6. Walter Alfieri - "Indian Estates" preliminary subdivision plan
Walter Alfieri presented the Planning Board with a plan which shows that The Elks
own land which is shown being subdivided on the preliminary subdivision plan of
"Indian Estates". Chairman Brugliera informed the Board that another subdivision
plan has also been submitted by a different applicant for the same parcel of land
and he would like to know if this is allowed. Richard Callinan, Planning Director,
stated that the applicant does not have to own the land to submit a subdivision on
it, he could have a purchase and sales agreement on the land; he 'stated that thel
Board is only approving the concept of the plan and any discrepencies which may
exist in the ownership of land would be a'civil matter which would have to be
worked out >between 'the two parties. The Board informed Mr. Alfieri that he should
speak to the developer and the engineer of this subdivision plan.' Planner
Boldrighini stated that he would like a letter sent to the applicant and the en-
gineer stating that it has been brought to the Board's attention that part of this
land which is being subdivided belongs to The Elks.
Motion: .To send a'letter to the applicant of the "Indian Estates" subdivision
stating that it has been brought to the Board's attention that a por-
tion of this land which is being, subdivided belongs to The Elks. A
copy of this letter should also be sent to The Elks.
(Flynn - Fiore - All in favor)
Michael Trowbridge, Engineer, stated that the whole section of Route 106 where
this development is does not match the assessor's` maps at all and that there isi
a possibility that, this subdivision will be withdrawn because all the applicant
wanted to 'do was to protect his land from the rezoning which has; gone to the
Special Town Meeting.
7. "Form A" plan
Carl A. Nelson, Jr. - Williams Street
The applicant of this "Form A" plan is Carl A. Nelson, Jr. This "Form A" plan
consists of a parcel of land on the northerly side of Williams Street bounded
northerly ;by Farris, Angerstein, easterly by Tremont Street, southerly by Williams
Street and westerly by Priesing. The reason this; plan does not constitute a
subdivision is because Lots 13A and 11A have sufficient area and frontage. Lot
12A labeled as a non -conforming lot. The checklist is complete with the ,excep-
tion of the following: The key plan is at two thousand (2,000) feet to the inch
and is supposed to be at one thousand (1,000) feet to the inch; the elevations
and limits of the 100 -year flood discharge are not shown; and in the case of
the creation of anew lot, the remaining land area and frontage ;of the land in
the ownership of the applicant shall be shown. The Planning Director has noted
Planning Board's Minutes
November 20, 1985

that there are two (2) lots, one (1) along Williams Street and one (1) along
Tremont Street that are not shown. The Planning Board had a question as to
whether the; applicant was creating a non -conforming lot. Planning Director
Callinan stated that this lot is already non -conforming and that the appli-
cant is taking a portion of Lot 12A and adding it to Lot 13A to make the area
larger; he also stated that this plan meets all the criteria of a "Form A"
plan.
Motion: To'approve 'the "Form A" plan for Carl A Nelson, Jr. for
Williams Street.
(Flynn - Boldrighini - All in favor)
8. Subdivision Regulations Hearing
Planner Flynn would like to know if the public hearing for the changes to the
Subdivision Regulations has been advertised. Planning Director Callinan stated
that he believes it has not been set and the Board should review all thein -
formation on the design criteria for the retention basins in order that it will
be prepared for the hearing.
Motion: To set the public `hearing `for Wednesday, December 11, 1985, at
7:30 P.M.
(Flynn - Fiore - All in favor)
9. 8.04 P.M. -`Public'Hearing for a Subdivision of a Parcel of Land on Mill (Street
The; public hearing ;for the subdivision of a parcel of land on Mill Street began
E at 8:04 P.M. The hearing was closed at 8:12 P.M. A copy; of the transcript is
available in the Planning Department office.
Chairman Brugliera'asked if the Board would like to vote on this subdivision
tonight. Planning Director Callinan stated that he would like to review; the
information on this plan further and the Board can vote on it at the next
Planning Board meeting.
10. "Form A" plan
Kenneth Conrad - East Street
The; applicant of this "Form A" plan is Kenneth Conrad. This "Form A" plan con-
sists of land located on the southwesterly side of East Street, oppositeShannon
Lane consisting of 'a total of five (5) acres. The reason this plan does not
constitute a subdivision is because Lots 1 and 1A and 2 and 2A as combined have
sufficient frontage (120') on a public street, East Street. Lots 2 and 2A have:
30,193 square feet as combined. The remaining land is not a buildable lot in
its present form. The checklist is complete. Clerk Doucette read the comment
from the Planning Director which states that an opening for the future right-
of-way should be aligned directly opposite Shannon Lane. The Board would like
to know how this could be 'done and still have the required frontage. Planning
Director Callinan stated that it just a recommendation and he feels that it
should be brought to the applicant's attention.
Motion: To approve the "Form A" plan for Kenneth Conrad for land
on East 'Street and to also send 'a note to the applicant that
an opening for the future right-of-way should be aligned di-
rectly opposite Shannon Lane.

11. Discuss "Camelot at Mansfield" Subdivision
Planner Flynn stated that she had asked to have this item placed on the; agenda'
in order that the 'Board can look at the plan and review it because they, have not
had the opportunity to do this; she would like to look at the retention areas
because they are quite large and she has a concern that it is going to be the
Town's responsibility to maintain these areas. She would also like to know if
the test holes which the consulting engineer requested have been done. 'Planning
Director Callinan stated that the test holes have been done and the consulting
engineer is now reviewing the information from those test holes; r he also stated
that he has no concerns on this subdivision and that the consulting engineer has
reviewed these plans and he, also, has no problems with it. Planner Flynn
stated that she does not know if the Board must get involved with these; plans
because it is already an approved subdivision and all the Board is doing is
reviewing ;the letters from the consulting engineer and she would like to know
if the applicant is aware of these comments. Planning Director Callinan stated
that he believes the applicant has copies of all the comments which were made
by the consulting engineer.
Motion: To send a letterregarding the retention ponds on this 'plan to
the consulting engineer to find out his comments.
(Flynn --Boldrighini - All in favor)
Planner Bachman had a question as to if this subdivision required another hearing
because it is over ten (10) years old and he has )very many concerns about this ,
subdivision because there were many problems with it when it was first approved.
Planner Flynn would like the Planning Director to review this plan and see if
it meets the Subdivision Regulations and if it doesn't meet the I requirements,_.
the Planning Board should require that he meets these regulations. The Planning
Director will review this; and this plan will be put on the agenda for the next '<
Planning Board meeting.
12. 8:40 P.M. - Public Hearing for the Extension of Glen Street - Stephen J. Conroy
The public hearing for the extension of Glen Street began at 8:40 P.M. The
hearing was closed at 9:15 P.M. A copy of the transcript is available in the
Planning Department office.
Planner Boldrighini stated that the Planning Board should vote on this sub-
division tonight.'
Motion: To approve the subdivision plan for the extension of Glen
Street subject to eliminating Willis Street as shown on
the plans.
(Boldrighini - Doucette - WITHDRAWN)
Planner Flynn asked if the Town Engineer was going to deal with ;the construction
of this roadway. 'Chairman Brugliera stated that the Town Engineer has to deal
with this roadway because it will be constructed as an unaccepted street. Planner
Bachman stated that he finds it hard to vote on ,this motion because there is a
discrepancy between Attorney Ruboy and Mr. Conroy about the status of Willis
Street. Planner Boldrighini stated that Willis Street can be deleted and, there-
fore, eliminating the discrepancy; that Attorney;Ruboy has with the stutus of his
client's (Schultz's) lots; he also stated that the Board has no of 'knowing
which plan is correct. Attorney Ruboy stated that if the Board would give him a
few minutes to speak with Mr. Conroy, he 'believes they can straighten out the
whole matter. The Board agreed and, therefore, this discussion' will be tabled.

13. Discuss "Massapoag Estates" preliminary subdivision plan
Paul Folkman, applicant, approached the Board with his plan and stated that his
objective tonight is to get a general concensus from the Board as to whether they
agree with `certain 'items on the plan. He 'stated that on the original proposal,
they proposed a dual entrance road to this subdivision, but they are now proposing
to ,put in an island area with one way on each side (much the same idea that is on
Forbes Boulevard, Mansfield); there will be 25 feet on each side of the island and
the iisland `itself will be ten (10) feet wide. The Board was in concensus that this
was good idea. Mr. Folkman stated that in order to address the concerns that the
Easton residents had on the drainage, they, are proposing that the water on the
Easton side of this subdivision be controlled by the creation of leaching basins
which will allow this water to flow naturally. The water that is flowing to the
Mansfield side of this subdivision, the applicants would like to create retention
basins so that the water will be able to go back into the ground. Planner Flynn
stated that she likes the idea of the applicant's, proposal on the water on the
Easton side of this subdivision. 'Mr. Folkman stated that he will bring back cal-
culations to the Board for this drainage. The Board was in general agreement with
this idea. Mr. Folkman stated that they have had professional people do site work
on this parcel of land to identify the poorly drained soils and there seemed to be
a lot of poorly drained soils in the back 'land of this parcel and, therefore, the
applicants have decided to remove this portion which will eliminate approximately
20 lots and they propose to take Patty's Road and loop it around so that it will
meet Barbara Road,:; these will be much larger lots then the rest of the subdivision.
The Board was in concensus with this idea. Mr. Folkman stated that he would like
to add an additional piece; of land in the :beginning of this subdivision which they
have the opportunity to obtain, this would be approximately four (4) lots. The
Board had no problem with the addition of these four (4) lots. Clerk Doucette
read the comments from the Planning Director concerning this subdivision; these;
comments pertain to the open space lots and a second access to this subdivision.'
Mr. Folkman stated that he would like to have copies of these comments and he
stated that he will look into these two possibilities and will have some more
work done on the plan. He also stated that they will be 'starting their definitive
plan for this subdivision.`
14. Discuss Extension of Glen 'Street
Attorney Ruboy stated that he has 'spoken with Mr. Conroy and they are in agree-
ment that the lines of Willis Street should be removed from this ;plan, but there
will be a note placed on the plan referring the the plan number which Willis
Street appears on and only one of the Schult'z lots will be shown with an arrow
pointing to where the other one belongs.
Motion: To approve the subdivision plan for the extension of Glen Street
subject to Willis Street being taken off the plan and aireference
being made to the plan number on which Willis Street appears.
(Boldrighini - Fiore - All in favor)
15. "Camelot at Mansfield" Subdivision
Mr. Edward Broderick, applicant, stated that the roadway is going to be con-
structed according to the present regulations and he also stated that he has
all the comments from John McMann, Consulting Engineer, and he will comply to
them. Once a bond estimate is calculated, he will submit a tri -party letter
of agreement.

Mr. Broderick stated that he wanted to have cluster development on the
"Forest Park" subdivision; they have done'a lot of work on this site and he
would like i to preserve the best characters of the land and the way to do this
is through cluster development. Planner Bachman had a question on the upkeep
of this land. Mr. Wells stated that it is the owner of the land who must
maintain the land and in that way it is a benefits to the Town also. Clerk
Doucette had a question as to why Mr. Wells felt that cluster zoning was
better than a conventional subdivision. Mr. Wells stated that cluster zoning
allows the natural features of the site to be preserved and the wetland

"Pine Terrace Estates V" preliminary subdivision plan
Michael Trowbridge, RIM Engineering, stated that the Back Bay Brook runs along,'
the front of this ,property and that there are no; streams that are going', to be
filled with the exception of the Back Bay Brook. The water is going to be put
back into the ground through porous pipe. A portion of this subdivision falls'
into the Residence A Zone and a portion of it falls into the Agricultural Zone.'
This property is not within the Water ProtectionDistrict and it is not 'within
the 100 -year flood zone. Although the elevations of the water table are not
shown on this plan, they will be placed on the plan when it reaches the ldefini-
tive stage. Planner Bachman had 'a concern with all this traffic exiting onto
Branch Street, which he feels is too narrow to handle this amount of traffic.
Michael Trowbridge stated that, according to the Environmental Impact Study,
if Winter 'Street could handle all the traffic which was being placed on that
road due to development, Branch Street can handle the traffic which will be
generated from this subdivision. Mr. Trowbridge stated that Branch Street is
not as winding as 'Winter Street and there will only be 58 house lots which is
minimal compared to the number of house lots which are in the vicinity of Winter
Street. He also stated that there is no other access to this land other than
from Branch Street. Planner Flynn asked the Board if they would like to look
at the open space lots for this subdivision. Elliott Fine, Attorney, stated
that he feels this will be a hardship to the applicant if the Board requires
him to leave open (space lots. Planning Director'Callinan informed Attorney
Fine that ;these lots would be reserved for three (3) years and it gives the
Town the opportunity to purchase these lots for recreation. Planner Fiore
stated that he believes the Board should consider these open space lots and
the Planning Director can distinguish what lots are to be left open and how
much land this would affect. The Board had a question as to if :they should
review the drainage on this subdivision.' Planning Director Callinan stated j
that the Board is only approving the concept of this plan, anything dealing
with the drainage must betaken up at the definitive stage. Planner Flynn
would like to know what the purpose is in having the island in the middle of
the road at the beginning of this subdivision. Michael Trowbridge stated that
this concept was requested on the "Austin Farms" subdivision because the road
forks, so the applicant wanted to use the same concept on this subdivision;
Mr. Trowbridge also stated that the road will be 25 feet on each side of the
island and the island itself will be 10 feet wide. Planner Flynn asked if
Planning Director`Callinan had any comments or concerns on this subdivision.
He stated that he has no concerns or comments on this subdivision.
Motion: To approve the preliminary plan for "Pine Terrace Estates V.

18. Review Site Plan for a Proposed Warehouse and Storage Building - Oakland Street
This site plan is for a proposed warehouse and storage building on Oakland
Street. Clerk Doucette read the comments from the department heads. Michael
Trowbridge, engineer, stated that Rande Wilson's comment regarding the sewage
flow information will be addressed when the applicant applies for the sewer
permit. Clerk Doucette had a question as to whether or not this site was in
the Water Protection District. Mr. Trowbridge stated that it is not within the
Water Protection District, but there has ,been oil/water separators provided
even though this is not required. He also stated that the building coverage
on this lot is 53 ,percent and that the pavement coverage is 20 percent; so the
total lot 'coverage on this parcel is 73 percent.' The drainage was based on
j calculations of a 100 -year storm, even though only a 25 -year storm is required.
Richard Callinan,'Planning Director stated that although Rande Wilson suggested
that additional study of traffic impacts and environmental impacts be required,
Planning Board's Minutes
November 20, 1985
Page 10
these cannot really be required. The Board felt that since there were so
many negative comments from the department heads, a positive recommendation
could not be made on this site plan.
Motion: To send a negative recommendation to the Inspector of Buildings
due to the comments from the various department 'heads, 'lack of
information concerning traffic and the potentialimpact to the
surrounding community.
(Flynn —Doucette'- All in favor)
19. Review Site Plan for a Proposed Office Building - Creedon Street'-
This site plan is for a proposed office building on Creedon Street. Clerk
Doucette read the comments from the department heads. The checklist for this
site plan is complete. Planning Director Callinan had a concern about the
width of the aisle in the parking lot; the aisle is presently 20 feet wide
and the regulations call for a 24 -foot wide aisle. Michael Trowbridge, en-
gineer, stated that if this aisle is widened to 24 feet, the applicant will
lose some of his parking spaces. The Board also had a question as to the
shrubbery or fencing for the buffer zone on the side of this property which
abuts a residential zone; they felt that shrubbery should rbe planted for a
buffer. Planner Boldrighini stated that if the applicant made the opening
24 feet wide and left the remaining aisle 20 feet, then he would 'still be
able to maintain the number of parking spaces that are needed. Planning Di-
rector Callinan stated that the aisle should be 24 feet throughout the whole
aisle, not 'just a 24 -foot opening; the width of the aisle effects the manu-
vering area for the vehicles.

Oaks Associates and Certuse. The reason this plan does not constitute a,subdivi-
sion is because Lot 54 has frontage on Francis Avenue, apublic way. Lot 53 has
frontage on Connors Avenue, a private way approved by the Planning Board in 1972.
Planning Director Callinan stated that the Planning Board had previously denied
this "Form A" plan because they did not know the status of Connors Avenue. The
checklist is complete, but there is a note on it which states that the applicant
should provide a recorded 'copy of the approved 1972 subdivision plan. Since
there was no further information provided: with this "Form A" plan, the Board
felt that they could not approve it.
Motion: To deny the "Form A" plan for Foxboro Terminals,Inc. for land
on Francis Avenue, Oakland Street and Connors Avenue due to the
lack of information regarding the status of Connors Avenue.
