each member who wished to receive a copy .of the newsletter. It was
the concensus of the board to copy the newsletter rather than paying
$4.00 per member to have it mailed to them by Joseph Magaldi.
*Planner Parsons entered the meeting
4. Variance - Incorp Development, Corp. - Forbes Blvd.
Incorp Development requests a variance to construct a 125 -room motel
at 60 Forbes Blvd. containing five stories, which is non -conforming
in the Industrial Zone. The shape and wetland condition on the lot
limits the available space for construction. If less than five
stories are permitted, the project will be economically impossible.
Chairman Seifert informed the board that.he had spoken with Bertram
Cook. He read Section 3, Exemptions from:Zoning Regulations, of the
General Laws. Mr. Cook said he had called the Department of Community
Affairs and Development regarding the three.story height restriction
vs. the 45 feet restriction. The Department of Community Affairs
informed Mr. Cook that the Zoning By -Jaw may regulate the number of
feet, but it shouldn't regulate the number of stories because the State
Building Code already regulates this. It was also pointed out that if
you had a 45 ft. building with three stories, the ceilings would be
15 feet high.
Motion: To send a favorable recommendation to the
Zoning Board of Appeals.

Margot Jellinek - Canoe River Estates Subdivision
Margot Jellinek appeared before the board and said that no one from the
Planning Board went to the public hearing, which was held in Foxboro,
regarding the Canoe River. She presented the board with a geological
survey map and pointed out the location of.the Canoe River and the pro-
posed subdivision. She also said that in 1982, this was voted the Water
Supply Protection District. She presented the board with another map
and pointed out Beaumont Pond and Factory Pond. She read sections from
the Conservation Commission's study regarding the following: (1) Chemical
Additives to run-off water. She pointed out that all run-off from Road A
is _going into Canoe River to Beaumont Pond.. (2) Expected Contents,,
(3) Affect on Groundwater Quality, (4) Elevations of Septic Systems.
She said that it is going to be a 13 lot subdivision, 16 acres in size.
Chairman Seifert suggested that the board members read the impact study
which has been done on Beaumont Pond. He said that he and Paul have,
already reviewed it. Margot Jellinek informed the board that the Foxboro
Conservation Commission is holding a hearing on August 10, 1982.
Motion: To have the DPW Director/Engineer look over the
Canoe River Subdivision plans and the wetlands
protection act,'

7. Granada Park Subdivision - Harry Curry and Richard DeMarco
Chairman Seifert read the petition submitted by the residents. He informed
them that the drainage is all the board has control over. Mr. Curry said
they were in seven months ago because he had 8 inches of water in his base-
ment. The developer put in a pipe to stop the flooding.. Now the water comes
in only in severe rainstorms. The water from the back and in between the
houses drains under his basement and out the pipe to the sewer. Most of
the water is not on his land because it drains through his basement. His
neighbor has in now on his land, but it does not flood his basement. Chair-
man Seifert asked if the residents had any suggestions. The Planning
Director previously suggested building a berm to hold the water back.
Chairman Seifert explained the water run-off on the ,lot. He said that there.
is a large area of land behind Mr. Curry's 'house that naturally pitches
towards the subdivision. Because of this, the water sheds towards them:
It was suggested to fill in the area where there is a pocket, but trees,
shrubs, ect. would be lost. Mr. Curry said that the depth of the water in
the pocket is over 1 foot. Al Paglia said he was out to the site last
Wednesday with the Planning Director. They walked out to the area which
Mr. Curry claims is full of water, and the grass was just wet. If the ground
was frozen, then maybe there would be water. Al Paglia pointed out that in
June, there was 11 inches of rain, which is a record rainfall. Margot
Jellinek said that the Conse:vat:ion Commission was going to hold a wetlands
hearing, but the Department of Engineering crossed it out; therefore, the
land was not put in a wetland area. The outcome of this discussion is that
all members will go out and see the site for themselves and talk with the
Planning Director, Board of Health Agent, and Bertram Cook if they have any
questions.

8. Meadow Lane Road Completion - Gary Woolman
Mr. Gary Woolman appeared before the board, speaking on behalf of all
the home owners in the area. They are asking for the completion of
Meadow Lane at this time. He said the street is 100 percent complete
up to the bonded area. There are four lots not under the bond. These
lots can't be sold because there is no bond on them. They would like
to have the berm, sidewalks, ect. installed so that they may complete
their landscaping. There are.no street lights. On "several occasions:
there has been a drinking problem, which -creates alot of `broken glass.
There is no fire box. There are five families presently living on
Meadow Lane, and there are six children. A recent need for an ambulance
was delayed because they didn't know the location of Meadow Lane. There
is no street sign. They have contacted Paul Folkman. At this time,
Mr. Willis has no intention of completing Meadow Lane. Mr. Willis, the
developer, has not put up anything in the last two years. With the bond
that the Planning Board is retaining, at this time, the residents would
like to have the street completed by November 1, 1982.
Motion: To invite Mr. Willis in to the next Planning
Board meeting.
(Parsons - Kaufman, all in favor) VOTED
9. Variance - Kathy and LarryCooper - John.Street
Mr. and Mrs. Cooper appeared before the board to. request a variance to
divide a parcel of land owned by Catherine.N. Falotico at 12 John Street
into two separate lots. Lot 1 containing 10,700, sq. ft. with an exist-
ing dwelling thereon, and Lot 2 having frontage of 73 feet and contain-
ing 7,300 sq. ft. which are non -conforming in a Residence_A Zone. The
would like to erect a'single family home on the 7,300 sq. ft. lot. They
are planning to hook-up to town sewer by an easement through their neigh-
bor's land.
Motion: To recommend against the variance to establish a lot in
a Res. A Zone which is less than 1/2 the required size,
as it is totally against what we, as a Planning Board,
are trying to achieve.
(Parsons
Mr. Cooper pointed out that on John Street, there are about three other
lots that are smaller than the 7,300 sq. ft. which they have.
Motion: To send a favorable recommendation to the Zoning Board
of Appeals.
(DeGirolamo - Genatossio) In Favor - Brugliera VOTED
Opposed - Parsons and Kaufman
10. Variance - Apple Tree Diner - Warren Jones
The reason this variance is being applied for is that Warren Jones would
like to remove a single family dwelling at 292 Chauncy Street, from a
parcel of land owned by Louis Andrews, and to erect a new structure to
be used as a restaurant. The applicant feels that because of the
Relocated Route 140, the area is better suitable for commercial type
uses. A brief summary of the discussion which was held last week was
reviewed for absent members.

11. Bonwood Corporation"- Fairfield
Ronald Bonvie appeared before the board and said that the plans will
not be officially submitted until tomorrow. He informed the board
that the Bonwood Corp. hired a new architect, Warren Daniels. Warren
has been informed of the problems with the plan and the background
information. Warren Daniels presented"the board with a handout which
addressed items listed in the Special Permit Decision. These items
were: Gravel base, binder course, and final course of asphalt; cobble-
stone specifications; catchbasin details; "landscaping, fencing; light-
ing, and rubbish and disposal area. He went through the handout with
the board and explained what material will be used for each item. He
presented the board with a plan. Some things have been changed. The
dumpsters have been moved. They will be fenced off across from the
parking lot, and the type of lighting has been changed, and the apart-
ments have changed. Planner Parsons asked about his work history.
Warren Daniels said he has been in the business for eight years, and
he has worked for three different firms. He has worked on alot of
housing and rehabilitation projects -such as, Charlestown navy yard,
Hope Gardens, and Quincy Market.
12. Around the Table
Planner Genatossio asked if the property that Leon Grant plans to
build on is+in an approved subdivision. If so, does the ,plan need
to be modified. There was some discussion by the members.. Planner
Parsons said he doesn't think it needs to be modified. It was the
concensus of the board to have the Planning Director check on it.
