updating was appropriated at the Town Meeting held Tuesday. The Town
Meeting was dismissed due to the lack of a quorum. *Motion on last page.
7. At 7:45 P.M. the Planning Board adjourned to go to the Selectmen's
meeting. The Planning Director was meeting with the Selectmen regard-
ing Fairfield Park/Park Court-. He gave a brief summary of the history
of the Fairfield Optical site. Then he addressed the neighbors' let-
ter regarding this proposed project. In this letter the neighbors
expressed four main concerns. These concerns are density, parking,
drainage, and maintenance. The Planning Director explained each item
individually. Many questions were asked.
Motion: To transfer the land from the Town to the Housing Authority.

** During the time the board was meeting with the Selectmen, Donald
Kaufman left, and Kenneth Parsons entered.

Peter O'Brien - Surplus Material Permit - Maple Street
Peter O'Brien left a letter requesting an extension of one week with
the Planning Board. The board also received a letter which outlines
why the Zola family qualifies as a Agricultural use. Evidence/Documents
were submitted from 1979 on.
Motion: To grant the extension request for one week.
(Parsons - DeGirolamo WITHDRAWN.
Chairman Seifert said that he spoke with Peter O'Brien who said he would
request addition time if needed. Planner Genatossio said she feels
the extension request should be for at least two weeks. At this
point, Peter O'Brien changed his written request from one week to a
two week extension.

9. Dr. Massand's Office Building - Wood Avenue
Ralph Maloon and John Piters, builder for Dr. Massand, appeared before
the Planning Board to explain the proposed addition. The size of the
proposed addition is 73' X 22'. Ralph Maloon said that they are pro-
posing 24 parking spaces, and the requirement is 19. He said that
they might loose two spaces; therefore, they will have 22 spaces. They
will put up a stockade fence as required, and basically the area around
the addition would consist of wood chips and landscaping. There are
two basins on the site with a drain line between them. Leon Grant, as
part of the sale of the property to Dr. Massand, is suppose._to bring
sewer onto the site. They are proposing to pave 30 feet beyond the
entrance/exit. At this point, the Planning Director read the staff
comments regarding this proposed addition. He said that he met with
Ralph and John earlier in the week to discuss the parking/circulation,
but because the comments from the staff came in today, he has not dis-
cussed some of them with John and Ralph. He recommended that the board
wait another week until the comments/problems can be resolved.
Motion: To request an extension of two weeks.
(Flynn - Genatossio, all in favor) VOTED
John Piters presented the board with a written extension of two weeks.
10. Around the Table
Planner Genatossio, in reference to the Zola property, said she thinks
the board should obtain elevations and grading plans for this property
since it is in a Water Protection District. She also mentioned putting
controls on the restoration. Planner Parsons said that the board could
do that, but the decision now is to determine if the property is Agri-
culturally exempt.
Planner Genatossio also asked if the Downtown Advisory Committee is
a board of its own or an advisory board to the Planning Board. Planner
Parsons said it was established in 1978-79 as an advisory board to
the Planning Board. Planner Genatossio pointed out that the Downtown
Advisory Committee has never come before the Planning Board for as
long as she has been on the board. Specifically, the Block Grant was
drawn up for the DAC. They had more imput than the Planning Board did.
Planner Genatossio questioned the statement that the Bonwood Corp. did
not have to come for a special permit, but they were pushed into it.
Chairman Seifert said apparently they did not qualify. They could have
developed the Carlson land separately from the Lombardi property.
Planner Flynn asked how the board was going to decide if the Zola family
is exempt. Chairman Seifert said by looking through all the information
which was provided. There was some discussion by the members regarding
researching the agricultural exempt status and checking the legal writing
which Peter O'Brien used in his letter.
Motion: To have the Planning Director research the agriculturally exempt
status and net back to the board next week so the board may make
a decision.
(Flynn - DeGirolamo In favor - Genatossio, Brugliera,
Opposed - Parsons

Planner Parsons said he thinks the board should consult with Town Counsel.
Chairman Seifert said he feels the board should make a decision themselves
and then consult Town Counsel.
11. Date of Next Meeting is April 28, 1982 at 7:30 P.M.
12. Public Discussion
Margo Jellinek, in reference to determining if the Zola property is
agriculturally exempt, said it has to be proven that the property has
been used as an agricultural/horticultural use for the past five years,
i.e cutting, planting, and selling. She told the board to call Lake-
ville. Again she pointed out that there is a certain amount of years
that the property has to be used as agricultural, and she believes it
is five.
Ernest Cowen said that the proposed operation by the Zola family is not
compatible with the residential neighborhood. He said the operator,
Davis, shows evidence as a wood cutter, and areas have already been
cleared, but that does not constitute forestry. He said that the only
person who has been growing trees is Mother Nature. He said that
160,000 yards of material is a gross misinterpretation in his opinion.
Also he and the neighbors are very concerned, and the board will
probably here more from them.
