The Planning Board reviewed these plans along with the approval letter and found that all the comments were incorporated on the plan with the exception of the poorly drained soils and the water easement ,(which was delineated as a drainage easement) between lots 6 and 7. The Board would like these comments placed on the plans. Motion: To sign ,the "Green Acres" Subdivision Plan subject to the above comments being delineated on the plan. Planning Board's Minutes December 17,;1985 Page 2 4 5. Review "Shiloh Estates" Preliminary Subdivision Plan Acting Clerk Flynn read the comments from the various department heads. The majority of the comments which were received from the Department of Public Works would be incorporated on the definitive stage of the plan and, therefore, were not pertinent to the preliminary plan approval. The Planning Director had a comment on waiving a portion of the sidewalk in this subdivision in exchange for sidewalks on Essex Street. Planner Gena- tossio stated that there were no 'sidewalks on Essex Street and she feels that it is really not necessary because it will only be for a small section of Essex Street if the Board does require the sidewalk.Planning Director Callinan stated that this recommendation' would really be taken up at the definitive stage;; he also stated that the flood plain was not delineated on the plans. The applicant then submitted a revised plan which stated that this site does not fall within the 100 -year flood zone. Acting; Clerk Flynn stated that the checklist for this subdivision is now complete. Motion: To approve the preliminary subdivision plan for "Shiloh Estates". Planning ,Board Minutes Executive Session Minutes of November 6., 1985 Motion: To approve the 'Executive Session Minutes of November i6, 1985, as amended. (Flynn'- Fiore All in favor); Planner Flynn stated that on the second ,page of these minutes the sentence ( "Attorney Gelerman stated that he will ask them that question when they are under deposition" was repeated twice. She would like t_i;e second sentence deleted from the minutes entirely. Planning Board Minutes December 30,'1985 Page 3 Minutes of December 11, 1985 Motion: To approve the Minutes of December 11, 1985, as amended. (Flynn - Bachman - All in favor) Planner Flynn stated that on Page 2, under the discussion of "Cluster Development" - it'states 'that "Planner Flynn stated that she did not like the terminology of calling this a 'Planned Residential Development"', she would like this changed to Cluster Development. Planner Flynn also stated that after she had left this meeting, the Board discussed the "Camelot at Mansfield" subdivision and she would like to know if Mr. Broderick had come into the 'meeting, to give the Board an over- all view of what is going on in this project because it was not in the minutes. ±Chairman Brugliera stated that Mr. Broderick 'did not come in to explain this whole plan to the Board. Planner Genatossio stated that on Page 3, under the discussion .of "Cluster Development" - it stated that the motion is "To have Edward Broderick bring this article to the Annual Town Meeting and to have the Board work with Mr. Broderick on this article." She stated that she thought the motion was also supposed to read that the Planning Director was to work with Edward Broderick on this article. Chairman Brugliera stated that the 'Board did not make that stipulation part of this motion because they felt that the Planning Director had too much work to do without getting involved in the "Cluster Development" provision. Acting Clerk Genatossio stated that she misunderstood the motion. Minutes of December 17,1985 Motion: To approve the Minutes of December 17, 1985, as amended. (Flynn - Fiore All in favor) Planner Genatossio stated that on Page 2 under "Around the Table" while discussing the withdrawal of plans, there are two ideas combined in the same paragraph and she would like this section deleted from the minutes entirely.'; 5. 8:00 P.M. - Armando Giovino - Bicentennial Court Armando Giovino approached the Planning Board and stated that he has two (2) lots on the corner of Pratt Street and Bicentennial Court and he would like the Board's assurance that these lots will still be available to 'build on should an amendment for the 60,000 square foot lots pass at the next Town Meeting. These lots were split up when the subdivision of Bicentennial Court was put in, and Mr. Giovino was assured by, the Planning Board at the time of approval that he would have no problems with these lots. The Board stated that these lots may have been a',part of the original subdivision plan and if they were, they will be protected. 'If they were not part of the original subdivision plan, then Mr. Giovino will have to "Form A" these lots to protect them. The Board would like the Planning Director to review the "Bicentennial Court" subdivision plan and contact Mr. Giovino at 339-7333 as to what exactly has to be done to protect these lots. 6. A new member of the Planning Board, Doug Annino, was present at this meeting and the Board decided to let him sit at the table and discuss matters with Planning Board's Minutes December 30, 1985 Page 4 the Board; this evening. Motion: To have Doug Annino, new Planning Board member, sit with the Board to discuss matters this evening although his term does not officially start until January 1, 1986. (Boldrighini - Flynn - All in favor) Motion: To send a letter to Ronald Doucette thanking him for his time spent on the Planning Board and especially thanking him for the extra time he spent on the 'Subdivision Regulations review. (Fiore - Flynn - All in 'favor) 6. "Forest Park" Discussion l- Gravel Pit Restoration Edward Broderick,,' applicant, brought in a plan to the Planning ,Board of his "Forest Park" preliminary subdivision plan on a 100 'scale so that the Board can see more clearly the area of the road layout and the gravel pit which Mr. Broderick would like to restore. He stated that there are three (3) notablefeatures on this site which are: 1. drainage system; 2. road cuts; and 3. the movement of gravel from one spot on the site to another spot on the site. He stated that there are two (2) main entrance points to this subdivision, Gilbert Street and West Street. This plan) highlighted the drainage of this subdivision. He is proposing to take: a portion of the wetlands and create a clear -water pond and also create a wildlife pond in another section of this subdivision; he stated that no material will be leaving the site, it will be moved from one pond to another. He stated that the cuts in the; roadway, are as minimal, as possible.; Chairman Brugliera asked Mr. Broderick what the depth of the clear -water pond would be. Mr. Broderick stated that it will be ten to sixteen feet deep and he would like to hire Lycott to work with him on the development of these ponds. Planner Flynn and Acting Clerk Genatossio stated that the Zoning Bylaw specifically states that no new ponds are allowed in the 'Town of Mansfield regardless of whether material will be leaving the site, however, pond restoration is allowed under the Zoning Bylaw. Mr. Broderick disagreed with this interpretation and felt that pond creation is allowed as long as no material leaves the site, he stated that the Board had received a letter from Town Counsel stating this fact which pertained to another project. Mr. Broderick requested that the Board ask an opinion of Town Counsel on this matter. Motion: To send a letter to Town Counsel requesting information pertaining to new pond development on this site. (Boldrighini - Fiore - Brugliera) (Flynn - Genatossio - Bachman opposed) FAILS Planner Bachman stated that the Board should get a written letter from Mr. Broderick on exactly'; what he: plans to do on this site and then the Board should get an opinion from Town Counsel at that time if the Board should decide it :is necessary. Planner Boldrighini did not feel this was necessary, since the opinion should be a';general 'one and not specifically for only this development. Planner Flynn disagreed because she did not feel Town Counsel's opinion was needed since no new ponds are allowed in the Town according to the Zoning Bylaw. Motion: To have Edward Broderick send a letter to the 'Board stating his exact intentions on this site and upon receipt of this letter, it should be forwarded' directly to Town Counsel for his opinion. (Boldrighini — Fiore -`Brugliera) i(Genatossio - :Flynn - Bachman opposed) .:FAILS Planning Board's Minutes December 30, 1985 Page 5.' Planner Bachman stated that after the Board receives this letter from Mr. Broderick, they should then vote on it to be forwarded to Town Counsel, this letter should not be forwarded to Town Counsel directly without fur- ther discussion of the Board. Acting Clerk Genatossio had a concern about the length of the roadways in this subdivision and whether or not it was allowed; she feels that more roads may be needed because as this subdivision is at the present time, it is like a big loop and it is not very good from a safety point of view. Planning Director Callinan stated that the Board may want to phase this subdivision so that there will not be a problem with safety and the Board also has the option of having road covenants placed on this subdivision for; the contruction of the road so that there will be a way in and out of the subdivision at all times. Chairman Brugliera inquired as to if this would be a cluster development. Mr. Broderick stated that right now he is proceeding with the development for a conventional subdivision because he does not have the time to wait until a cluster development provision is 'passed at the Town Meeting. Acting Clerk Genatossio asked Mr. 'Broderick if this was a submitted plan because the Board originally denied it. Mr. Broderick stated that it was still a denied plan, but he had sent a letter to the Board stating that S all the items for denial were on the plan when originally submitted and, therefore, he would like the Board to reconsider their original vote. He stated that if he did resubmit a preliminary plan for this project, it would be the exact same plan that the Board had in front of them when they denied it originally. Motion: To reconsider the Planning Board's original vote on the: "Forest Park" preliminary subdivision plan. (Fiore - Boldrighini - All in favor) Acting Clerk Genatossio read the checklist on the "Forest Park" preliminary plan which was done by the Planning Director and everything was complete. Chairman Brugliera stated that if the Board is going to reconsider this sub- division plan, there should be a time limit set on it and it should also be reviewed by the new Town Engineer who is expected to start on January 6,' 1986. Several Board members felt that the plan could not be approved be- cause there are two (2) pond areas shown on it and pond areas are not allowed in the Town of Mansfield according to the Zoning Bylaw. 'Planner' Fiore stated that he, too, does not believe the plan can be approved, but the Board should not just deny the plan if there are other things of value that can be added to it. Motion: To extend the period of time to act on this subdivision plan for '30 days in order that the Planning Board can get comments from the new Town Engineer and other de- partment heads due to the fact that there may be other items of value that can be added to the 'plan. (Boldrighini - Fiore - Genatossio - Bachman - Brugliera) (Planner Flynn was opposed to this motion) Mr. Broderick stated that there is approximately 7,000 square feet of road- way going ;through ,wetlands and he will take this plan to the Conservation Commission in January and that the average size of the lots is one acre. Motion: To send a letter to Judith Scott, Town Clerk, informing her that the Board has reconsider their vote on the "Forest Park" subdivision and that an 'extension of 30 days has been granted. (Flynn - Genatossio - All in favor) Planning Board's Minutes December 30, 1985 Page 5 7. "Massapoag Estates" retention basins Chairman Brugliera informed Paul Folkman, applicant, that the reason that this plan was denied was because the deadline was expiring and another ex- tension request was not received by the applicant and since there were so many changes to be made to the plan, the Board had no other choice, but to deny the plan. Paul Folkman requested that the Board reconsider their vote and stated that he has made amendments to 'r the plan which 'address all the comments stated in the denial letter. He stated that it was just an over- sight on his part to allow the deadline date to expire without granting j another extension.Acting Clerk Genatossio stated that Mr. Folkman should resubmit his preliminary plan and 'then the Board can look at it. Motion: To reconsider the Planning Board's original vote on the preliminary plan for "Massapoag Estates". (Flynn - Fiore - All in favor) PASSES Planner Flynn stated that when a definitive plan is denied by the Planning Board, the applicant can redesign the plan so that it comes into conformance with the Subdivision Regulations and then the Planning Board can reconsider the; plan; she would like to know why the Board cannot take the same approach on a preliminary plan. Planning Director Callinan stated that the State Law does not specifically state that the Board can do that under a preliminary plan process. Mr. Folkman stated that he will do whatever the Board requests; if they want him to resubmit his preliminary plan, he will do so He in- formed the 'Board that they are planning on submitting their definitive plan in a few weeks. Planning Director Callinan stated that it is better for the Board to discuss this plan in a preliminary stage rather than waiting for the; plan to go to the definitive stage because they have more input at the preliminary stage;; he believes the Board can legally reconsider their original denial on this plan. Acting Clerk Genatossio still felt that Mr. Folkman should resubmit his preliminary plan and the Board should act on it from that point'. Motion: To request the developer to resubmit his preliminary plan to the Town Clerk with the changes which were requested in the denial letter. (Genatossio - Bachman) (Brugliera - Fiore - Boldrighini:- Flynn opposed) FAILS Planner Fiore stated that the Board will have the Planning Director review the plans which Mr. Folkman submitted and the Board will take this matter up at the next Planning Board meeting. Motion: To have Planning Director Callinan review the "Massapoag Estates" preliminary plan 'according to the denial letter and Mr. Folkman's letter of December 17, 1985, and the Board will take up this matter at the next Planning Board meeting. (Fiore - Flynn - Brugliera - Bachman - Boldrighini) (Genatossio opposed to this motion) PASSES 8. Discuss "Canoe River Estates" Subdivision f Planning Director Callinan stated that Mike Laughlin, representative for; Douglas King Builders, had asked to be put on the agenda at the last Board meeting which he was, but 'due to lack of a quorum, it had to be postponed to ;this week's meeting. However, Mr. Laughlin is not present at this meeting. The Planning Director has spoken with Mr. Laughlin and Mr. Laughlin Planning Board's Minutes December 30, 1985 Page 6 has requested that. the Planning Board reconsider their vote to pull the bond on this subdivision and have the work completed by the Town. Planning Director Callinan stated that he has spoken with the DPW Construction In- spector and was informed that little work has been done on this subdivision, but that during this season there is really no work that is able to be com- pleted. He stated that if the Board still does decide to call the bond on this subdivision, they should decide what procedure they want to 'follow to have the work completed by; the Town. Planner Flynn stated that she believes the Board should keep their original motion and call the performance bond on this subdivision because this work should have been completed a long time ago. Motion: To remain with the Planning Board's original vote to call the performance bond for the "Canoe River Estates" Sub- division because no matter what time of year it this subdivision has been uncompleted for three (3) years. A copy of this letter is to be sent to the Board of Select- ment, Town Counsel and the Town Manager. (Flynn -'Genatossio - All in favor) 9. Review "Indian Estates" preliminary subdivision plan The deadline on this subdivision was December 24,'1985, and there was a question from the Board as to whether they have the authority to act on it since the deadline date has already passed, Planner Flynn felt that the Board should act on this plan. Planning Director'Callinan highlighted his comments for the Planning Board. Planner Genatossio had a concern with the 'length of Algonquin Street; it appears to be 800 feet long and yet, it is still a;cul-de-sac and this is not allowed in the Subdivision 'Regula- tions. Motion: Todeny the preliminary plan for "Indian f. Estates" due to. the reasons which have not been incorporated on the plan according to the Subdivision Regulation's checklist and the comments which were made by the Planning Director and the applicant should also be notified that he should more closely adhere to the Subdivision Regulations particularly regarding street lengths.` (Flynn - Genatossio - All in favor) Acting Clerk Genatossio asked if the applicant should be made aware that the Board may require open space lots for this subdivision. The Planning Director stated that the Board should inform the of this fact at this point rather than at the definitive stage. 10. Review "Sturbridge Estates" preliminary subdivision plan' Planning Director Callinan'outlined his comments for the Planning Board.` He stated that there is no problems with the plan conforming to the Rules and Regulations, but there are detention ponds on Lots 22 and 23 and the1 ',.. Board may want to address that point. He stated that this is within a Water Supply Protection District. Motion: To deny the "Sturbridge Estates" preliminary plan due to the Planning Director's comments. (Fiore - Flynn - All in favor) Planning Board's Minutes December 30, 1985 Page 7 11. Review "Eastbrook Estates" preliminary subdivision plan Acting Clerk Genatossio read the comment from the various department heads. Bob Foley, abutter, whose property is listed on the plan as belonging to Zitoli, asked the Board if the placement of the road in; this subdivision is legal because it is right up against his property line and the appli- cant is building his road through wetlands; he was also very concerned` about the water flowing onto his property. The Board stated that this is a legal road and that as far as the applicant building his road through wetlands, he willhave to go to the Conservation Commission for, approval. Chairman'Brugliera explained to Mr. Foley that the Planning Board only approves the concept of the plan. Acting Clerk Flynn stated that the DPW's comments regarding ;this plan would not be ;pertinent until the plan goes to a'definitive stage. Planning Director informed the Board of his recommendation regarding an alternative access to this subdivision as was stated in his comments to the Board. Motion: ;To deny ;the preliminary plan for "Eastbrook Estates" based on the comments of the Planning Director, it should also be pointed out to the applicant that the Board has many concerns about the crossings of the wetlands by the 'roadways and the applicant should seriously consider rerouting of roads and should con- sider whether Lot 13 should be :on the subdivision. (Fiore - Boldrighini - All in favor) 12. Review "Echo Hills" preliminary subdivision plan Jack Taylor, applicant, approached the Planning;' Board and requested that this plan not be discussed until; next week because he was not aware that it would be brought up tonight so he does not have his engineeror his attorney with him. The Board explained to Mr. Taylor that he would have to submitfa request, in writing,; to the Board for an extension of time for the Board to act on this pian. Mr.lTaylor submitted this extension to the Board at this point. Motion: To approve the extension request for the "Echo': Hills" preliminary subdivisionplan until January 17, 1986. (Fiore - Flynn - All in favor) 13. Review "Eastleigh, Estates I" preliminary subdivision plan *Doug Annino left the Planning Board meeting at this point. Acting Clerk Genatossio read the comments from the various department heads. Planning Director Callihan suggested that an Environmental Impact Statement be done in this area due to the fact that there are so many subdivisions proposed in this area; he stated that he has spoken with SRPEDD and they can do this study. Planner Flynn asked if this study would take up some of the Town's hours which are appropriated to them. Planning Director Callinan stated that the hours would be used and,; therefore, Planner Flynn felt that it should not be done in this manner because the Town should not use up their appropriated hours; on an Impact Study for ;proposed developments. Planning Director Callinan stated that a checklist has been done on this subdivision, but it was misplaced and, therefore, he does not know whether all the technical requirements have been met. The Board noted that there were other problems with this subdivision and that the Planning Director F Planning Board's Minutes December 30,'1985 Page 8 should review this plan and list what the technical requirements are that are missing. Motion: To deny the "Eastleigh Estates '3" preliminary subdivision plan due to the lots which are fronting on Route 106, the problems with the lot ownership, the Environmental Impact Statement which should be conducted, the road layout, and any affects of the drainage system. The technical re- quirements which are not incorporated on the plan should be included in the letter. It should also be noted that the Board believes there should be open space included in this 'r subdivision. (Fiore - Genatossio — All in favor) 14. Review "Stearns Hill Estates" preliminary subdivision plan Acting Clerk Genatossio read the, comments from the various department heads. Planning Director Callinan stated that this plan had a'lot of problems because the applicants are just doing enough to get the plans submitted and that he recommendswaivers to eleviate the impact on the Town. Acting Clerk Genatossio stated that she feels there is a big safety problem with this subdivision and she feels that the Board can deny the ,plan on :that basis. She stated that in this denial letter, the Board can state that it feels there is a safety problem with the plan because there is only one access way to Stearns Avenue and the Board recommends that the applicant connect his 'road to another sub- division to provide at least one other access.
