Public Discussion 7. Date of Next Meeting 8. Adjournment PLANNING BOARD'S MINUTES OCTOBER 16, 1985 Present: Chairman Brugliera, Clerk 'Doucette Planners: Genatossio*, Flynn, Boldrighini and Bachman 1. Meeting called to order at 7:30 P.M. 2. "Form A" plans Robert Moore - Elm Stret The applicant of this "Form A" plan is Robert Moore. This "Form A" plan consists of a parcel of land on the easterly side of Elm Street bounded northerly by MBIA; easterly by the Town of Mansfield; southerly by ABC Trust, Gazzola, Tartufo, Willis, Torrey and Mahan; westerly by Dougherty and Seekell. The reason this plan does not constitute a subdivision is because lots 8, 9 and 10 have sufficient area and frontage as per zoning. Lot 7 labeled as a non -buildable lot because it does not meet frontage requirements. Chairman Brugliera had a concern regrding Lot 10 because it was in both Agricultrual and Residence AA Zones, it has the frontage for Agricultural but does not have the required area for Agricultural, it has the required area for Residence AA. It was the Board's opinion that the lot had to have the required area for the zone which the frontage is in. *Planner Genatossio entered the meeting. Planner Genatossio stated that one of the criteria for signing a "Form A" plan is that you cannot create a non -buildable lot by not having enough frontage on a public way. Planner Boldrighini stated that a note has been placed on the plan that states that this is not a buildable lot and that the only reason that it is included in the "Form A" plan is for deed pur- poses. Motion: To sign the "Form A" plan for Robert Moore for Elm Street. (Boldrighini - Doucette - Bachman - Brugliera) (Planner Genatossio was opposed to this motion) (Planner Flynn abstained from voting on this motion due to the fact that she felt that the lots did not have frontage for ade- quate egress and ingress because these lots are a number of feet below the roadway.) M. R. Keefe, Inc. - West Street The applicant of this "Form A" plan is M. R. Keefe Inc. This "Form A" plan consists of property on West Street opposite Alden Street. The reason this plan does not constitute a subdivision is because Lot 1 has frontage on Route 140 and West Street and sufficient land area for Agricultural Zoning. Planning Board's Minutes October 16, 1985 Page 2 Lots 2 and 3 have frontage on West Street and sufficient land area for Residence A Zone. The checklist is complete with the exception of Number 4 which states, "Identification of the plan by name of owner of record and location of the land in question" - this was not shown on the plan. Motion: To reject the "Form. A" plan for M. R. Keefe, Inc. on West Street due to the fact that the identification of the plan by name of owner of record and location of the land in question was not shown on the plan. (Flynn - Doucette - All in favor) Coughlin - East Street The applicant of this "Form A" plan is Thomas J. Coughlin. This "Form A" plan consists of a parcel of land on the westerly side of East Street bounded northerly by Pine Wood estates Realty Trust, easterly by East Street, southerly by Kirby & King and westerly by the Canoe River. The reason this plan does not constitute a subdivision is because Parcel C has sufficient area and frontage. Parcels A and C to be conveyed to abutting ownership. The checklist is complete with the following exceptions: The key plan at one thousand (1,000) feet to the inch shall be filed, the scale is at 1700 feet to the inch; the existing water bodies and wetlands to demonstrate compliance with Section V -I Water Body Setback and Wetland Protection as enumerated in the Mansfield Zoning Bylaw. Where a water body or wetland is located within the boundaries of the property., elevations of the water at the time of the survey shall be shown on the plan; this is not shown on the plan; the elevations and limits of the 100 -year flood discharge as taken from the Flood Boundry and Floodway Map for the Town of Mansfield effective date April 1, 1977, and the flood rpfile in the Flood Insurance study for the Town of Mansfield dated October, 1976, this is not shown ont he plan; in case of the creation of a new lot, the remaining land area and frontage of the land in the ownership of the applicant shall be shown. Planning Consultant Mannarino noted that although the application form states that Parcel C has sufficient area and frontage. Parcels B and C to be conveyed to abutting ownership - this statement must also be placed on the plan for recording. Motion: To reject the "Form A" plan for Thomas J. Coughlin for East Street due to the facts which were not incorporated on the plan according to the "Form A" review checklist; Number 7, 12, 13 and 14. (Doucette - Flynn - All in favor) 3. 8:00 P.M. - Joint Meeting with the Board of Selec uss Industrial The Planning Board met with the Board of Selectmen at 8:00 P.M. to discuss in- dustrial zoning in the Town of Mansfield. This meeting ended at 9:10 P.M. Immediately following this joint meeting, the Board of Selectmen requested the Planning Board to enter into an executive session to discuss a complaint against a public official. *Planner Flynn left the meeting after the executive session adjourned. 4. Site Plan - Forbes Boulevard David Grant, C,C&F, submitted a site plan for a proposed parking area addition which he has submitted to the Building Inspector who informed him that he has to bet Planning Board approvel, but this plan has not been submitted to the Town Clerk. The comments which have been made by Joseph Mannarino, Planning Consultant, regarding this plan have been addressed with the exception of the drainage because Planning Board's Minutes October 16, 1985 Page 3 the drainage is going to recharge into the ground rather than taking it off the property. Mr. Grant stated that if the Board would like drainage calculations, he will have them calculated and then submit them to the Board. The parking spaces have been met according to the Zoning Bylaw. The proposed parking area is just for the parking of the trucks which will be fenced. Mr. Grant submitted a revised plan with all of the comments from the Planning Consultant to the Planning Board. The Board explained to Mr. Grant that he should submit this plan to the Town Clerk before they can vote on it. Mr. Grant requested that the Board vote on this plan subject to the plan being submitted to the Town Clerk so that construction can begin on this proposal as soon as possible. The Board had no problem with this request. Motion: To send a positive recommendation to Bertram M. Cook, Inspector of Buildings, on the site plan for a proposed parking area addition on Forbes Boulevard submitted by David Grant with the stipulation that the plan be submitted to the Town Clerk. (Doucette - Boldrighini - All in favor) 5. "Form A" plan - Harris - Gilbert Street The applicant of this "Form A" plan is Nicholas C. Harris. This "Form A" plan consists of property located on Gilbert Street on the westerly side. The reason this plan does not constitute a subdivision is because there is adequate area and frontage on a public street. The checklist is lacking the following information: Zoning Classification and locationof any Zoning District Boundaries that may lie within the locus of the plan; the northerly abutters from the latest available Assessor's records unless the applicatnt has knowledge of any changes subsequent to the latest available Assessor's records; the distance to the nearest road or to other permanent monument, or tied into the Town of Mansfield Vertical Control Sy- stem; the plan is at a scale of 2,000 feet to the inch rather than 1,000 feet to the inch which is required; the existing water bodies and wetlands to demonstrate compliance with Section V -I Water Body Setback and Wetland Protection as enumerated in the Mansfield Zoning Bylaw. Where a water body or wetland is located within the boundaries of the property, elevations of the water at the time of the survey shall be shown on the plan are not shown; and the elevations and limits of the 100 -year flood discharge as taken from the Flood Boundry and Flooway Map for the Town of Mansfield effective date April 1, 1977, and the flood profile in the Flood Insurance study for the Town of Mansfield dated October 1976. Motion: To reject the "Form A" plan for Nicholas C. Harris for Gilbert Street due to the facts which were not incorporated on the plan according to the "Form A" review checklist; Number 6, 9, 10, 12, 13 and 14 were not on the plan. (Genatossio - Boldrighini - All in favor) 6. Correspondence Planner Genatossio stated that even though the correspondence was not on the agenda she would like to go over it quickly to see if there are any matters which must be voted on. The Board agreed. Planner Genatossio stated that there was a letter in the correspondence regarding the inspection of a subdivision and she believes that an Inspector Form must be com- pleted and signed by the person who inspected it and also the Planning Board Agent. She would like a letter sent to the Town Manager stating this fact. Motion: To send a letter to Rande Wilson, Town Manager, regarding the procedure which should be followed concerning inspections of subdivisions. (Genatossio - Boldrighini - Bachman - Brugliera - Doucette) (Bachman was opposed to this motion) Planning Board's Minutes October 16, 1985 Page 4 Planner Genatossio also stated that there is a letter in the correspondence regarding the bond estimate for Golden Hill Homes. She believes that the bond estimate is calculated by the Planning Director and the Planning Board then approves the calculated amount. Planner Bachman stated that the bond estimate is calculated through the Means Construction Catalog. Planner Genatossio stated that the Board should calculate this amount since there is no Planning Director, and the applicant shouldn't be submitting an amount to the Board and stating that this is how much he believes the bond should be for a subdivision. Chairman Brugliera stated that this bond amount came from the engineers which were hired by the Town Manager. Planner Genatossio stated that a letter should be received from the Town Manager stating that these are consultants which he hired to work for the Town. A letter from Max Volterra, Volterra, Goldberg & Mangiaratti, to the Mansfield Planning Board regarding the preliminary plan of "Forest Park" and the Planning Board's request that the applicant resubmit this plan because it was withdrew from the office. The letter states that The Broderick Corporation never with- drew the plan and, therefore, will not be refiling the plan as it is unnecessary and unwarranted. Planner Genatossio stated that on the bond estimate for Golden Hill Homes, the Board should make sure that this was calculated according to the 1985 Means Construction Cost Data due to the fact that this is the method that the Board uses and she also stated that the bond estimate should include the fire alarm boxes and that the calculation should be according to the plans which were sub- mitted and approved by the Planning Board. Motion: To send a letter back to Rands Wilson, Town Manager, stating that the Planning Board would like this bond recalculated according to the plans that were submitted and approved by the Planning Board and also using the 1985 Means Construction Cost Data Catalog due to the fact that the Board uses this catalog as a basis for all bonds and also that the fire alarm boxes should be added to the calculations. (Genatossio - Doucette - All in favor) The Planning Board received a request from Ronald S. Bonvie for a partial re- lease of the bond on Wind Chime Subdivision due to the fact that the base coat paving and the 12" gravel base are completed. The Board also received a letter from Al Andrews, Construction Inspector, which stated that both of these items have been properly completed and inspected. The total amount for this work which is being held is $33,546 as figured by the Planning Board. Motion: To release $33,546.00 to The Ronald S. Bonvie Corporation due to the fact that the Base Coat Paving and the 12" Gravel Base were completed and inspected on this subdivision. (Genatossio - Boldrighini - All in favor) The Planning Board received a memorandum from Joseph S. Mannarino, Planning Consultant, regarding the recommended performance guarantee for Mansfield Manor Estates Subdivision. The total amount of this performance guarantee is $551,206.44. Motion: To approve the performance guarantee for Mansfield Manor Estates Subdivision in the amount of $551,206.44. (Genatossio - Doucette - All in favor) Planning Board's Minutes October 16, 1985 Page 5 A letter from Jay Schmidt, 25 Granada Circle, to the Mansfield Planning Board regarding the Board's recent denial of a special permit to Foxboro Terminals and thanking the Board for their decision. A memorandum from Al Andrews, Construction Inspector, to the Town Manager re- garding Eastland Estates and inspection of the paving at this subdivision. A letter from Joseph S. Mannarino, Planning Consultant, to Joseph D. Brugliera, Chairman of the Mansfield Planning Board, regarding the plan and profile of Glen Street. He stated that this plan needs additional information concerning the existing topography of the surrounding area, wetlands and poorly drained soils; it must also meet the requirements for unaccepted streets in the Town of Mansfield Subdivision Regulations. Motion: To send Steven Conroy, applicant, a letter stating that the plan and profile of the Glen Street construction layout re- quires additional information as stated in Joseph Mannarino's letter (which will be attached), in order that he can have that information for the public hearing. (Genatossio - Doucette - All in favor) 7. Around the Table Planner Genatossio stated that the letters which were sent to the applicants of the preliminary plans which were returned to them should have been sent to Judith F. Scott, Town Clerk, with a copy going to the applicant in order that she will know the status of all the plans. Planner Boldrighini asked what the status of "Forest Park" preliminary subdivi- sion plan was at this time. Planner Genatossio stated that the Planning Board voted to deny this plan due to the fact that the applicant took his plan out of the office before the plan was reviewed by the Board. She stated that the letter should be sent to Judith F. Scott and the reasons for the denial should be stated and it should also be stated that the plan should be resubmitted. Planner Boldrighini stated that 'dir. Broderick should submit his plan to the Town Clerk and then bring it bank ;to the Board so that they can review it. Planner W-.aiiman stated that if tlah, plan is reconsidered for review, than the rest of the plan which the Board denied will have to be reconsidered for review and he does not feel that that is right. 'This matter will be taken up further at the next Planning Board meeting. `- 8. Public Discussion No comments at this time. 9. Date of Next Meeting is Wednesday, October 23, 1985, at 7:30 P.M. 10. (Genatossio - Flynn - All in favor) Planner Flynn stated that on Page 6, the paragraph regarding "Forest Park" pre- liminary subdivision plan should state, "The plans for Forest Park are denied and will be returned to the applicant for a new submittal due to the fact that these plans were taken out of the Planning Board office before the Board has a chance to review them". This will be noted in the minutes. Planner Flynn stated that on Page 4, under the discussion of a variance for Dairy Mart, the motion should read, "To send a favorable recommendation to the Zoning Board of Appeals on the variance application of Dairy Mart, Inc., due to the fact that the Planning Board does not feel that this would be more detri- mental to the surrounding neighborhood." This shall be amended. *Planner Fiore entered the meeting. Planner Flynn also stated that on Page 7, under the discussion of Foxboro Termi- nals, Inc. for a "Form A" plan, it should state, "Acting Chairman Genatossio con- tacted Planning Consultant Mannarino by phone and discussed this matter with him." He stated that the Board cannot review this plan because it has not been submitted to the Town Clerk and he has made revisions on it, so he should submit this plan to the Town Clerk so that the Board can review it. Planner Genatossio stated that under this same section, it should state that, "the applicant took his plan out of the office before the plan was reviewed by the Board." Planner Flynn stated that on Page 2, it should be noted that after the joint meeting with the Selectmen to discuss Industrial Zoning, the Selectmen requested that the Planning Board enter into an executive session to discuss a complaint against a public official. She would also like it noted that she left the meeting after the executive session. Planning Boards Minutes October 23, 1985 Page 4 Planner Flynn also stated that on Page 1, under the "Form A" plan for Robert Moore, she would like it added that she abstained from voting on this motion because she felt that the lots did not have frontage for adequate egress and ingress because these lots are a number of feet below the roadway. 4. Sign "Westview Woods" Subdivision plan off West Street Chairman Brugliera stated that this is the subdivision plan that the Board went to court on. Planner Genatossio asked Mr. Broderick, applicant, what the road cut was for this plan. Mr. Broderick stated that the road.cut is approximately 52' to 6 feet at the deepest cut; he also stated that this plan conforms to the all the stipulations in the judgement from the court. Motion: To sign the "Westview Woods" Subdivision plan off West Street. (Boldrighini - Flynn - WITHDRAWN) Planner Genatossio stated that the Town Consulting Engineer should look at this plan to make sure that it conforms to the judgement. There was a concern from the Board because the revision date which was placed on the plan was done in pencil and this will not be accepted by the Registry of Deeds. Chairman Brugliera stated that he would also like the Planning Consultant to look at this plan to make sure that it conforms to the judgement. This plan will be taken up next week. Motion: To send a memorandum to Joseph Mannarino, Planning Consultant, stating that the Board would like him to review the "Westview Woods" Subdivision plan to assure that it conforms to the judgement; the Board would also like to send a memorandum to Rande Wilson requesting him to have. the Consulting Engineer review this plan to make sure it conforms. Discuss "Forest Park" preliminary subdivision plan Planner Bachman stated that he had asked for this item to be placed on the agenda because he would like the Board to review the process which has occured. Planner Genatossio stated that the Board had received a number of new subdivision plans on the same day and that they were reviewing them in no particular order, but did not get to review "Forest Park", Mr. Broderick then came into the Planning Depart- ment the next day and removed his plan, made revisions to it and then returned it without it being stamped by the Town Clerk. She stated that she feels in all fair- ness to everybody who had submitted plans and did not remove the plans the Board should not reconsider their decision to have the applicant resubmit his plans to the Town Clerk. Max Volterra, Attorney for Mr. Broderick, stated that the plans are not going to be resubmitted because the plan was not withdrawn and that the Board can deal with it as they would like. Planner Genatossio stated that the plan has been denied. Mr. Volterra stated that he would like to know why; Chairman Brugliera stated that Mr. Broderick will be receiving a copy of a letter which was sent to the Town Clerk outlining the reasons. Planning Board's Minutes October 23, 1985 Page 5 7. Review Site Plan - Apartment Building on Park Street Clerk Doucette read the comments from the department heads. Edward Sliney, Fire Chief, stated in his memorandum that no trash is to be stored in the building, the alarm system is subject to his approval and the.wing on the left portion of the main building prevents Fire Department access to the last unit creating a life -safety hazard; Jesse Earls, Police Chief, had a concern about the adequacy of the parking facilities; Joseph S. Mannarino, Planning Consultant, stated that this plan lacks the ground water information for the leaching catch basin; Rande Wilson, Town Manager (for the Department of Public Works), stated in his memorandum that the radius on the entrance should be shown on the plan, granite or concrete curbing should be used, the water service should be shown on the plan and proper permits for the sewer line must be requested and approved. The Board felt that these concerns should be addressed on the plan and, therefore, they felt that they could not make a posi- tive recommendation. Motion: To send a negative recommendation to Bertram M. Cook, Inspector of Buildings, regarding the proposed site plan for an apartment building on Park Street based on the comments from the Fire Chief, Police Chief, Planning Consultant and the Town Manager (Acting for the Department of Public Works). Chairman Brugliera stated that the Board has not received anything from Town Counsel on either of these subjects. Planner Flynn stated that she would like a letter sent to the Board of Selectmen stating that the Planning Board was told that the cut of the roadway in the "Westview Woods" subdivision was to be four feet and they have been told by Mr. Broderick, applicant, that the cut is to be approx- imately 52' to 6 feet deep. She would like a copy of this letter sent to Jack Dwyer and would like a response on this issue by Wednesday, October 30, 1985. Motion: To send a letter to the Board of Selectmen with a copy going to Jack Dwyer, Town Counsel, stating that the Planning Board has been told that the roadway cut for the "Westview Woods" subdivision was to be four (4) feet, but the Board has been informed by Edward Broderick, applicant, that the roadway cut is approximately a 5i to 6 foot cut; the Board would like an explanation on this matter by Wednesday, October 30, 1985. (Flynn - Genatossio - All in favor) Planner Genatossio stated in the Minutes of October 9, 1985, under the dis- cussion of "Forest Park", it should have been stated that the plan was denied and the applicant must resubmit this plan because the applicant had -taken the plan out of the Planning Department Office before the Planning Board reviewed them.' She stated that the Board should now review the original submittal and deny the plan on that basis in order that the reasons for the denial will be stated in the letter to be sent to Judith Scott, Town Clerk. Mr. Broderick will then be aware of the reasons why his plan was denied. The Board reviewed the origi- nal plan according to the Subdivision Regulations and found that the major features of the land such as existing walls, fences, monuments, buildings, trees twenty-four inches (24") in caliper measured four feet (4') above the ground, wooded areas, outcroppings, ditches, swamps, water bodies and natural waterways were not shown. The topography of the land with a five foot (5') contour inter- val based on the U. S. Coast and Geodetic Map and tied to the Town of Mansfield vertical control system. Water bodies and their elevations shall be shown with the date of measurement; this was not . on the plan. The elevations and limits of the 100 -year flood discharge as taken from the Flood Boundry and Floodway Map of the Town of Mansfield effective date April 1, 1977, and the flood pro- files in the Flood Insurance study for the Town of Mansfield dated October, 1976, were not on the plan. Motion: To deny the plan for "Forest Park" preliminary subdivision due to the fact that the plan is lacking the necessary in- formation as outlined in the Subdivision Regulations under Preliminary Plans; Some of the Board's concerns are that the plan is lacking Section 2e, Section 2i and Section 2n. Adjournment I MANSFIELD PLANNING BOARD Minutes of Meeting Held October 23, 1985 Present: Chairman Brugliera, Clerk Doucette Planners: Genatossio, Flynn, Boldrighini, Fiore The Meeting opened at 7:30 The Board discussed the selection and appointment, of an Agent to perform the functions of the Planning Board Agent to inspect subdivisions etc. Planner Genatossio indicated that the Planning Board should have a Professional Engineer inspect all subdivision improvements. A letter dated October 7, 1985 from the Planning Consultant, Joe Mannarino, was also discussed. Motion: To appoint the Town Manager, Rande Nilson as the Planning Board Agent. (Boldrighini, Doucette, all in favor) At this point Chairman Brugliera left meeting. Motion: To appoint Planner Doucette as Chairman (Genatossio, Boldrighini, all in favor) Page 2 Motion: To appoint Planner Fiore as Clerk (Genatossio, Boldrighini all in favor) The Board then discussed various proposed changes to the Subdivision Regulations. Planner Flynn commented on the roadway design regulations. She indicated that to reduce the amount of soil removal from site, the cut and fill should be balanced, and if removal was required, a gravel removal permit should be required so to protect the natural features of the land. Planner Genatossio pointed out that the requirement for a gravel removal permit may be too restrictive, and instead the Regulations should be amended to make specific provisions for control (hours, amount etc. ) and health and safety truck rates, dust control, refueling). The consensus of the Board favored Planners Genatossio's position. Motion: To hold the Public Hearing for the Amendments to Subdivision Regulations or November 14, 1985, at 8p.m. (Genatossio, Boldrighini, all in favor). A229ep 0k' hA0
