it as of this winter. The drainage from Wind
Chimes is going to run into the same brook. The water empties onto Leon Grant's
property. He pointed out that the stream will soon be a river. In regards to
this subject, he said he has been to DEQE, the Conservation Commission, and
the Building Inspector. Chairman Seifert pointed out that this is an approved
subdivision plan. Rustic Acres is complete, and Wind Chimes has been voted on
and approved. Wind Chimes has not been built yet, and while it is being built,
the water drainage has to flow according to the approved plans. It was pointed
out that the Town of Mansfield spent $2,000 for a survey on the drainage.
Mr. Goddard showed pictures of the stream. He also showed pictures of property
owned by Leon Grant which showed trees lying on the property. Chairman Seifert
said that the board does not have any authorization or jurisdiction to change
or modify any water flow other than the subdivision they are dealing with.
Planner DeGirolamo said that Mr. Goddard's property is one of the lowest areas
in Mansfield; It was pointed out that Ronald Bonvie did a survey on the drain-
age, the Town of Mansfield did a survey, and then another survey was done by
GHR. Planner Genatossio read a section from the report done by GHR. Ray
Goddard said he feels there should be a retention area.
10. Karl Drown, Health Agent - Compo
Karl Drown appeared before the board and informed them that the test wells
were retested and sent to two separate and different laboratories. The tests
came back neutral. The Board of Health has test results back to 1980. The
test well that previously came back with a reading is located upstream and
going against the flow. The Board of Health thought this was unusual, and
therefore retested. There have been no other problems at Compo that he is
aware of. The Board of Health would like to see the wells tested every six

months rather than once per year. Test Wells Nos. 4 and 5, which are located
downstream from the landfill, have always show a small amount of contamination;
but the state doesn't have any concern for this. The state only requires two
wells located downstream and one upstream. Planner Genatossio suggested putting
a well farther down. The Board of Health said they have considered this. They
will look into the possibility of locating another well farther downstream.
11. Around the Table
Chairman Seifert said that the board will be making recommendations on the
zoning changes next week. The board will also go through parking. Acting
Clerk Flynn suggested that the members look at a few of the banks located in
town in regards to the parking situation.
Planner DeGirolamo asked how Plantingfield Road was left. He also asked if
the board is holding any money. The board is hold $2,900.
Acting Clerk Flynn said that the book regarding zoning for solar is very
interesting, and she would like this added to the work list.
12. Public Discussion
Margot Jellinek requested that the letter she submitted for correspondence be
read completely. This letter was read. The attachments were also read. This
came about because Mr. Christoforo referenced a letter from Mr. Ripa. Margot
pointed out that Compo was operating without a discharge permit, and the League
` of Women Voters informed Mr. Ripa of this. Mr. Ripa said that the League would
have to prove that Compo was discharging 20,000 gallons of water, which they did.
The League sent in the water bills to prove that Compo was using that amount of
water for cooling. It was pointed out that no one knew where they were putting
it after. The League of Women Voters demanded a permit. Mr. Christoforo had
said that Compo handles their hazardous waste, and Margot Jellinek pointed out
that they never had a permit to dispose of the water. This is why she requested
that the Planning Board meet with the Board of Health and the Conservation
Commission.
Margot Jellinek also pointed out that the members of the Planning Board
volunteer to be on the board, and they are here to serve and protect the town.
Acting Clerk Flynn asked if anything new came in from Francis Shaw. Chairman
Seifert said Mr. Shaw requested to be on the agenda at 3:00 today. Instead
he will be on the agenda of April 13, 1983.
13. Date of Next Meeting is April 13, 1983, at 7:30 P.M.
