Paul Boyden said there has been test borings done on the property. The -Town owns the property to the rear. The lot size is approximately 31,960. Kenneth DiNisco presented the proposed apartment building design. On the plan he presented, the buildings were more detailed and colored. The proposed apartment building design was put next to the proposed townhouse design to compare the compatibility. On the apartment design there was a balcony which connected the two apartments. The open space under the balcony is approximately 20 X 24. The apartment buildings would be set back 8 to 10 feet from the property line. There would also be a sidewalk. The proposed apartment building would be 3'Z stories. Planner Flynn said that the design looks much better. Planning Director then went through the Camp, Dresser & McKee letter. He said that there are three main points: (1) They recommend not tying in any drainage into the 24" line. (2) All leaching basins shoul'd be tied together. (3) Downstream drainage ditch needs to be redesigned for a 25 -,year storm. Planning Director said that Mr. Maloon has complied with all of these requests. *Planner Flynn left the meeting. 10. Subdivision Fees Planning Director said that for the board to implement the fee schedule, there needs to be a vote. This vote/motion would have to be sent to the land Court, the Registry of Deeds, and the Town Clerk. B. L. Makepeace Quote Planning Director explained that $150 needs to be taken out of the consultant account for the reduction of the base map. This reduction would be from 1" to 400 feet to 1" to 600 feet. After this reduction occurs, the base map may be sent to SRPEDD. Motion: To take $150 out of the consultant account (Parsons - Seifert, all in favor) VOTED 12. Charlie Mulcahy's letter - Henley -Lundgren In this letter Charlie Mulcahy states that it is his opinion=that the Town of Mansfield can accept the reduced bond. hie stages in his letter that if a third party were to enter upon the land and use, it in such a fashion that the seedlings were destroyed or the grass died, it would be incumbent upon the town to show that it was done through the negligence of the Henley -Lundgren Company in order for the bonding company to step in and award any damages. 'Clerk Seifert said he feels it should not be the Town's responsibility to prove negligence. He feels that this sentance which states that the Henley -Lundgren Company disclaims liability for any detrimental effects to the area, shouldberemoved.
