Site Plan - isoo - Branch Street
Planner Fiore pointed out that the proposed parking lot is located in the
Agricultural Zone. He questioned whether or not this is allowed, as it is
not specifically stated in the Zoning By-law. He also pointed out that
the board has an article to rezone this land. If it is rezoned, will this
become a non -conforming use? Ralph Maloon and Charlie Knisbell appeared
before the board. Ralph showed the location of the test well owned by
Compo. This test well is not located in the proposed parking lot. This
well site was added to the site plan. The staff comments were that the
Fire Chief would like the compactor to be moved away from the above ground
storage tanks, which are shown less than 50 feet away. Charlie Knisbell
said there would be no problem in moving the compactor. Karl Drown's com-
ments were: (1) Where will the new septic system be located? Ralph Maloon
said when ispo came in, the leach field was designed for 40 people, and
they only have 15 people in the building. Karl commented that the subsur-
face sewage system will have to be expanded. Ralph said that there is a
new sewer line coming through, and Compo and ispo are planning to connect
to it. Ralph said that Karl may think that this expansion will produce
more people, which it will not. Planner Genatossio questioned the fact
that they are adding showers. Charlie Knisbell said they are only adding
two showers. The industrial traffic will not park across the street. Karl
also commented as to where Compo is going to relocate their test well; but
as it was previously pointed out, the test well is not located in the park-
ing lot. Ralph said that the test well is checked by Whitman & Howard two
times per year. Charlie Knisbell requested an extension until March 16.
Motion: To accept the extension request
(Flynn - Genatossio, all in favor) VOTED
The board still questioned whether a parking lot may be put in an Agricultural
Zone and what effect the proposed zoning change will have on this addition.
Ralph pointed out that there was a Form A signed in 1982 for this land.

Motion: To send a letter to Town Counsel asking whether a parking
lot is allowed in an Agricultural Zone; and in reference
to Chapter 40A, Section 6, what effect the proposed zoning
change may have on this site plan. It should be stated
that a Form A was approved in 1982 for this land.
(Brugliera - Fiore, all in favor) VOTED
7. Site Plan - Peter Saunders - Old Colony Way
The proposed apartments are approximately 500 square feet each, although
they are not all the same. The grain mill apartments are slightly smaller.
This building will abut the diner and a five -unit apartment building.
There are no curbs or sidewalks. It is just paved. It was pointed out
that the Zoning By-law requires that the building consist of 600; sq. ft.
The State Building Code only requires 400 sq. ft., and this overrules
the Zoning By-law. It was pointed out that the Mansfield Zoning By-law
does not have any setback requirements for the Downtown Zone; however,
the State Building Code does.
Motion: To send a favorable recommendation to the Building
Inspector, Bertram Cook.
(Brugliera - Genatossio, all in favor) VOTED
8. Around the Table
Planner Genatossio asked if Robert Chavaree had replied to the board's
letter regarding the security guarantee. It was pointed out that this
letter was sent on February 17, 1983. The board has not received a
reply yet. It was the concensus of the board to wait until March 23, 1983
to receive a response. If they have not heard anything as of this date,
they will take other action.
Planner Genatossio pointed out that the special permit for Willis Pond
expired. This expired on September 24, 1982, and Allen Willis did not
come in for a request for an extension. Therefore, if Allen is still
interested in this project, he will have to come back before the board
for a new special permit.
Motion: To send a letter to Allen Willis informing him that the
special permit expired on September 24, 1982; and since
he did not request an extension, he will have to obtain
a new special permit if he is still interested in pursuing
this project.
(Fiore - Brugliera, all in favor) VOTED
Clerk Flynn asked what was being done about the drainage problem in
Cedar Meadows. The board went through the past correspondence. Acting
Chairman DeGirolamo said that it looks like if/when the last lot gets
developed near the Shaws, something will be done. He does not feel
anything will happen until the lot is developed. In previous correspon-
dence, a letter was written to the bank requesting a three -party agree-
ment. A letter was also written to William Canaday stating that the
the drainage construction work be completed by December 10, 1982.
Motion: To send a letter to William Canaday asking what his
plans are for resolving the drainage problem on Ephriam
Drive behind the Shaws' house.
(Flynn - Fiore, all in favor) VOTED
*Planner Brugliera left the meeting during the drainage discussion.

9. Date of Next Meeting is March 9, 1983, at 7:30 P.M.
10. Public Discussion
In reference to Willis Pond, Margot Jellinek said that a pond has to
have been visible for the past 10 years, and it has to be a minimum of
10,000 sq. ft. She said that the Planning Board had no business to
say it was a pond. She pointed out that in the Zoning By-law it states
that the permit is issued for a period of one year, and he may request
a one-year extension. She said she has legal proof that it has to be
visible in the past 10 years, and it does have 10,000 sq. ft. She
said she will bring this to the next meeting. She also said she feels
that Hatheway Patterson is in violation of the Zoning By-law.
