3. Minutes of March 2, 1983
Motion: To approve as amended
(Flynn - Fiore, all in favor) VOTED
Planner Flynn pointed out that on Page 3, No. 7, 4,000 sq. ft. should.be
changed to 400 sq. ft. and 6,000 feet should be changed to 600 feet.
4. Site Plan - Peter Saunders - Old Coles Way - Typical Floor Plan
In reference to the discussion at the meeting of March 2, 1983, regarding
the by-law requirement of 600 feet vs. the building code requirement of
400 feet, Planner Flynn informed the board that she called various people in
Boston to see if the building code overrules the by-law. She was informed
that the Building Inspector would have to follow the by-law requirement.
The typical floor plan was redesigned to provide 600 feet. However, this
would include the washroom closets, hallways, ect. There was discussion
regarding whether or not hallways, ect. may be included in the 600 feet.
5. Margot Jellinek - Inland Ponds
Margot pointed out that the board sent a letter to Allen Willis regarding
his pond development. First, Allen Willis applied for an enlargement of
a pond. He also filed a Form A. He applied to the Army Corps of Engineers
and the Conservation Commission. She has all the correspondence on this.
Acting Clerk Genatossio read the letter which the board sent to Allen Willis.
She pointed out that the board will have difficulties because the Army
Corps of Engineers is under the impression that he is enlarging a pond.
The board gave him his first permit for a new pond. The Army Corps was
ready to give him a permit for the enlargement of a pond. This may make
legal difficulties for the Planning Board if a new permit is issued.
6. Typical floor plan - Rumford Square - Peter Saunders
The board referenced the by-law, Page 15B, Intensity Regulations. This
states, "each dwelling unit shall have a minimum of 600 sq. ft::.af interior
floor area, exclusive of cellers, said area to be measured to the exterior
walls of the structures". There was more discussion regarding whether the
Planning Board's minutes

hallways, ect. could be included in the 600 ft. There was also discussion
regarding exactly how this area should be measured. Planner Flynn sug-
gested writing a letter to Bertram Cook stating that Peter Saunders should
have to adhere to the 600 ft. requirement. It was pointed out that the
amended typical floor plan was calculated by taking the total area and
dividing it by the number of units. It was pointed out that this require-
ment was initiated after World War II. The soldiers were coming home, and
the government was putting up very small houses. This created a problem.
This is how the 600 ft. measurement came about.
Motion: To send a letter to Town Counsel asking his opinion on how
the Planning Board should apply Section IV A, Paragraph 5
of the Mansfield Zoning By-law, and whether the Mansfield
Zoning By-law or the State Building Code supercedes in
relation to this paragraph.
(Fiore - Flynn, all in favor) VOTED
Motion: To send a letter to the Executive Office of Community Development
and the Massachusetts Federation of Planning Boards asking if the
local zoning board can adopt zoning ordinances that are more
stringent than those in the State Building Code. If so, which
one does the Building Inspector have to comply with.
(Flynn - Fiore, all in favor) VOTED
Acting Chairman DeGirolamo said that he would rather settle this with the
Building Inspector.
7. Wind Chime Bond Estimate
The board looked over the bond estimates, which were prepared by Paul
Folkman, for Wind Chime. Most of the figures were taken from the 1982
Means Catalogue. However, there are three items that do not have an
estimate. This is because they were not listed in the Means Catalogue.
Planner Flynn said she would take the Means Catalogue home and the bond
estimate to calculate the three items.
Motion: To hold until next week
(Flynn - Genatossio, all in favor) VOTED
8. Plymouth Street Bond Estimate
David Grant had previously submitted a bond estimate and plans for Plymouth
Street. These figures were given to Paul Folkman to review. He checked
the figures with the plans, and the amounts with the Means Catalogue. He
commented on whether the estimate was high, low, or exact. The board looked
over the estimates. Planner Flynn said she would take these home and call
Paul Folkman and David Grant to discuss this with them.
Motion: To hold until next week
(Flynn - Fiore, all in favor) VOTED
9. Variance - Kevin Jackson - Hope Street
Mr. Jackson would like a variance to construct an addition consisting of
a porch, mudroom, and a one -car attached garage to his dwelling located
at 220 Hope Street. There would be a 34 ft. rear yard measurement which
is nonconforming in a Residence A Zone. The rear yard requirement for
Planning Board's minutes

the Residence A Zone is 40 feet. The grounds for the variance are a
garage to house the car, screened porch to enjoy the yard, and the
mud room for practical entrance into the house.
Motion: To send a favorable recommendation to the Zoning
Board of Appeals.
(Genatossio - Fiore, all in favor) VOTED
10. Correspondence
Granada Park: The board read the letter from Joseph McKenna regarding
his inspection of Granada Park. In this letter it stated that sidewalks
were not completed, a curb has to be reset, sidewalks have to be tied
into the driveways, and that sidewalks were sunken at light pole bases.
Acting Chairman DeGirolamo said that the sidewalks will be completed
when the top coat is put on the road. He also pointed out that the most
recent houses that were built would be rough because they were done late
in the year. The board also went through correspondence on Granada Park.
Motion: To send a letter to the bank asking them to acknowledge
the board's vote to release funds and requesting an
updated figure on the bond.
(Fiore - Flynn, all in favor) VOTED
Surplus Material Request: The board received a request for a surplus
material permit from Lachance Excavating, Inc. to remove 2,500 cubic
yards of material from Park Street. This is the Mansfield Housing for
the elderly project. In this letter it stated that the loam will be
stored on property owned by Leon Grant. The material will be stored for
re -use, and any excess will be given to Leon Grant. Ray Goddard said
that the loam also consists of parts of a buried building, and Leon Grant
is taking the loam and excess gravel to continue his gravel operation.
He suggested that the board members drive by and inspect this. Bertram
Cook ordered a cease and desist on this because they did not come before
the Planning Board, as stated in the by-law.
Motion: To postpone action on the gravel removal request until
the board members have a chance to inspect where the
loam is being stored.
(Flynn - Fiore, all in favor) VOTED
Acting Clerk Genatossio pointed out that since this is the Housing
Authority building, why is the loam being moved to Leon Grant's property.
She pointed out that there must be land that the town owns that this
loam could be stored on. Acting Chairman DeGirolamo said that it would
have to be stored in an open area. Acting Clerk Genatossio suggested
behind the DPW garage.
Motion: To send a letter to the Town Manager and the Housing Authority
suggesting that the loam be stored on town owned property;
therefore, the town would have access to the excess material.
(Genatossio - Flynn, all in favor) VOTED
11. Around the Table
Planner Flynn said that the Conservation Commission informed her that
they received a memorandum from Paul Folkman regarding site plan review.
It was pointed out that this is a form memorandum, and it will be changed
to read from the Planning Board.
Planning Board's minutes
Page 5
March 9, 1983
Planner Flynn also pointed out that there was a hearing notice in the
paper to rezone land presently zoned Res. AA and Agricultural to Res. B
on Branch Street. She pointed out that the board did not receive this
rezoning proposal from the Board of Selectmen, and the Selectmen are
required to send the proposed rezoning changes to the Planning Board.
Motion: To send a memorandum to the Board of Selectmen requesting
that they adhere to this policy.
(Flynn - Fiore, all in favor) VOTED
Planner Flynn would like to obtain the cluster rezoning information
from Bob Marshall.
Acting Clerk Genatossio pointed out that the board does not have anything
in the by-law as to what is considered a condominium or what is required.
She said that the Town of Sharon and the Town of Easton are preparing
sections of multiple dwelling buildings/condominiums, and she would like
to obtain copies of these. It was suggested to call and request copies.
Planner Fiore suggested spending more time on work list items. Acting
Chairman DeGirolamo suggested taking a little less routine work each
night.
12. Date of Next Meeting is Wednesday, March 16, 1983 at 7:00 P.M.
13. Public Discussion
Margot Jellinek pointed out that the certificate of compliance for Bruce
Evans is Lots Nos. 12 and 14 located in Granada Park. She requested
the letter from LaChance Excavating, Inc.
Ray Goddard said he would like to appear before the Planning Board regard-
ing the Wind Chimes Subdivision for drainage. He has letters, maps, and
pictures.
14. Adjournment 10:00 P.M.
