On this letter, he he also quoted the Massachusetts General Laws, Chapter 40A, Section 9 which deals with the issuance of Special Permits. Attorney Gellerman stated that the Planning Board should base their vote on the issues which are listed and also any information which they have knowledge of themselves, such as traffic and safety. He stated that he will prepare the written decision for the Planning Board after they vote. Planner Genatossfo stated that Attorney Katz, attorney for Foxboro Terminals, stated that the Planning Board cannot obtain any additional information after the public hearing is closed. Attorney Gellerman stated that the Board can address those issues that are part of the public hearing transcript and they can also consider items that they may know as citizens of the Town of Mansfield. Review site plan - Copeland Drive This site plan is for a proposed hair salon on Copeland Drive which would be the conversion of an existing single family dwelling into a small full service Hair Salon. No additional increase in exterior of building. The existing sewage system is adequate for the proposed use (computations were attached). The applicant of this site plan is Copeland Realty Trust. Clerk Doucette read the comments from the various departments. Planning Consultant Mannarino had a comment regarding the screening of the parking area. The applicant stated that he has worked out an arrangement with the abutter for this screening; he also stated that there is an existing septic system and that, according to the computations,, there will be no increase in the amount of water used. Planner Genatossio had a concern about the parking since there were only seven (7) parking spaces shown on the plan; she wanted to know about the employee parking, also. The applicant stated that he only has two (2) employees working at this facility and that he doesn't expect more that five (5) customers at a time, so there is sufficient parking. Planner Genatossio stated that she is still con- cerned with the parking and she would like the Building Inspector to be aware of this fact so that there will not be parking on the street. This is in a General Business zone. Motion: To send a favorable recommendation to the Building Inspector on the application of Copeland Realty Trust for a proposed full ser- vice hair salon on Copeland Drive including the comments from the department heads and the Planning Consultant. This letter shall also state that the Planning Board had a concern regarding the amount of parking and felt that employee parking will be needed. (Doucette - Boldrighini - All in favor) 5. 8.00 P.M. - Discuss "Foxboro Terminals" Special Permit - off Francis Avenue The discussion for the "Foxboro Terminals" Special Permit began at 8:00 P.M. The discussion ended at 8:20 P.M. Please see the attached copy of this dis- cussion for details. 6. Guest - Steven Conroy - discussion of extending a paper street Steven Conroy approached the Board and submitted a plan to them for his pro- posal to extend Glenn Street which is currently a dead-end paper street. He stated that he has spoken to the Town Engineer and received the requirements to make this street conform to the Unaccepted Street Requirements; he also stated that the Town Engineer has no problem with the water or the sewer on this plan. Mr. Conroy has received acceptance of this proposal from the Board of Selectmen and he has spoken to the Building Inspector and was told that he has to get Planning Board approval first. Planner Genatossio stated that Mr. Conroy must submit these plans to the Town Clerk and a public hearing must be held on this proposal. Motion: To hold a public hearing for the extension of Glenn Street, the applicant is Steven Conroy, on Wednesday, October 30, 1985, at 8:00 P.M. (Doucette - Fiore - All in favor) Planning Board's Minutes October 2, 1985 Page 4 7. Review "Austin Farms" definitive subdivision plan off Winter Street Clerk Doucette read the letter from Michael Trowbridge, engineer, addressing the comments from the Planning Consultant and the Town Engineer. He stated that the Planning Consultant's concern about the amount of material being cut; the gravel which is going to be cut will be used on site and there will be 12,000 cubic yards of loam and subsoil removed and that that is allowed. Mr. Trowbridge stated that he has had a problem reaching John Larch, Light Depart- ment Manager, in order that he will know where to place the street lights on the plan, but that Mr. Larch can just give him the layout of the lights and junction boxes at a later date and they will be put on the plan during the appeal period. The applicant is requesting a waiver for the roadway pavement width - he would like the pavement width to be 25 feet instead of the required 30 feet. He is also requesting a waiver to place the sidewalk on one side instead of on two sides. Motion: To approve the waiver for the roadway pavement width to be reduced from the 30 -foot requirement to 25 feet due to the fact that this is what the Environmental Impact Statement suggested. (Doucette - Boldrighini) (Genatossio - Flynn - Bachman - Fiore opposed to this motion) FAILS Planner Genatossio stated that she has a concern as to the width of the street because this may be considered a secondary street and not a minor street and F" the Planning Board, in updating the Subdivision Regulations, were speaking about reducing the width of a minor street to 25 feet, not the width of a secondary street. Motion: To deny the request for a waiver for the placement of side- walks on only one side of this subdivision. (Genatossio - Fiore - All in favor) Chairman Brugliera stated that he has no problem with allowing the electrical - Tights and the junction boxes to be placed on the plan during the 20 -day appeal period. Ronald Bonvie, applicant, stated that the Town Engineer had marked up a plan showing exactly what he wanted and the plans have been revised to reflect these changes. Planner Flynn stated that she had a concern about the 12,000 cubic yards which are to be removed. Mr. Bonvie stated that even if there was no cut and fill on this site, that amount of material would still have to be removed because it is all loam and subsoil. Mr. Trowbridge stated that the Town Engineer had requested that the easement be enlarged; this has been shown on the plan. The Board reviewed the plans and all the comments seem to be addressed. Motion: To approve the subdivision plan entitled "Austin Farms", submitted by Ronald Bonvie with the stipulation that John Larch, Light Depart- ment Manager, place the locations of all street lights and electrical utilities on the plan; and also, the plan must conform to the Subdivision Regulations concerning the roadway pavement width and the sidewalks. (Doucette - Genatossio - All in favor) 8. Discuss "Hallett Crossing" definitive subdivision plan - off Fruit Street The comments from the various department heads were read and the plan which the Board was reviewing did not address these comments. There was a question Planning Boards Minutes October 2, 1985 Page 5 as to whether the applicant and engineer had received the department head comments on this plan or a letter from the Planning Board stating what issues had to be addressed on this plan. Motion: To send a letter to the applicant outlining the concerns of the Planning Consultant, the Town Engineer and all other department heads; it shall also be stated in this letter that the curben shall conform to the present Subdivision Regulations and that if the applicant is requesting a waiver of this regulation, it must be submitted, in writing, to the Planning Board; a waiver must also be requested for the width of the roadway pavement; it shall be stated in this letter that these are only some of the concerns that the Planning Board had and that they would like these addressed. (Doucette - Genatossio - All in favor) 9. Discuss "Chambers Court" subdivision plan - off West ?Street - The Board received an application from the Harrington & Matto Company, Inc. for the removal of approximately 16,000 cubic yards of top and subsoil on the site of "Chambers Court" subdivision. The Board requested the applicant to attend a Board meeting to explain the necessity for this amount of mate- rial to be removed since the site, when approved, nothing was mentioned of this amount of removal. Michael Trowbridge, Engineer, stated that all this material to be removed is top and subsoil which cannot be used on site. Mr. Steven Wright, applicant, stated that the material which has to be removed ranges from 13" to 36" throughout the whole site and that this material must be removed in order to landscape the property properly. Planner Boldrighini stated that he does not see any reason to remove that amount of material from the site because it is very flat and he wanted to know, since this calculation was for the whole site, how much material needed to be removed just for the roadway. Michael Trowbridge stated that it was not calculated separately from the whole site. Planner Genatossio stated that this calculation should have been submitted to the Board when the subdivision was in the process of being approved. Mr. Wright stated that they did not know this amount of material was to be removed until they starting cutting the road. Planner Boldrighini stated that there is no reason to remove up to 16,000 cubic yards of material from this site, but the applicant should be allowed to remove up to 10,000 cubic yards of top and subsoil from this site. Motion: To send a positive recommendation to the Building Inspector on the application for surplus material from the site of "Chambers Court" which has been requested by the Harrington & Matto Company Inc., but it should be stated in this letter that the applicant should only be allowed to remove 10,000 cubic yards of material from the site and the hours of operation shall be from 9:00 A.M. to 2:00 P.M. (Boldrighini - Fiore - All in favor) 10. Waiver Requests The Planning Board received a request from Edward Broderick, The Broderick Corporation, requesting a waiver of the road width requirements from 30 feet to 25 feet and one sidewalk in the place of two sidewalks in the "Westview Woods" subdivision. The Planning Board had a question as to the status of the plan and stated that they would like to find out from Town Counsel as to the exact status before voting on any requests for waivers. Planning Board's Minutes October 2, 1985 Page 6 Motion: To send a letter to Jack Dwyer, Town Counsel, requesting that he ex- plain the results of the Broderick Corporation versus the Mansfield Planning Board case; what those results mean to the Planning Board and how they should handle it. (Fiore - Doucette - All in favor) Motion: To send a letter to Edward Broderick, The Broderick Corporation, stating that the Board will not be taking an action on the requests for the waivers until a response is received from Town Counsel as to the status of the plan. (Genatossio - Doucette - All in favor) 11. Preview new subdivision plans Clerk Doucette stated that he has a big concern about all the subdivision plans which have been submitted and the Board may have to start meeting an extra night every week to review all these plans. Planner Flynn stated that the Board should review these subdivision plans according to the preliminary checklist and if they are not complete, they should be sent back to the applicant. Wood Park Preliminary Subdivision Plan The Planning Board reviewed this preliminary plan and found that there was no "Form E" Certified List of Abutters with this submission; there was also no elevation of the brook shown on the plan. Motion: To return this preliminary plan to the applicant due to the lack of information, specifically the elevation of the brook and the "Form E" Certified List of Abutters. (Flynn - Doucette - All in favor) Pleasant Valley Preliminary Subdivision Plan The Planning Board reviewed this preliminary plan and found that there was no "Form E" Certified List of Abutters with this submission. Motion: To return this preliminary plan to the applicant due to the lack of information; no "Form E" Certified List of Abutters was sub- mitted with the plan. (Doucette - Genatossio - All in favor) Bird Hill Estates Preliminary Subdivision Plan The Planning Board reviewed this preliminary plan and found that there was no legend on the plan; there was no "Form E" Certified List of Abutters with this submission; there was no existing and proposed lines of streets, ways, easements and any public or common areas within the subdivision in a general manner; the major features of the land were not on the plan; the widths of adjacent streets were not shown; the elevations and limits of the 100 -year flood discharge was not shown. Motion: To return this preliminary plan to the applicant due to the lack of information; there was no "Form E" Certified List of Abutters submitted with the plan; the existing and proposed lines of streets, ways, easements and any public or common areas within the subdivi- sion in a general manner were not shown; the major features of the land were not shown on the plan; the widths of adjacent streets were not shown on the plan; the elevations and limits of the 100 -year flood discharge was not shown. (Fiore - Genatossio - All in favor) Planning Board's Minutes October 2, 1985 Page 7 Motion: To discuss "Camelot Estates" Subdivision at this time. (Boldrighini - Fiore - All in favor) 12. Discuss "Camelot Estates" definitive subdivision plan - off Williams Street Edward Broderick, applicant, approached the Board and submitted the Order of Conditions which he received from the Conservation Commission, an approved copy of the plan which was signed on October 22, 1975, and a letter from RIM Engineering outlining the items which they have noted have been revised in the Subdivision Regulations since this plan was approved. Planner Genatossio asked Mr. Broderick if there has been any change in the drainage for this sub- division since it was approved in 1975; he replied that it has not been changed to his knowledge. Planner Flynn stated that she has been looking through the file for the original submission and she believes that the Board must look at this plan very carefully because there was so many problems with the original plan. *Planner Flynn left the meeting. Planner Genatossio stated that there were problems within this subdivision and the Board has to look and see what changes have been made and that a major concern in this subdivision is the drainage. She stated that this plan should be reviewed and a memorandum should be sent to the Town Manager stating that he should hire someone to review the drainage on this plan. Motion: To request the Planning Consultant to review this plan and submit his comments to the Planning Board and to also send a memorandum to the Town Manager requesting that he obtain comments from the Town Engineer. (Genatossio - Doucette - All in favor) Doug Annino, Tremont Street, stated that the neighbors in this area have a big concern regarding the mine shafts which exist in this area which would be built right on top of and they are also concerned about the water table. Planner Genatossio stated that the only mine shafts the Planning Board can deal with are those which are in the road way, but the Board will inform the Planning Consultant that there was concern shown about these mine shafts and state that boorings may have to be done in the roadway. Chairman Brugliera stated that the Board will have to review this file and discuss this plan further at another time; the Board will also receive comments from the various department heads. Planner Boldrighini stated that the Board should require the latest information on the mine shafts be placed on the plan in order that the Board knows if there will be any problems with these and test holes should also be done in order to expose these mine shafts. 13. Public Discussion Planner Bachman stated that he doesn't not understand why another public hearing is not being held on Camelot Estates because the plan is ten years old and he would like the Board to ask the Planning Consultant to review this plan and give the Board some guide as to how to handle it. Clerk Doucette stated that the Planning Board should write a letter to the Town Manager requesting that a Town Engineer be hired to review all the new subdivision plans which have been submitted. He also stated that he would like a half -way point set up in order that when 30 days have passed on the subdivision plans, they would automatically be put on the agenda for review in order that the Board can review them properly. Planning Board's Minutes October 2, 1985 Page 8 e Planner Genatossio stated that the preliminary plan for "Jason Lane" was not to the specifications of the Subdivision Regulations and she believes that this plan should be sent back to the applicant and he should be informed that this plan must conform to the Subdivision Regulations. Motion: To return the preliminary plan for "Jason Lane" to the applicant due to the lace of information and advise him to get a copy of the Subdivision Regulations and design the plan in accordance with the guidelines. (Genatossio - Doucette - All in favor) Planner Genatossio stated that the Planning Board has to start doing site walks on some of these subdivisions such as "Hallett Crossing", and "Camelot Estates" and she also stated that the Board should start working on revising the Subdivi- sion Regulations. The Board will meet on Monday, October 7, 1985, at 7:30 P.M. to work on these Regulations. Chairman Brugliera stated that on August 6, 1985, the Planning Board sent a letter to Douglas A. King Builders concerning the "Canoe River Estates" sub- division and the problems which still occur at this subdivision. He stated that no response has been received on this letter and the work still has not been completed. The Town is holding $10,600 for the remaining work to be done and Chairman Brugliera feels that the Town should take this money and complete the work. Planner Boldrighini stated that Town Counsel should be notified and Douglas A. King Builders should also be sent a letter stating that the Town is pulling the remaining bond to complete the work. Motion: To pull the remaining bond for the "Canoe River Estates" subdivision and to notify Douglas A. King Builders of this fact and to also send a letter to Town Counsel requesting him to pull the bond. (Boldrighini - Fiore - All in favor Chairman Brugliera stated that he would like Cabot Pond put on the agenda next week. 14. Public Discussion No comments at this time. 15. Date of Next Meeting is Wednesday, October 9, 1985, at 7:30 P.M. 16. Meeting adjourned at 11:00 P.M. CLERK DATE October 2, 1985 Foxborough Terminals meeting Chairman Brugliera: We are going to be taking up Foxborough Terminals and we have some correspondence from their attorney, could you read that please? Clerk Doucette read the letter received from the attorney for Foxboro Terminals. Chairman Brugliera: Okay. Is there any discussion on this letter, any comments from anyone on the Board? No comments at this time. Richard Merrikin: We have the revised plan if you'd like to see it. Chairman Brugliera: Okay. As we were discussing last week, or as you brought to our attention last week, we cannot accept that revised plan because the public hearing was held on the original plan, am I correct? Attorney Katz: Whatever you wish. plan on a larger scale. Richard Merrikin: Just for the record this is a revision of the original plan, not that revised plan we brought in with a smaller building. Attorney Katz: This is the original plan on a larger scale. Richard Merrikin: Some technical items, very fairly minor and it addresses some of the technical things. Attorney Katz: It's not a revised plan. In your letter to us, you asked for the thing to be submitted on a larger scale, it's drawn on a larger scale. Chairman Brugliera: Did you want to submit that to the Planning Board? Richard Merrikin: Sure. Attorney Gelerman: There may or may not be some technical requirement as to whether or not that's (can't hear). Richard Merrikin: Yes. We'll give it to them, you know, and they can do what they would like with it. I can tell you what we changed so you don't have to delve into it. The first items on your letter indicated what we would consider technical deficencies. That is the scale, notation of wetlands, notation of the driveway next door and the distance, the size of the truck dock and, one item you didn't mention, was the abutters and the abutting houses. We had amended that portion and we had indicated that it was incorrect on the first filing. So, those are the major items that have been changed. Other than that we haven't, obviously haven't, done anything to do with the environmental studies that were in the following, in the subsequent portion of the letter. Planner Fiore: You have changed the scale? Richard Merrikin: Yes. October 2, 1985 Foxborough Terminals meeting Page 2 Planner Fiore: The location of driveways and driveway openings? Richard Merrikin: Yes. Planner Fiore: Locations of wetlands and ponds within 200 feet? Richard Merrikin: That, also. Planner Fiore: Truck manuevering areas within 60 feet adjacent to loading areas? Richard Merrikin: Yes, we revised that. Chairman Brugliera: Okay, thank you. Members of the Board, is there any dis- cussion on this plan.. You know our time is running out, our deadline is October 8, 1985, it is now October 2, 1985, and we will not be meeting again before then. Can I hear any comments or questions the Board members may have. Planner Fiore: I think I have, obviously it came up at the public hearing, a great concern regarding this plan due to the excessive amount of truck traffic that's going to be generated. That area is in a high residential area and there's often places where there is no sidewalks, truck traffic is at high frequencies during the times when schools are opening and schools are closing. I just have a great, general concern for the safety and public welfare in that area should the site be allowed to be developed. Chairman Brugliera: Okay, anybody else? Planner Genatossio: Rick, you showed the wetlands here, the approximate wetlands area? Richard Merrikin: Yes. Planner Genatossio: There is a wetland area Richard Merrikin: in the back? Planner Genatossio: Yes, in the back. Richard Merrikin: That's shown on there Planner Genatossio: On which sheet? Over here? Richard Merrikin: Yes. Planner Genatossio: This is the only one? Is there none down in this area over here? Richard Merrikin: Not within 100 feet of the site. Planner Genatossio: 200 feet. Richard Merrikin: Not to my knowledge. Those have to be verified by the Conser- vation Commission on the exact locations. October 2, 1985 Foxborough Terminals meeting Page 3 Planner Genatossio: But how are we supposed to know. You, as the engineer, Richard Merrikin: I feel comfortable with that. Planner Genatossio: I believe, myself, from this particular area that there are wetlands down in this particular area over here from driving by there. Richard Merrikin: I'm not familiar with the site. So I would have to say, my opinion is that there are none. Planner Genatossio: I don't know if it's a Conservation Commission responsibilty or your responsibility as applicant and developer of the site. Chairman Brugliera: Again, because of the time frame that we are working under, the deadline and the last meeting before the deadline; we do have a full Board and I would like to request that the Board make a motion on the plan. Anthony Fiore: I make a motion that we reject this plan, not allow this Special Permit for the reason that I gave; one, that I do have great concern about the traffic and public safety and I also think that, it's obvious that this plan is in the Water Protection District, in an aquifer, and I've got concerns about the effect on the quality of water. I also have concerns about the degradation of the surrounding neighborhood because there is a lot of residential neighborhood in that area and how this development is going to effect the neighborhood. I've got concerns about public safety, we have the railroad crossing across Francis Street and I am somewhat concerned about the fact that the train would get stuck if something ever happended to that railroad crossing, it would block off the rest of the street, it would stop emergency vehicles from travelling down Francis Street. Clerk Doucette: I'll second that motion. Chairman Brugliera: Open for discussion. Planner Genatossio: Are you mentioning noise within that motion. Anthony Fiore: Noise is another thing I'd be concerned about due to the surrounding areas and the old age home, an old age development in the area. Truck traffic is going to be moving in and out at all hours of the day. That's also a concern. Planner Genatossio: I don't know if, so much the traffic also is a concern as the noise that is generated by engines that are possibly left on, deisel engines and pollution from those deisel engines that are left running. And the loading, the noise from the loading of trucks and unloading of railroad. The Board had a concern about the noise from that rail line to the side of the building and asked the applicant to enclose it which was not done, to cut down on the noise. I also have concerns about the wetlands that are on the site. Anthony Fiore: This is near, what, three well sites. October 2, 1985 Foxborough Terminals meeting Page 4 Planner Genatossio: Yes. Planner Fiore: Three operating well sites in the Aquifer Protection District? Planner Genatossio: That's in our major aquifer, one of our major aquifers for the Town; and we also have wetlands to consider within that area, on the site as well as off. Chairman Brugliera: I think the Water Protection is the biggest concern, then traffic, the children going to school with no sidewalks such as on Hope Street. Anything else from the Board? Planner Boldrighini: I think the biggest thing is that we want industry there, but a different type of industry that doesn't have a negative im- pact, that doesn't have all of that. Chairman Brugliera: Hearing no further discussion, we have a motion from Tony Fiore to deny the Special Permit and we have a second from Ron Doucette, all those in favor of that motion signify by saying I. C All Board Members: I. Chairman Brugliera: Opposed? None opposed. Attorney Katz: Mr. Chairman, can I request you to have your secretary send me a copy of the decision. Chairman Brugliera: Yes. We will have that written in a few days. Attorney Katz: Okay, thank you.
