(Genatossio - Kaufman, all in favor) VOTED 5) The Board met with Ralph Maloon to discuss the site plan application of C & S Contracting Co., Inc. Planner White left the meeting during the discussion. Chairman Flynn read the letter of application from RIM Engineering Company to the Board. The proposed building would be a garage located on School Street. Mr. Maloon explained to the Board where the building would be 'located on the site. He noted the plan shows the proposed street drainage and told the Board that there is existing street drainage from School Street onto the property. Equipment and material for the nursery business will be stored in the building. Planning Director Folkman told the Board that he had viewed the site with Building Inspector Bertram M. Cook and noted that the large tanks on the property above ground hold 29,000 gallons of fuel. He told the Board that Mr. Smith mentioned that they may be taking them down. Mr. Maloon told the Board that they are not proposing pavement because they will have heavy equipment going over it and they will be bringing in loam and materials to be stored in the garage. Planning Director Foll<man told the Board the purpose of the pavement is to control the run-off and dust. He stated he felt the entrance and exit road should be marked clearly. They could have curbing to line the entrance and exit and pave the narking area in front of the nursery with a driveway to the garage. Chairman Flynn read Planning Director Folkman's memorandum on the site Plan. Mr. Maloon stated they could have an island to control the traffic and put landscaping on the island. Minutes January 2.8, 1981 Page 3 Motion: To return the Plan with Planning Director Folkman's comments that the parking lot needs to be paved/curbed as per Section V -K -2-b and V -C-3 of the By-law; the entrance and exit drive has not been designed, and is an uncontrolled frontage entrance way; the drainage plans cannot be approved until the paved areas have been designed and the affects on drainage calculations determined; and there is no proposed landscaping and fencing, to see if they can work out some type of compromise. (Genatossio - Kaufman, all in favor) VOTED Mr. Maloom.topk the plans with him when he left the meeting. 6) The Board discussed the Water Supply Protection District amendment. Planning Director Folkman told the Board that the only part of the amendment that he felt comfortable with was the item that prohibited landfills, junkyards, herbicides and so on. He noted he didn't feel a special permit would be necessary for commercial and industrial uses. At 8:00 P. M. the discussion stopped for the public hearings. 7) At 8:00 P. M. a public hearing was held on the application of W R C Properties, Inc. for a subdivision on Norfolk Street. Planner White left the meeting during the hearing. A complete transcript of the hearing is on file. 8) At 8:30 P. M. a public hearing was held on the application of E R C Corp. for an earth removal permit for land off Maple Street. A complete transcript of the hearing is on file. During the hearing Chairman Flynn turned the gavel over to Clerk Brugliera and left the meeting. 9) The Board returned to the discussion on the plater Supply Protection District. Planning Director Folkman told the Board that he is against the article. He noted the article has been prepared entirely from SRPEDD Material and he didn't feel. he has done enough research on the subject to support an article at Town Meeting. He told the Board he is planning to visit SRPEDD to check on their information. He noted he would go along with the first two pages of the article as written, but wanted to check out the maps first. Planner Genatossio felt the Board should go along with the entire article including the special permit provisions. Planner White told the Board that he didn't feel he could support the article as it is written. Planning Director Folkman told the Board that he will not endorse the article at Town Meeting because it was hastily prepared, and he hasn't had time to check on the map. He noted that they would have to have SRPEDD defend the map. Planner Genatossio asked if he would support the article if the map was defensible and he said he would. Motion: That the Board submit as an article for Town Meeting the following: "To see if the Town will vote to amend the Zoning By-law by inserting in Section II -A - Classes the following: "!Rater Supply Protection District. and to insert in Section II -B - Boundaries Minutes January 28, 1981 Page 4 5. The Water Supply Protection Districts are those areas so designated on a map entitled "Water Supply Protection Districts" at a scale of 1" = 2,000' dated September 1978 and revised January 1981 by the Southeastern Regional Planning and Economic Development District, which map is incorporated by reference as part of the Zoning By-law of the Town of Mansfield. and to insert in Section III - Use Regulations: K. "Water Supply Protection District" The purpose of the water supply protection district is to protect the public health, safety, and welfare by regulating uses of land and buildings and the characteristics of such which may pollute, degrade, or otherwise damage the source of the current water supply for the residents, adjoining cities and towns, and the public generally. Except as specifically provided otherwise, this Section III -K applies to the water supply protection district hereby established. The water supply protection district is superimposed on other zoning districts established by this by-law. All uses, dimensional require- ments and other provisions of this By-law applicable to such under- lying districts shall remain in force and effect, except where the water supply protection district imposes greater or additional restrictions and requirements, it shall prevail. 1. In those portions of the Town within the Water Supply Protection District the following uses of land shall be prohibited: a. Commercial storage, processing, manufacturing or disposal of any hazardous waste materials. b. Outdoor storage of road salt, pesticides, herbicides, insecticides. c. Junkyards, dumps and landfills for waste materials. and the map as an article with the understanding that the map is going to be cleared up as to where the areas are and that SRPEDD convinces the Board of the defensibility of the map. (Kaufman - Genatossio; Kaufman, Genatossio, Brugliera in favor; White opposed) VOTED 10) The Board discussed the proposed article for fee schedules. Planning Director Folkman told the Board that he felt it would be better to propose the article without figures and to give the Board of Selectmen the power to set the fees so that the Zoning By-law would not have to be amended everytime the Board decided to change the fees. The Selectmen would just hold a public hearing on the changes. It was the consensus of the Board that the article should include a statement on the recommendation of the Planning Board. Motion: To approve an article for Town Meeting by adding to Section VI -A Administration - 5. Fees - The fees required for application and permit review contained within the Zoning By-law shall be established by the Board of Selectmen on the recommendation of the Planning Board. (Kaufman - White, all in favor) VOTED Minutes January 28, 1981 Page 5 11) Motion: To approve an article for Town Meeting for the acceptance of Erick Road and related drainage easement as shown on on a plan entitled, "Street Acceptance Plan, Erick Road, Mansfield, Mass." dated November 1978 and prepared by R. C. Southwick Associates. (Kaufman - White, all in favor) VOTED 12) Planning Director Folkman told the Board that Town Counsel Mulcahy has reviewed the earth removal amendment in regard to the Town having a legal easement over the property in the case of a default. He noted there may be a change in the wording of that section before Town Meeting . 13) The date for the next meeting was set for February 4, 1981 at 7:30 P. M. 14) Meeting adjourned at 11:30 P.
