Planning Director informed the board that he asked Peter O'Brien to
submit an extension until May 19, 1982, which he did; therefore,
the board needs to accept the extension. He talked with several
people on the telephone, and he could not find anyone who new about
the five years which Margot Jellinek mentioned at the previous meet-
ing. He looked through the General Laws and checked out the informa-
tion which Peter O'Brien stated in his letter. At this point; the
Planning Director read a section from the General Laws. The Planning
Director asked Peter O'Brien to obtain certification from the State
Forestry regarding their participation in the past, and their par-
ticipating in the proposed new plan. It is the Planning Director's
opinion that there are two uses: (1) Harvesting of timber/wood and
(2) Harvesting of a crop on a yearly basis.

extension until May 19, 1982.

8. Site Plan - Newport Creamery
Peter Rector, President of Newport Creamery, appeared before the board.
Kenneth Larsen, owner of the property that Newport Creamery wants to build
on, and Brad Tyed, who handles Chauncy Place as a broker for Ken, accompanied
Peter Rector. Peter said that their main office is located in Middleton,
Rhode Island, and they are interested in putting a Newport Creamery in
Mansfield. Planning Director informed the board that he had reviewed the
site plan, and modifications have already been made. He went throught the
staff's comments. The drainage calculations were shown. The drainage and
the parking analysis are intertwined with Chauncy Place. Chauncy Place has
been moved slightly to the right.
Newport Creamery has 31 stores. It is a family style restaurant, similar'
to Friendly's: Peter Rector presented the board with pictures of the inside
and outside of Newport Creamery. He also presented the board with sample
menus, i.e. regular, children's, and breakfast. He also passed out a
brochure on the history of Newport Creamery. The restaurant's hours are
7 A.M. to 11 P.M. seven days a week. The restaurant will be constructed
of concrete blocks, and it will seat 76 people. The total number of
employees will be 60 to 70, and the largest operating shift will consist
of 8 to 10 people.
At this point, Ken Larsen presented the board with a complete set of
blueprints. The board reviewed the elevation plan. There was some dis-
cussion regarding the lighting. Peter Rector said there is lighting
underneath the canopy. There will also be lighting in the back and on
the side. All lighting will be shone into the parking lot. Ralph
Maloon further explained the drainage at this point. Chairman Seifert
said he would like to see more lighting for the parking lot, and
Planner Brugliera said he would like to see the entrance light.
Motion: To approve the site plan for Newport Creamery provided
that additional lighting is added.
(Brugliera - Genatossio, all in favor) VOTED
Motion: To approve the amended site plan for Chauncy Place.

John Piters - Site Plan - Wood Avenue
The Planning Director informed the board that he met with John Piters
and staff members on Tuesday to work out comments which the staff made
previously, i.e. water, sewer, and drainage problems. He said he talked
with Charlie Mulcahy regarding the roadway. The research shows that it
is not an accepted street, and it is not a private way but a public way.
Planning Director informed the board that Charlie Mulcahy asked him to
ask the Planning Board to write him a letter regarding the research of
the status of the road. One of the outcomes of the meeting held Tuesday
is that Ken Larsen and John Piters reached an agreement on sharing the
costs.
Motion: To write a letter to Charlie Mulcahy asking for the criteria
of Wood Avenue.

and the information which Charlie sends back to the Planning Board.

Robert Bogdanchik of Canton requests a variance to divide a parcel
of land owned by Walter Bogdanchik at 1620 West Street into two
separate lots. One lot to be conforming, and the second the have
60 feet frontage on West Street. He proposes to build a singe -family
dwelling there. (attached map of land owned) Planning Director
said he would like to have his frontage on West Street. If a future
road is put in, he would then switch his frontage to the new road.
Motion: To recommend to the Zoning Board of Appeals that the
variance not be granted because it derogates from the
intent of the Zoning By-law, and the proposed plan
suggests a future subdivision which should be judged in
accordance with the subdivision regulations.
(Parsons - Flynn, all in favor) VOTED

William Miller requests a variance to construct an addition to his
home at 101 School Street with a 13 foot sideyard measurement and

Board of Appeals.

13. Around the Table
Planner Flynn asked if any board member knew someone who builds
solar greenhouses. Chairman Seifert said he could get some
information. Planner Genatossio pointed out that the newsletter
was very interesting, and read a few articles to the board. These
articles were regarding variances. She also informed the board of
a case she found in Chapter 41A. In reference to the discussion
which took place at last week's meeting regarding the Downtown
Advisory Committee, the Planning Director informed the board that
he is the person who prepares the town's grants. He recommended
to the Board of Selectmen that the Downtown Advisory Committee

be the designated overseeing body on the Block Grant. He said he
could report more on what the Downtown Advisory Committee is doing.
He then explained that Robert Mangiaratti and Ronald Montaquila
were up for re -appointment in 1981. Ed Tartufo and Rod Stearns
are up for re -appointment in 1982. He explained that these two
people were not officially re -appointed. Therefore, after the
add appears in the paper, the three re -appointments will be taken
care of this year. The length of the term will be taken from
the year they were suppose to be re -appointed. Whoever fills the
vacant position left by Robert Mangiaratti's resignation, their
term will begin from 1981. The Planning Director also said he would
provide the Planning Board with the Downtown Advisory Committee's
agenda and summary minutes from each meeting.
Planner Parsons informed the board that the Downtown Advisory Committee
had an open house Monday evening, and the displays were terrific.
Chairman Seifert suggested putting it on the agenda so the board
may see them. Planner Parsons said that Everett Associates photo-
graphed all the buildings on Main Street and identified each build-
ing's good and not so good points. They also presented ways to
improve the buildings. Two people are interested in Everett Associates'
improvement designs. Everett Associates also presented information on
the right-of-way from East Street to the center of town. There has
been two neighborhood meetings regarding the right-of-way. The design
is ready to go to the Selectmen.
