Also to change the board did not know Leon was going to do this to the Mansfield Planning Board. Lot 2 Ronnie hopes to take out of land court, and Lot 1 is where the apartments are going. The attorney at the bank noticed this when he was going to close on some units. Rezoning Articles Chairman Seifert said that the industrial rezoning article was amended on April 2, 1982, which was after the public hearings. He asked if any of the board members had any changes. Motion: To amend the article by removing Mr. Wolf's property, Parcel No. 2, from the industrial zone for this town Meeting because industrial land should not be extended into a residential section. Also there is not adequate water and sewer utilities or roads. (Flynn - Genatossio) Opposed - DeGirolamo, Fiore, and Seifert Motion: That all the rezoning articles be written as separate articles, instead of one large article. (Flynn - Genatossio, all in favor) VOTED Planner Genatossio said she realizes that Mr. Ispo left the public hearings last year with the impression that his land, Coinpo, would not be rezoned. However, she pointed out the problems Compo is having with the land fill contaminating the water. She said that if Compo was put in an agricultural zone, they would have to come before the board for a special use variance. The board would have a little more control. The water contamination problem is getting very serious. If their property stays industrially zone, they may do what ever they want. Motion: To send a letter to Judee Shupe asking for the deed, description, and as -built before it may be put on the warrant. (Flynn -- WITHDRAWN At this time, it was pointed out that in the Subdivision Control Laws it states that the developer shall provide for the proper maintenance during the construction and for a period of eighteen (18) months after the com- pletion of said improvements. There was discussion regarding how long the roads proposed for acceptance have been completed. The board went through old correspondence and minutes. Hampden, Middlesex, and Norfolk Streets have been completed since 1979. Motion: To send the Board of Selectmen a letter with the Planning Board's recommendation for approval for Town Meeting road acceptance of Hampden, Middlesex, and Norfolk Streets, and request that they hold the required public hearing. Gravel Removal In reference to the elimination of gravel operations, Planner Flynn said she feels that the trucks damage the roads, the gravel that spills is hazardous to small children, people riding bikes, and motorcycles. The tax payers are paying for the up -keep of the roads. She also referenced the hassels that the abutting home owners have and the number of gravel operations that were not brought back up to grade. She also said there have been a number of times when the Zoning Board of Appeals took court action against gravel operations. Planner Flynn will write up a draft article for Town Meeting. 13. Site Plan Change Planner Genatossio said she would like to have Section 5 K (2) of the Zoning By-laws amended. Motion: When the Building Inspector's decision differs from the recommendation of the Planning Board, the reasons should be stated in writing within seven days of the decision. He should also address specifically the recommendations of the Planning Board in this letter. (Genatossio - Flynn) In favor - Fiore Opposed - DeGirolamo Chairman Seifert pointed out that the Building Inspector follows the ' Mansfield Zoning By-laws and the State Building Codes when issuing a permit. If the plan conforms to both, then a permit is issued. He pointed out that one reason the board did not want to see a permit issued for Ronald Bonvie's six unit was because they felt it was an overdevelopment of the site. He said that if the Building Inspector was going to respond to the Planning Board as to why a building permit was issued, he would probably state the reason the permit was granted is because it conforms to the State Building Codes and the Mansfield Zoning By-laws. 14. Form A - Joseph Brugliera - Heather Lane This Form A consists of two lots located on the northerly side of Heather Lane. Both lots have frontage on an existing street. This Form A was sent back last week because the zoning classification was not shown. There was a motion made on January 19, 1983 to sign the Form A when the proper zoning classification was noted on the plan. The zoning classification was noted on the plan; therefore, the board members signed it. 15. Form A - Allan Brown - Balcom Street This Form A consists of a parcel of land located on the northerly side of Balcoin Street. The lot shown has frontage on an existing street. The board members compared the description with the Plan. There was discussion regarding the ownership of Lots Nos. 9 and 11. Motion: To send it back to have the proper ownership of Lots Nos. 9 and 11 noted on the plan. (Fiore - Genatossio) Opposed - DeGirolamo **Planner Flynn left the meeting during the Balcom Street Form A discussion. Planning Board's minutes January 26, 1983 Page 6 16. Environmental Impact Report - Michael -Angela Estates II Chairman Seifert read the letter from MAPC. It was pointed out that the Foxboro Conservation Commission will be writing up an order of conditions for Michael -Angela Estates next week. Diane Royal said that the Town of Mansfield has agreed to pay 50 percent for an independent study; but one commissioner in the Town of Foxboro felt it was the Town of Mansfield's problem. Evelyne Shrom, Chairman of the Foxboro Conservation Commission, said that this is only one persons opinion and she pointed out that there may be a way that Foxboro will pay 50 percent for the independent study. Diane Royal said she does not think that Whitman & Howard should do the study because they work for Mansfield and Foxboro. The Mansfield Conserva- tion Commission sent a letter to the Foxboro Conservation Commission regarding this. Diane Royal called the Foxboro Conservation Commission today and asked wait until they receive the letter before they take any action. Clerk DeGirolamo suggested having town personnel do the study. It was pointed out that the town personnel are not qualified. Motion: To send a letter to Michael Coppola, Chairman of the Foxboro Planning Board, thanking him for the letter and reiterating the board's concerns and express the board's hopes that the Town of Mansfield and the Town of Foxboro work together to hire an independent engineer. (Genatossio - DeGirolamo, all in favor) VOTED 17. Public Discussion Margot Jellinek questioned Circle C road acceptance.
