(Genatossio - Flynn, all in favor) VOTED
Planner Flynn pointed out that she left the meeting of November 18,

Article 35, which was sponsored by the Planning Board. She said

She also presented the Zoning Act of Massachusetts, Chapter 40A
and a map on the salt shed. She also presented a booklet entitled
Water Quality Management Planning for Urban Run-off. She said that
the Town is in violation of Article 35, Water Supply Protection
District, because of their salt storage. She pointed out that

the Zoning By-law has a pnealty for salt storage. This penalty is to
charge people a fine if they do not obey the By-law. She asked when
the Board would like to start charging the Town this fee. Planner
Seifert said that he did not think that Article 35 would effect an e
existing use. Margo Jellinek disagreed with this. She said that it
would effect an existing use, and it would not come under the grand-
father clause. She again asked if the Board was going to charge the
fee and when they would like to start. Chairman Kaufman said that
he thinks that the Building Inspector would be the enforcer. Planning
Director said that the Town no longer uses salt with sodium ferrocynide;
the concrete pad where they mix the sand and salt has been expanded so
that the run-off will go away from the storage shed; the Board of Health
will be doing water testing in catch basins and the river. He said that
the long term outlook is to either move the storage shed or stop salt-
ing completely. Chairman Kaufman said that he feels it is the opinion
of the Planning Board, and the Planning Board agreed, that the storage
by the Town is a non -conforming use, and if they are wrong, the person
to enforce the fine would be the Building Inspector. If the Building
Inspector finds the Town in violation, he will send a written notice
of the fine to them. The fine is not levied until the letter has been
sent.
Motion: To send a letter to the Board of Selectmen regarding the
Planning Board's concern of salt storage on the East Street
site because it is in the Water Supply Protection District.
Also the Planning Board would like to see them work towards
a positive solution.
