Sign "Green Acres" Subdivision Plan and Tri -Party Letter of Agreement At the last Planning Board meeting, the Board approved the Tri -Party letter of Agreement which was received from Charlie Boutas of Home Developers. The Board' must sign the mylars for this subdivision; entitled "Green Acres", however, the Board cannot do this due to the fact that RIM Engineering has not been able to locate all of the mylars. Therefore, the Board will sign these plans once the mylars are submitted by RIM Engineering. 5. Review Performance Guarantee/Release Covenant - "Highland Avenue Extension" Subdivision The Planning Board received a release form from The Folkman Company for the "Highland Avenue Extension" Subdivision and also 'a letter from the Mansfield Co -Operative Bank 'stating 'that they are holding $129,483.82 in a construction loan account No. '0150100111 for The Folkman Company, Inc. for the purpose of construction and completion of the "Highland Avenue Extension" Subdivision. The amount which the bank is holding corresponds to the recommended performance guarantee which was approved by the Planning Board. Motion: To approve the Performance Guarantee in the amount of _$129,483.82 which is :being held by the Mansfield Co -Operative Bank for the completion and construction of the "Highland Avenue Extension" Subdivision. (Fiore-'Boldrighini - All in favor) Motion: To release the covenant for the "Highland Avenue Extension" Sub- division. '(Fiore - Boldrighini - All in favor) Planning Board's Minutes December 4, 1985 Page 4 Planner Genatossio stated ;that there was a waiver on the in side sidewalk for this -subdivision and that the applicant was required to place sidewalks on Highland Avenue, she would like to know if this was incorporated into the, performance guar- antee. She would like to 'make sure that the applicant is not backing out of this proposed sidewalk because it was part of the conditions under which the plan was approved. 'Planning Director Callinan stated that he will look into this matter. Motion: To send a letter to the Department of Public Works informing them that there was a waiver 'granted on the inside sidewalks for this subdivision subject to sidewalks being placed on Highland Avenue and, since this is an off site improvement, the Board would like the Department of Public Works to assure that this work is going to be done. (Genatossio - Fiore - All in favor) 6. Review Performance Guarantee/Release Covenant - "Chambers Court" Subdivision The Planning Board received a release form from Harrington & Matto Company, Inc. for the "Chambers Court" Subdivision and also a performance bond from Patsy Cavalieri &'Son Inc'. stating that $116,825.94 is being held for Harrington & Matto Company, Inc. for the construction and completion of the "Chambers Court" Subdivision. The amount which is being', held corresponds to the recommended performance guarantee which was approved by the Board. Motion: To approve the performance bond :in the amount of $116,825.94 which is 'being held by Patsy Cavalieri & Son Inc. for the construction and completion for the "Chambers Court" subdivi- sion. (Genatossio - Fiore - All in favor) Motion: To release the covenant for the "Chamber Court" Subdivision. (Fiore - Boldrighini - All in favor) 7. Discuss Subdivision of a Parcel of Land on Mill Street - Schurman The Planning Board received a letter from Winslow B. Schurman, Jr. stating that he is unable to attend the Planning Board meeting at this time and if there should be any questions on this subdivision plan, he would appreciate it if the Board would continue 'their discussion until the next meeting. Planning Director Callinan sent a memorandum to the Planning Board regarding this subdivision plan - this memorandum states that there seems to be no problem with this plan, but a note should be placed on the plan stating', that the Planning Board waived the frontage requirements for this plan under Section 81-R of Chapter 41 of the Massachusetts General Laws. Motion: To approve this subdivision plan for land on Mill Street subject to the above note being placed on the plan or attached to the ';plan. (Fiore - Boldrighini - All in favor) 8. Discuss Camelot at Mansfield - drainage Planning Director Callinan stated that he has spoken with Edward Broderick, applicant, and he has agreed to conform to all the comments which were made by John McMann, Consulting Engineer. He also stated that the Planning Board can approve the construction of the retention basin subject to the comments which were made by John McMann being placed on the plan. Planner Genatossio also had a concern that the Planning Board had concerns about a fence being Planning Board's Minutes December 4, 1985 Page 5 placed around this retention area and also a gravel roadway for an easement to this retention area; she also had a concern about the additional comments from ' the various department heads, she feels these, also, should be added to the plan. Planner Boldrighini asked if these comments could ;just be attached to the plan. 'Richard Callinan, Planning Director, stated that they could be attached to the plan, but Planner Genatossio felt that they should be added to the plan instead of 'having an attachment. Planner, Bachman stated that there was a lot of controversy on this plan when it was originally approved and he would like some history on the entire situation; he would also like to know if this subdivision' required another public hearing because it is going to be updated. Planner Fiore stated that the applicant would have to make his plan comply to all the comments which were received by the Planning Board on this subdivision. Planner Boldrighini asked what the status of the plan was and if the plan had to be re- designed and then resubmitted to the Board. Planning Director Callinan stated that the redesign of the retention basin 'must come from the Board before it is actually done; the redesign of this basin would be referenced to, John McManu's comments. Acting Clerk Flynn stated that she would like to see all the comments on this plan together at one-time and have Mr. Broderick make a presentation to the Board in order that everything can be addressed at that time. Mr. Broderick stated that he would like the Board to give him a week to get all the comments from the various department heads together and then address these issues before' the Board at their next meeting. Planner Genatossio asked Mr. Broderick if he has addressed the water protection and the suitable soils. Mr. Broderick stated that he had submitted a report to the Board on these two (2) matters. Planner Genatossio stated that this should be shown on the subdivision plan g` because in the future any lots which the Planning Board approves will be under € a "Form A!' plan and she believes that the poorly drained soil should be shown on. the plan so that the Board will know if these lots are buildable. Planning i. Director Callinan stated that that particular issue is under the control of the Building Inspector. Planner Genatossio stated that the Planning Board should place a comment on the plan which states that "The additional lots must conform with the 1985 Zoning By -Law regarding buildable land". Mr. Broderick had no problem with placing this note on the plan. Motion: To send -a letter to the applicant, Edward Broderick, stating that the Board voted that the following items should be placed on the subdivision plan of "Camelot Estates": ` the comments from the con- sulting engineer regarding the construction of the retention basin, a fence should be placed around the retention basin, a', gravel road which will serve as an easement should be shown on the; plan and the statement concerning the buildable lots conforming to the 1985 Zoning Regulations should also be placed on the plan. After these items have been placed on the plan, Mr. Broderick or his engineer should submit it to the Board along with a presentation. (Boldrighini - Genatossio - Brugliera,- Flynn - Fiore) (Bachman abstained from voting.) 9. Review Recommended Performance Guarantee - "Westview Woods" Subdivision The Planning Board received a memorandum from John McMann, Consulting Engineer, regarding the recommended performance guarantee for the "Westview Woods" Subdivi- sion; the total amount of this recommended performance guarantee is $167,248.62. § Motion; To approve the recommended performance 'guarantee in the amount of $167,248.62 for the "Westview Woods" Subdivision submitted' by John McMann, Consulting Engineer. (Fiore Boldrighini - All in favor) Planning Board's Minutes December 4, 1985 Page 6 The Planning Board also received a letter; from Ernest E. Fay, Vice President of the Merchants Bank of Boston, stating that they are holding $167,248.67 in a construction loan, account No. 20700715-6 for The Broderick Corporation for the purpose of construction and completion of the "Westview Woods" Subdivision. The amount corresponds to the amount approved by the Planning Board.; Motion: To approve the Performance Guarantee in the amount of $167,248.67 which is being held by the Merchants Bank of Boston for the con- struction and completion of the "Westview Woods" Subdivision. (Boldrighini - Fiore - All in favor) The Board also received airelease -form from The Broderick Corporation for the "Westview Woods" Subdivision. _.Motion: To release the covenant for the "Westview Woods" Subdivision. (Genatossio - Fiore - All in favor) 10. Review Preliminary Subdivision Plans "Hallett Crossing IV preliminary subdivision plan The Planning Board received a letter from Edward'Marcheselli, Treasurer of The Walmark Corporation, respectfully, requesting an extension of the "Hallett Crossing II" preliminary subdivision plan located off Fruit Street until January 16, 1986. Motion: To approve the request for an extension for the "Hallett Crossing lI" preliminary subdivision until January 16, 1986. (Flynn - Fiore -'All in favor) "Massapoag Estates" preliminary subdivision plan' Chairman Brugliera asked the Planning Director if there were any new comments or developments regarding this plan. Planning Director Callinan stated; that at the last Planning Board meeting, he had suggested open space lots and a secondary access to Bird Road be ,placed on this subdivision plan. He stated that the applicant was present when these statements were read, so he was aware of these facts, but he has not presented any revisions to the plan or an extension to the Board on this plan. The deadline for the Planning Board's decision on this subdivision plan is December 6, 1985, so the Board will have to make aldecision on this plan tonight.' At the last Planning Board meeting, the applicant informed the Board that he will be deleting approximately 20 lots from the rear of this subdivision and adding a few lots on the front where he has been able to acquire additional land. The Board felt that these were major changes to the plans and that the 'applicant should come in with a plan showing these revisions because it will be the same as reviewing an entirely different plan. Motion: To deny the preliminary; subdivision plan for "Massapoag Estates" based on the Board's desire to see the plan redesigned eliminating the lots in the rear of this subdivision, to possibly address the secondary access to Bird Road, to provide for ,open space accord- ing to the Mansfield Subdivision Regulations and the failure of the plan to address the particular items that are not checked off on the preliminary plan checklist. i (Genatossio - Fiore - All in favor) Planning Board's Minutes December 4, 1985 Page 7 "Balcom Ridge Estates I and II" preliminary subdivision plan Acting Clerk Flynn read the comments from the Planning Director regarding this subdivision plan. The Planning Director has cited a number of features which fail to conform to the provisions of the Zoning Bylaw and the Subdivision Rules' and Regulations. Particularly, a violation of Section IV. A. 1 of the Zoning By -Law which states that "no existing lot shall be changed as to size of shape so as to result in the violation of these requirements."Lot I on this; plan is making such a violation. Planning Director Callinan submitted a site plan to the Planning Board which was obtained from the Board of Health files. This plan was submitted in August in order to obtain a building permit, it has 120 feet of frontage along Balcom Street; a building permit was issued in October for this lot. Should this subdivision pass, the applicant will be violating the .'Zoning By -Law. The applicant should first obtain a variance from the Zoning Board of Appeals before approaching the Planning Board with this plan, but the applicant does have two (2) choices. He can either ask the Planning Board for a waiver of the roadway width so this violation will not be created or he can obtain a vari- ance from :the Zoning Board of Appeals. The Board reviewed the preliminary plan checklist which was done by Planning Director Callinan; some of the abutters to this property are not shown on the plan. Nicholas Harris, applicant, stated that he is currently waiting to purchase a piece of Town -owned land which they are planning to connect to their original subdivision plan which was denied by the Planning Board a few months ago for various reasons.' He stated that if they are successful in purchasing this Town -owned land, they will then submit a subdivision plan which will show the connection of this subdivision plan and the subdivision plan which was recently denied. Mr. Harris explained what the subdivision would actually look like if they are successful in obtaining this land. Planner Genatossio stated that if this Town -owned land is obtained by the applicant and the two (2) subdivisions connected, it is going to change the whole subdivision.' Chairman Brugliera explained to Mr. Harris that if he is successful in obtaining that land and he 'submits a subdivision showing the connection of these two (2) subdivision plans, the Board will have to treat it as a whole new subdivision; but the Board still must act on this plan and even if he does submit a new subdivision showing the connection, it still does' not change; that non -conforming lot. Planner Genatossio asked if the Town of Mansfield was an abutter to this property. Mr. Harris stated that the Town of Mansfield is an abutter. Planner Genatossio stated that it is not noted on the plan and it should be shown. Motion: To deny the preliminary subdivision plan for "Balcom Ridge I and II" based on the technical requirements that have not been met and also that Lot One (1) would be made into a non- conforming lot if this was approved; also, the abutters were not properly shown on the plan. (Genatossio - Boldrighini - All in favor) Chairman Brugliera explained to Mr. Harris that once this subdivision plan meets all of the reasons that the plan was denied for, he can come back with a revision and the Planning Board will review it again. He stated that Mr. Harris will be receiving'a letter in the mail as to all the points for the denial, *Planning Director Callinan left the Planning Board meeting at this time to go into the Board of Selectmen's meeting. Planning Board's Minutes December 4, 1985 Page 8 "Jason Lane" preliminary subdivision plan Acting Clerk Flynn read the comment from Edward A. Sliney,'Jr., Fire Chief, re- garding this subdivision which states that a hydrant should be placed in the cul-de-sac and a fire alarm box shall be installed: at the entrance to the sub- division. Planning Director Callinan had no comments or problems on this sub- division. Chairman Brugliera stated that during past discussions the Board had a question as to whether the applicants needed a drainage easement, but the applicants can obtain a drainage easement for this subdivision, if needed, when it reaches the definitive stage. The deadline for the Planning Board's decision on this preliminary subdivision plan is December 8 1985, which means the Board must act on it at tonight's meeting. Motion: To approve the preliminary; subdivision plan for "Jason Lane" located off of East Street. (Flynn - Boldrighini - All in favor) 11. "Form A" plans Phillips - Pratt Street The applicant of this "Form A" plan is Clyde H. Jr. and Nelia A. Phillips. This, "Form A" plan consists of a certain parcel of land, located on Pratt Street bounded westerly by the Town of Mansfield, northerly by Terence J. and Rolpa Marie Walsh, easterly by Granada Circle and Danunzio and Rose A. Alessandri, and southerly by i Pratt Street. The 'reason this plan does not constitute a'subdivision is because' the -lot has sufficient frontage and are as per the Zoning By -Laws. The checklist is complete. Motion: To sign the "Form A" plan for Clyde H. Jr. and Nelia A. Phillips on Pratt Street. (Genatossio - Flynn - All in favor) O'Sullivan - Branch Street l The 'applicant of this "Form A" plan is Patrick O'Sullivan: This "Form A' plan consists of a parcel of land on the easterly side of Branch Street bounded northerly ,by Armstrong; easterly by remaining land of O'Sullivan; southerly by McGrail and westerly by Branch Street. The reason this plan does not constitute' a subdivision is because Lots 1, 2'and 3 are conforming lots and Lot 4 has been labeled as a non -conforming lot. The checklist is complete. Planner Genatossio' stated that she believes Lot 4 needs a variance because it is a non -conforming lot, this is according to a Land Use Manager pamphlet which she has read. Chair- man Brugliera hair-man'Brugliera stated that this does not need a variance because a note is placed on the plan which states that this is not to be construed as a buildable;, lot. Planning Director Callinan also stated that he does not need a variance because of the note which was placed on the plan. If the ,note was not placed on the plan, however, he would need to obtain a variance and then come before the Planning Board. Motion: To sign the "Form A" plan for Patrick O'Sullivan for Branch Street. (Boldrighini - Bachman - All in .favor) 12. Around the Table Planner Genatossio asked if the Capital Improvements Committee has met this year. Chairman Brugliera stated that they have not met as yet this year. Planner Planning Board's Minutes December 4, 1985 Page 9 Genatossio would like to know if the Board can write a letter to the Selectmen to find out if they; are going to be meeting. Planner Boldrighini'stated that he would 'like to wait and ask Planning Director Callinan if he has heard any- thing about this committee. The Board agreed. *Planning Director Callinan re-entered the Planning Board's meeting. Planner Genatossio would like to know what is happening with the Industrial Zoning Committee. Richard Callinan stated that they are in the process of re- viewing Zoning By -Laws from five (5) various surrounding towns. Planner Gena- tossio would like to know if there will bean article going to the Annual Town Meeting on this matter. Planning Director Callinan stated that that is the whole objective of this committee.' Planner Genatossio would like to know if the Board has decided on the cluster development proposal that Mr. Broderick has presented to the Board; she would like to know if the Board has decided that this is what they want and if they have decided to place an article on the Town Meeting warrant. Planning Direc- tor Callinan stated that he has drafted some points for discussion on this article and he would like the Board to discuss this matter tonight so that they can start working on it for the Annual Town Meeting.' Planner Genatossio stated that she has no problems with a cluster development provision as long as it is for single-family ',homes, but she 'stated that there are so many other issues the Board should be 'working`, on for the Annual Town Meeting such as the Downtown Zoning and the Intensity Regulations. Planning Director Callinan stated that there is approximately 1,100 lots coming before the Planning Board within the next few months and with the cluster development provisions a'lot of the Town's resources will be preserved.', Planner Genatossio stated that this type of provision would take a lot of study and that the Board only has until February 1,',1986, to work on an article for Town Meeting, she feels that the Board should work on this provision for the 1987 Annual Town Meeting. Planning Director Callinan stated that if the Board waits until the 1987 Annual Town Meeting, the 1,100 lots will have already (passed the approval point and he feelsf that an article for Downtown Zoning will take just as much time and study for an article for the 1986 Annual Town Meeting, so this would be the most opportune) time. Acting Clerk Flynn asked where the 'Master Pian would fit into this pro- posal. Planning Director Callinan stated that the Master Plan should be amended' and, this would be accomplished with a comprehensive plan; he stated that he is currently working on a proposal for the Strategic Planning Grant, but that the Town would not get :the money for this grant until 'March of 1986 and by that time it will be too late to get an article on the warrant for Town Meeting. Planner Genatossio stated that she would like to see the Comprehensive Plan worked on before any ;provision for cluster developments are 'worked on for Town Meeting. She feels that the 'Board is not doing things in a; proper 'order because a hearing has not even been held yet for the amendments to the Subdivision Regulations and she would like to know if everything is all set on these regulations, she feels the Board needs to 'work thoroughly on one thing at a time. Chairman Brugliera stated that he would like to see a, provision such as this before these 1,100 lots come before the Planning Board for a decision. Acting Clerk Flynn stated that the Board is forgetting that someone is going to have to 'make a presentation at Town Meeting to "sell" this article to the people ,of the 'Town. Planning' Director -Callinan stated that Mr. Wells would make 'a presentation to Town 'Meeting. Planner Genatossio stated that she does not feel it is his place to make ,the presentation to Town Meeting because he is only a consultant which has been hired by Edward Broderick and that his opinion may differ drastically from other 1people ;who do the same type of work or from the Board's opinion. Planning Director Callinan stated that the Board should give this matter some thought and it can be dis- cussed at a later meeting. Acting Clerk Flynn stated that most of her literature Planning Board's Minutes December 4, 1985 Page 10 on this matter dates back to 1973 to 1975 and she would like some ,updated liter- ature on this matter. She would like to obtain a .copy of the Cluster Development Survey from the Department of Community Affairs, this survey was performed in 1980 for the entire state. She would also like to obtain ,copies of the Zoning By -Laws from the various towns: Duxbury, Westford, Wayland and Amherst. She would like this information just for some basis that the Board can look at and decide what to do from there on this matter. Motion: To send a'letter to the Department of Community Affairs requesting a copy of the Cluster Development Survey which was performed in ' 1980 for the entire state and to :also contact the following towns to obtain copies of their Zoning By -Laws: Duxbury, Westford, Wayland and Amherst. (Flynn - Genatossio - All in favor) Planner Genatossio asked Planning Director Callinan if he had any, knowledge of the CapitalImprovements Committee. Planning Director Callinan stated that he has not heard anything, but that he will talk to the Town `Manager cabout this matter. Chairman Brugliera stated that all that has to be done is a meeting set up to see what the various departments want during the coming year. The Planning Board received a letter from Frederick T. and Paula D. Iddings, Jr.' requesting an extension on the deadline for the Planning Board to make a deci- sion on the "Fox Street" Subdivision until January 10, 1986. Motion: To approve the extension request for the "Fox Street" Subdivision submitted by Frederick T. and Paula D. Iddings, Jr. until January 10 1986. _(Boldrighini - Genatossio'- All in favor) The 'Planning Director received a memorandum from the Town Manager regarding the Board of Selectmen's (sitting as Road Commissioners) concerns about the public safety issues surrounding the proposed developments of Tighe Trucking and Fox- boro Terminals. The Board': of Selectmen would like to know what short term and long term steps should the Town be taking to adequately plan for ,this possible outcome and what mitigation measures can the town realistically implement to protect and; enhance public safety.; Chairman Brugliera asked the Planning Direc- tor if irectorl`if he would like to address this matter at next week's meeting. Planning Director Callinan stated that he has discussed this matter with the Building Inspector, the Town Manager and Town Counsel to see what could be done under the Zoning By -Law for these two (2) proposals. He also stated that the plan for .Tighe Trucking is currently being reviewed by the Consulting Engineer. 13. Public Discussion Mr. Edward Broderick submitted directions to Blanchard Farms cluster development to the Planning Board and stated that since it is so difficult to get all the members of the Board to go at one :time, he feels it is easier for the members to go at their own convenience. He urged the Board to go and take a look at this cluster development because it may help them decide whether',a cluster dev- elopment is something that the Town should work on for the Annual Town Meeting.' He stated that he would like this article on the warrant for this year's Annual Town Meeting because he would like to do "Forest Park" in a cluster development and if it doesn't go to Town Meeting this ;year, he will develop it into a con- ventional:subdivision. He also believes that many of the developers who have plans before the Planning Board will not wait until 1987 to develop their land into a cluster development because of various factors and he feels that many Planning Board's Minutes December 4, 1985 Page 11 valuable resources will be lost. He stated that there are many By -Laws which have incorporated this type of provision and that if the Planning Board would look at those, it will simply be a matter of editing those provisions for Mansfield. He hopes that something will come out of it and that the Planning Board will sponsor it because he feels it will be better received coming ;from the Planning Board rather than a developer. Planner Genatossio stated that each Town is different and that Mansfield is a very highly sensitive area re- garding water and the Board must be concerned about that matter. Mr. Broderick stated that he feels a cluster development, provision will be better for the Town because it will be saving valuable resources, Planner Genatossio stated that it would be better for the developers, not the Town, ;and that the reason that Mr. Broderick would like the Board to bring this article to Town Meeting is because the developers do not want to take it to Town Meeting.'; Mr. Broderick stated that this would be good for the whole town and that is why he invited various people in the Town to see the cluster development, but he stated that he feels this article will be better received coming from the Board than <a developer. 'Planner Boldrighini stated that the Board should be open minded about this 'matter and look at the Blanchard Farms cluster development and make a decision after they have reviewed all the facts. Planner Genatossio stated that she feels it is very commendable for Mr. Broderick to try to arrange for the 'whole Board to visit this development at one time. 14.
