Clerk DeGirolamo read the letter from Peter O'Brien to Bertram Cook. In this letter it requests that ap- proximately 160,000 yards of material be removed. Enclosed with this letter was a plan drawn by RIM, a report from the Soil Conservation Service, and correspondence from United Methane. Peter O'Brien in- formed the board that the property consists of 58 acres located off Maple Street, and it is zoned Agricultural. It has been used for the harvesting of trees for the past few years. He said that approximately 20 percent of the timber is still standing, and the Zola family would like to remove all the timber and plant poplar trees. In order to do this, the land would have to be leveled and all rocks would have to be removed. The Planning Director siad he felt the board should iden- tify the legal issue, determining if an Agricultural use has been con- ducted, before the board gets into the technical aspects. Peter O'Brien said the board would have the additional evidence necessary to determine if an Agricultural use has been conducted for their next meeting. It was the concensus of the board to wait until this evidence is submitted. Master Plan Donald Kaufman explained what had happened at the March 31st meeting regarding the master plan. At that meeting, the Planning Director suggested that the board withdraw the article if there was no money available. The concensus of the board was to support the article even if there was no money available. The Planning Director said that if the master plan is updated, the Conservation Commissionican receive up to 80 percent reimbursement for conservation uses. He also gave various other reasons why the master plan needs to be updated. He said that the present zoning map doesn't show Route 495 or Route 140. The board suggested that the Planning Director prepare a list of needs for the master plan for Tuesday. 9. Around the Table Planner Kaufman said that sometimes someone will come in and present something to the board, and the board will vote on it; then they apply for a permit for something else. Planning Board's minutes April 14, 1982 Page 5 Planner Genatossio asked about Peter Fontanini's pond. Planning Director said that three pieces of information had to be added to the final as -built plan. He said that Otto from RIM took the mylar and has not returned it yet. Motion: To send a letter to Peter Fontanini (Genatossio - DeGirolamo, all in favor) VOTED Planner Genatossio asked about the East Street earth removal - Fish and Game. He said that he feels the shooting range is going as planned. Planner Parsons expressed his appreciation to Donald Kaufman for being Chairman for the past year. The board also thanked him, and they wished Mitchel Seifert good luck. Planning Director said that the meeting with the Board of Selectmen regarding the Block Grant is to hear any comments from citizens, boards, or committees on what types of projects/proposals should be in the grant application. He said that the preliminary appli- cation is due May 3, 1982. He explained that the town is going for both aspects of the grant. He said that they are expecting about 100 applications, and they have the capability to fund 20 communities. He also said that Joanne Colella and he will be before the Selectmen at 9 P.M. regarding Fairfield Park/Park Court. 10. Date of Next Meeting is April 21, 1982 at 7:30 P.M. 11. Public Discussion Margo Jellinek asked the Planning Director how far above the water level the trees were planted by Lundgren and Rezza. Planning Director said Rezza planted his trees 5 to 6 feet above the water level, and Lundgren planted their trees 9 feet above the water level. He pointed out that the water level might be higher towards the pond. Margo Jellinek pointed out that the Zola family's land is located in a recharge area. She said she just wanted to make it clear that the Zola family may not need to plant their poplar trees at 4 to 5 feet above the water level. 12. Meeting adjourned at 8:50 P.M. CL RK AE
