Also Planner Flynn pointed out that in the minutes of January 6, 1982, on Page 4, Item No. 7, Home Developers should be Henley -Lundgren. Planner Flynn asked if the board could geta subscription to the Land Use Manager which came from the Massachusetts Executive Office of Communities and Development. She also pointed out that the board members should have copies of the pages which are to be inserted in the Planning Handbook. *Planning Director entered the meeting. When the Planning Director entered the meeting, he informed the board that Whitman & Howard and the Industrial Development Committee had cancelled so ':they would not be appearing before the board. 5. Industrial Rezoning Mrs. Jellinek asked the board how many acres of land Frank Allen owned. In reference to the comment which was made previously that Frank Allen had money invested in the land because he had already cut in a road, she pointed out that the road was cut in vears ago. She said that this land, which is owned by Frank Allen, has always been referred to as the rubber dump because quite a bit of rubber was dumped on this property. She pointed out that Frank Allen did not dump the rubber. She said that some of the rubber had been removed, but she thought the board would like to go out to the site to see just how much has been removed. The Planning Director showed the board the maps which outlined the proposed rezoning from Industrial to Agricultural. On this map the existing industrial uses where outlined in a different color. Paul explained to the board that a Mr. Wolf, who owns Parcels 13 & 10, had spoke with him regarding the rezoning. Mr. Wolf is the General Manager of Peggy Lawton Kitchens, He explained to Paul that he and his sister had bought the industrial land in anticipation that they would relocated their plant, Which is presently located in E. Walpole, Planning Board's minutes January 27, 1982 Page 3 in Mansfield in the next three to five ,years depending on the growth of the company. Paul informed the board that Mr. Wolf has spoken with Ralph Seifert. Planner Genatossio asked if a binder could be put on the land so that if the board decided to leave Mr. Wolf's property in Industrial and Mr. Wolf then sold the property, it would be automatically transferred to Agricultural. Planning Director said no. Planner Parsons pointed out that the key to the discussion is whether the board can soot zone or not. There was some discussion about Frank Allen's property. Paul explained to the board that Mr. Allen's concerniswhat; the board is going to rezone the land to. He pointed out that the sewer interceptor will be coming through in about 2 to 22 years. Mr. Allen is interested in Cluster Zoning. Granada Park Subdivision - Mr. Schmidt and Mr. Curry Mr. Curry and Mr. Schmidt appeared before the board to explain Mr. Curry's drainage problem. Mr. Curry told the board that he had 8 inches of water in his cellar, and the Fire Department came to his house and put in a 3 inch in diameter fire hose to drain it. Mr. Curry pointed out that the hose could not keep up with the incoming water. Paul said that the Building Inspector, Bert Cook, went through the files to check the elevations. He found that the foundation was pro- perly located. Therefore, there may be a surface water problem or something wrong with the grading in the rear of the lot or the area around the foundation. After Bert knew that the foundation was pro- perly located, he allowed Mr. Paglia to out in a pipe that went to the foundation of the house to pick up the drainage. Paul said that he was out at the site when the pipe was going in. Mr. Curry said that Mr. Paglia was going to put a manhole to the right of his house to pick up the water, but he was turned down by the town. The reason he was not allowed to put in a.-manhole was because the manhole would pick up leaves, ect. and eventually work into the town drainage. In the spring paul will monitor the drainage with the neighbor to see if there is a surface water run-off problem. 7, Industrial Development It was the concensus of the board to zone all the land to Agricultural and amend it later if necessary. Motion: To accept the article as proposed for the Town Meeting. (Parsons - Flynn, all in favor) VOTED 8. Master Plan Motion: To accept the master plan article as proposed for the Town Meeting. (Parsons - Brugliera,,all in favor) VOTED Water Supply Protection Districts Motion: To accept the Water Supply Protection District amendments. (Parsons - withdrawn There was some discussion by the board regarding what is in the By-law now versus what is proposed. It was pointed out that the map which is in effect which was prepared by SRPEDD encumpasses more land due to the method they used to calculate the protection district. In reference to Paul's letter to Whitman & Howard regarding the shape of the cone of depression and the recharge area, Chairman Kaufman said that he would Planning Board's minutes January 27, 1982 Page 4 to see them drawn on the map as they appear and not as circles. It was the concensus of the board to leave what is presently in the By-law and not accept the proposed amendments until their is more communication between Whitman & Howard and the board to clear up some areas. 10. Parking By-law Amendments Motion: To approve the article on parking as written (Brugliera - Parsons, all in favor) VOTED Planner Parsons said that he thought the size of the regular park- ing space was small. Planning Director then referenced the book which he used to come up with the regular size parking space size. After hearing the reference from the book, it was decided to leave the regular parking space size as is. 11. Subdivision Fee Public Hearing - February 3, 1982 Planning Director said that the hearing notice appeared in the paper for two weeks, and he showed the board the notice which appeared in the paper and the original which was sent to the paper. 12. Master Pl.an Planning Director said that when he gets estimates back from the Makepeace Company on reproduction and reduction/enlargement costs, the board could then start the mapping work with SRPEDD working on updating the base map. 13. Around the Table Planner Genatossio asked about Peter Fontanini's pond. Planning Director said that he and Bert went over the as -built, and it looked fine. It was suggested to put it on the agenda for next week with a memorandum from the Planning Director and the Building Inspector reviewing final as -built. Planning Director reminded the board of the Cabot, Cabot & Forbes' dinner which is February 2, 1982 at 5:30 P.M. Planner Brugliera said that he feels that alot of time is spent on Zoning Board of Appeals' applications, and the board's recommendations usually don't influence their decision. He felt that the board should stop making recommendations. Planner Parsons said that it is a re- quirement for the board to make recommendations, and he felt the board should continue making recommendations, because if they were in favor or opposed strongly to a variance, they might want to appear before the Zoning Board of Appeals. Planning Director asked if everyone who wanted a set of the Fairfield Park plans had received them. Planner Flynn said that she would like to walk the site. Planner Genatossio asked if there was a fence pro- posed along the walkway. Planning Director said he believed not. Planner Parsons said that by following the key that indicates dumpsters, there are dumpsters all over the site in open view. Planning Director said that there are only four or five dumpsters proposed. There was Planning Board's minutes January 27, 1982 page 5 some discussion on Home Developers' special permit decision regard- ing the surprise ending. Planning Director said there needs to be an indication on which way the majority of the board is leaning, whether it be in favor or against, and then he could begin drafting the special permit. Planner Flynn said she would like to have the board go over the plans a few more times. Planner Genatossio said that she would like to have an engineer review the site to check the water, sewer, and drainage calculations. Also to check the affect the site would have on the Back Bay Brook. Motion: To send a letter to the Board of Selectmen requesting funds to hire a Civil Engineer regarding the Fairfield Site. (Genatossio - Brugliera - Withdrawn Planner DeGirolamo pointed out that the board should explain exactly what they would like reviewed to the Board of Selectmen and to obtain estimates from engineering companies. .Planning Director said he would have estimates for next week. The specific areas which the board would like to have checked are utilities generally, drainage calculations, piping system, and the affect on the Back Bay Brook. 14.
