**The scheduled public hearing began at 8 P.M. A copy of the transcript
is available at the Planning Department.
6. Michael Avallone - Plantingfield Road
Michael Avallone appeared before the board and informed them that he attended
the hearing the Board of Selectmen had last week regarding acceptance of
( Plantingfield Road. The Selectmen told him that the Town Engineer and the
Planning Director had inspected Plantingfield Road, and they found six defects.
The Selectmen declined to take action on a recommendation because the six
repairs have to be completed before town meeting. The Selectmen feel it is
the Planning Board's responsibility to contact Mr. Rizzo. Acting Chairman Flynn
read the letter the board received from the Selectmen which listed the corrections
that needed to be made. The Planning Board has sent Mr. Rizzo a letter inform-
ing him of this, and he has been in to the town hall to find out exactly where
they are located. There are two lots left to be built, and the curb cuts are
done for the driveways. Acting Chairman Flynn asked if there was any problem
with drainage in the cul-de-sac, which there is not.
7. Revised Site Plan - Wood Avenue
Ralph Maloon appeared before the board and informed them that the shape of
the proposed building has changed. It is now rectangular. It was pointed
out previously that there was a problem with parking. Ralph said that he
figured the parking according to the present Zoning By-law and the article
proposed for town meeting. He explained how he came up with the parking
figures. On the present zoning he is proposing 58 parking spaces, and accord-
ing to the proposed article, he is proposing 58 parking spaces. There was also
a question as to whether it is considered a detached assessory building. Ralph
pointed out that there will be a continuous roof; therefore, it is not an asses-
sory building. The continuous roof is not enclosed. In reference to sewer,
there is a 12" pipe which Leon Grant installed; there is an 8" pipe coming up
Wood Avenue, and they are going to connect with a 6" pipe. Ralph pointed out
the locations of the catch basins. There was no handicapped parking space
shown on the plan. Ralph Maloon said he will designate one of the five spaces
in front of the building for handicapped parking. The Fire Chief's comment on
this site plan is he is concerned with the lack of adequate water for fire

protection for this project. He points out that no hydrant has been pro-
posed for this project. The Water Supervisor's comment is K type copper
is to be used from building to building so buildings operate off the same
meter. He is concerned about ample water from the 4" main. The Sewer
Supervisor's comment is that he would like to be notified when work on the
sewer line begins.
Motion: To recommend in favor of the site plan and to strongly
recommend that a fire hydrant be installed, as per the
Fire Chief's recommendation.
(Brugliera - Genatossio, all in favor) VOTED
Planner Genatossio pointed out that she does see it as being an overdevelop-
ment of the site in regards to parking on the site. She has a feeling it is
going to be difficult maneuvering the cars.
8. Margot Jellinek - Compo
Margot Jellinek appeared before the board in reference to Compo regarding
the letter from Hale & Dorr dated March 17, 1983. In this letter it states
that it is no longer necessary to test for Tetrohydroflorine. She also read
a letter which was written to the League of Women Voters regarding the
amount of hazardous waste Compo generates. Compo had no discharge permits.
She also read a section of the Whitman & Howard groundwater study, Page 37.
She explained what a tank farm is and showed pictures of one. She asked
the Planning Board to hold a conference with the Board of Health and the
Conservation Commission before town meeting in order to put the industrial
land back into agricultural. This would give the Planning Board more con-
trol on expansion. She asked the Planning Board to set a date. Planner
Genatossio pointed out that this is a Board of Health problem, and it should
be brought up to them. She said that the board was concerned with the water
quality in the test wells, and it has not been contaminated. If the board
is still concerned, then they will invite the Board of Health agent in.
9. Leon Grant - Maple Street Project
Leon Grant appeared before the board. The original plan was brought out.
Leon showed how far he was on the map. He has run into a piece of ledge;
therefore, he is going around it. He will be putting rocks along the pro-
perty line. The pole shed will be used to store hay. Planner Genatossio
said that this came about because she asked Bertram Cook why 10 wheelers
were coming down Maple Street. Leon pointed out that it is all his pro-
perty, and it is all under one ownership. He is stripping some gravel and
that is why the trucks were going down Maple Street. He plans to harvest
hay on the property. He pointed out that he will generate approximately
12,000 bales of hay. Therefore, he will need a place to store it. He
plans to protect the land with a conservation easement when he is finished.
Mr. Boutis still owns the land; but Leon has it under a sales agreement.
He will have to remove approximately 2,000 yc:rds of gravel more than
originally planned on. The total site is 56 acres.
10. Appeals of the Building Inspector's Decisions - Karl Clemmey
Karl Clemmey appeared before the board regarding two appeals. One in
reference to the use of a parcel of land located at 4 S. Main St., owned
by Shell Oil Company; and the second in reference to the use of a parcel
of land located at 44 Chauncy St., owned by Bruce Woods. Karl pointed
out that the Building Inspector enforces the Zoning By-law, and he questions

the storage of motor vehicles not being allowed in the downtown area. He
is only questioning the use of the storage of motor vehicles. He has filed
complaints with the Building Inspector. Mr. Wood is protected by the non-
conforming use because he has been in business, as per Mr. Cook; but Karl
is saying that Mr. Wood is no longer protected by the nonconforming use
because he has not been in the towing and storage of motor vehicles for
over the last two or three years. The storage of motor vehicles is only
allowed in the industrial zone. Planner Brugliera asked if it matters
whether the car is a useful car or a junk car when your talking about
storage. Karl said storage of motor vehicles is not an allowable use in
the downtown business zone. Mr. Kamen said he has a common carrier cer-
tificate that he bought from Bruce Wood, which gives him the right to tow
and charge for it. Mr. Kamen said that if your car is broken down and he
has to tow it to 4 S. Main Street, it is not the primary business to store
the car; it is an accessory use. It has been doing this since the station
has been built, and all stations in town and all repair shops. If I tow
your car in and I can't get to it today, tomorrow, maybe I can't get parts,
the car has to sit there. If I want to charge you money for storage,
legally I can charge you money for storing. As far as downtown business
goes, it is not zoned for salvage which means I can't bring in a salvage
automobile. Salvage is an unrepairable automobile. This discussion when
on.
Motion: To send a letter to the Board of Appeals stating that
the Planning Board feels this matter is more properly
heard before the Board of Appeals; therefore, the
Planning Board abstains from taking any action.

removal behind the DPW garage. It is in the water protection district.
She also said that Ronald Bonvie, Bonwood, had no excess material permit
for Fairfield.
