Minutes of January 5, 1983 Motion: To approve (Genatossio - Brugliera, all in favor) VOTED Bill from New England Telephone in the amount of $57.85 Motion: To pay (Brugliera - Genatossio, all in favor) VOTED Subcommittee Master Plan Chairman Seifert informed the board that the subcommittee which Kenneth Parsons was the chairperson of is almost complete; however, the.subcom- mittee that Donald Kaufman was the chairperson of still has alot more to do. Tony Fiore is already on a subcommittee; therefore, Robert Ross was appointed as the new chairperson for Subcommittee B2, Services & Facilities. This subcommittee consists of the Water Dept., Light Dept. Recreation, Airport, Transportation, Highway Division, and Conservation Land. Chairman Seifert informed the board that Paul Folkman has been hired by the Town Manger as a consultant. He will be helping the Planning Board prepare the articles for Town Meeting. In reference to Beachwood Estates, Planner Genatossio asked if engineering expertise will be required. She also asked what the status of the punch list items is. There was discussion regarding who is going to check the road. Grant Johnson - Acceptance Middlesex, and David and Vernon appeared before the board. They presented the board with three maps of the roads. They explained that the roads have been sitting with the finish course since 1979. They submitted a description for the warrant and presented the board with copies of the deed. If the articles pass, they will give the original deed to the town. There is a punch list which they went over with Paul Folkman. They corrected all the items on the ounch list. Paul Folkman went out after the items were corrected. There is correspondence in the file regarding this. It was pointed out that thev put in a sewer line for the Hagan Bldg. and ran into a water line. They found out that the outside of the water pipe was corroded. Bob Morrison Planning Board's minutes January 19, 1983 Page 4 took a sample and is having it tested. David and Vernon realize that this is their responsibility, but they don't want to hold up the acceptance. re: Hold Harmless Agreement. It was pointed out that a section of Plymouth Street is under construction. There was a slight change on one section of the grade on Plymouth Street. This was approved by George Wey. They sub- mitted a plan that lowered the grade a little. Paul Folkman and George Wey reviewed it and accepted it. They requested bond amounts on the whole west side. Presently, there is a bond in the name of Mansfield Trust, and they would like to transfer it to the present owner. There is a section of Plymouth Street that has not been constructed yet. He explained the three sheets which cover the amounts for the different sections of Plymouth Street. The three sections of Plymouth Street are as follows: there is one section with everything finished but the top coat; there is one section that is under construction; and there is one_ section which has nothing done. Paul Folkman prepared a memorandum dated November 9, 1982, using the 1982 Means' prices for the security guarantee estimates for Kent, Lincoln, Rutland, and Cambridge Streets. The total security guarantee, according to this memorandum, is $1,012,643.90. These figures are acceptable to David and Vernon. Motion: To accept the security guarantee in the amount of $1,012,643.90 for Kent, Lincoln, Rutland, and Cambridge Streets. (Flynn - Fiore, all in favor) VOTED The Plymouth Street figures were prepared by Cabot, Cabot & Forbes. They f, used Paul's money amounts. The unit prices were provided by Paul. There were a few items which he did not give them a unit price for; therefore, C, C & F figured these items. Motion: To have the figures checked by Chadwick Maurer to make sure they are correct and are the current Means' prices. (Brugliera - Flynn, all in favor) VOTED 8. Cabot's Pond Letter from Attleboro Savings Bank stating that the bank is holding $20,000 in an unadvanced mortgage escrow account on behalf of Robert Chavaree for the purpose of posting security guarantee for Cabot's Pond. It was pointed out that the board never voted to use the loam on site as a guarantee. The board went through old correspondence. The present bond is calculated by 1980 Means' Catalogue prices. Motion: To send Robert Chavaree a letter stating that he needs to submit a performance guarantee in the form of a bond or other security totaling $61,296.76 (Flynn - Genatossio, all in favor) VOTED There was some discussion regarding what the board will do if they don't have the money to post a security. Planner Flynn pointed out that she does not feel that the town should accept the loam as security. 9. Vending Trucks Chairman Seifert read the letter from John Dwyer to the Board of Selectmen regarding vending trucks. The Selectmen wrote the Planning Board a letter requesting that they make a recommendation on how an article could be drafted Planning Board's minutes January 19, 1983 Page 5 to limit the areas in town where a vending truck could sell. Chairman Seifert suggested preparing an article, such as, vending trucks can't sell within a school district, which would be defined as 1/4 of a mile in radious; and they could not sell within 1,000 feet of a food establish- ment. There was discussion regarding this. It was pointed out that in the letter from John Dwyer, it states that the Selectmen may draw up rules and regulations as to what public ways the vending trucks may operate on; and the hours that they may do so. The Board of Selectmen are also the licensing authority. The Selectmen have the authority to license and define the streets where they may be allowed. It was the concensus of the board that the Selectmen already have the authority they need. Motion: To send a letter to the Board of Selectmen , along with their original request, indicating that the Planning Board feels this could be properly handled in the licensing procedure, not the Zoning By-law. (Fiore - Brugliera, all in favor) VOTED 10. Circle M - Judee Shupe Chairman Seifert informed the board that they sent Judee Shupe a letter on October 28, 1981, asking for completion of the punch list items. These items that needed correction were: numerous cracks in the roadway, water gate near cul-de-sac on Maverick Drive needed to be straightened, cracks in several places along edge of sidewalk, and puddles in Pinto Way cul-de- sac. Judee Shupe kept sending letters requesting the release of the loam and seeding money. Chairman Seifert read the letter she sent to Peter DeGirolamo requesting solutions. Peter did some of the sidewalks and top coat. He replaced the water gates because the binder had been done five years ago; therefore, the water gates were cracked and had to be removed before the top coat could be put on. These people knew what needed to be corrected over a year ago. Motion: To send a letter to Judee Shupe informing her that the Town Warrant closes in two weeks, February 1, 1983, and hope the roadway punch list for this subdivision, Circle M, is com- pleted by then. Enclosed will be a copy of the Oct. 28, 1981 letter. (Flynn - Fiore, all in favor) VOTED 11. Robert Rizzo - Plantingfield Road Acceptance Robert Rizzo submitted the deed description. Chairman Seifert explained that he would like to get on the town warrant to have Plantingfield Road accepted. Chairman Seifert suggested taking this up at the next meeting when the other road acceptance items will be discussed. *Planner Brugliera left the meeting 12. Form A - Joseph Brugliera - Heather Lane This Form A consists of two lots situated on the northerly side of Heather Lane. The lots shown have frontage on an existing street. Form A - Allan Brown - Balcom Street This Form A consist of a parcel of land on the northerly side of Balcom Street. .It was pointed out that Lot No. 63 is owned by Connie Eagan, Lot No. 10 is owned by Allan Brown, and Lot No. 9 is owned by Bob Cassidy. The board was going through the description of the property and realized that it stated that this is westerly and southerly by Inman which is not' on the Form A. Motion: To return the Form A due to lack of information. (Flynn - Genatossio, all in favor) VOTED It was suggested to give Ralph Maloon a copy of the Form A checklist and request that he attend the next meeting. 14. Around the Table Planner Ross informed the board about himself. The other members also did this. He also requested a copy of the Zoning By-law and Subdivision Regulations. He also request a copy of the list of the members of the Planning Board. There was discussion regarding the appointment of a member of the Planning Board to be on the Downtown Advisory Committee. Planner Ross showed an interest in being a member of the DAC. Motion: To appoint Robert Ross to represent the Planning Board on the Downtown Advisory Committee. (Fiore - Brugliera, all in favor) VOTED Planner Brugliera pointed out that there was an article in the Sun Chronicle issue dated January 11, 1983, which stated that Bob Marshall did some work on the guidelines and regulations for cluster development. He said he doesn't remember ever seeing or hearing about this. It was suggested to ask Bob Marshall. Planner Genatossio pointed out that in the memorandum from the Town Manager, it states that he requests that the board submit a listing of the articles for Town Meeting before January 21, 1983. It was the con - census of the board to send the Town Manager a memorandum listing the following: Removing commercial gravel, street acceptance, rezoning, and changes to site plan approval regardin the Building Inspector.
