Foxboro Terminals Chairman Brugliera stated that the Board has received a letter from Foxboro Terminals, Inc. requesting a sixty (60) day extension on the application of a special permit in the water protection district and for site plan approval for a 650,000 square foot warehouse terminal off of Francis Avenue. He stated that the Board should vote on this extension because the deadline, as it stands now, is October 8, 1985. There was discussion from the Board as to whether an exten- sion could be granted because there is nothing that stated this fact in the State Regulations. The Regulations state that the Planning Board has 90 days to either approve or deny this proposal or the applicant gets approval by de- fault. Chairman Brugliera also stated that the Board has just received an updated plan from the engineer of this proposal and they would like to have time to review the plan and receive comments from the DPW Director and the Planning Consultant. Motion: To deny the request for a sixy (60) day extension requested by Garrett Spillane, attorney for Foxboro Terminals, Inc. (Doucette - Genatossio - All in favor) --_ Motion: To send a letter to Rande Wilson, Town Manager, requesting him to have Joseph Zeneski, Town Engineer, review the revised plans for Foxboro Terminals and report back to the Planning Board in time for their meeting next week. (Doucette - Flynn - All in favor) Planning Board's Minutes September 18, 1985 Page 4 4. Review covenant for "Westhaver Farms" subdivision and "Fuller Estates" Paul Folkman, representative for Evelyn Allen, approached the Board and stated that he would like the Planning Board to approve the covenants for "Westhaver Farms" and "Fuller Estates" subdivisions and he would also like the Board to vote to release the following lots because they have frontage on an existing public way - "Westhaver Farms": Lots 1, 2, 3, 4, 30, 31, 32, 33, 34 and 35; "Fuller Estates": Lot 8. Mr. Folkman stated that there were some complications filling out the forms, so they are not all complete, but he requested that the Board vote on the forms and he will then submit all paper work to the Planning Department. Motion: To approve the covenant for "Westhaver Farms" subdivision plan and to also approve the release of Lots 1, 2, 3, 4, 30, 31, 32, 33, 34 and 35 due to the fact that they have frontage on an ex- isting public way; this approval is subject to the appropriate paper work being filled out and returned to the Planning Depart- ment. (Flynn - Boldrighini - All in favor) Motion: To approve the covenant for "Fuller Estates" subdivision plan and to also approve the release of Lot 8 due to the fact that it has frontage on an existing public way; this approval is subject to the appropriate paper work being filled out and re- turned to the Planning Department. (Genatossio - Doucette - All in favor) 5. "Jason Lane" preliminary subdivision plan Mr. Robert Field, Field Associates, approached the Planning Board and stated that he is the engineer of this plan and that it consists of approximately seven (7) lots off of East Street, the roadway is 650 feet long and he is pro- posing 24 foot pavement, he also stated that all the lots will conform to the zoning laws. The Planning Board explained to Mr. Field that if he is proposing 24 foot pavement for the road he will have to request a waiver because the re- quirement is 30 feet. The drainage for this property is partially on this pro- perty and partially on Mr. Flint's property because the land drains that way naturally. Planner Genatossio stated that a drainage easement must be obtained from Mr. Flint if this drainage is to go to his property, and if he should not be able to obtain an easment he will have to have an alternative drainage plan. Mr. Field submitted all abutters within 300 feet of this proposed subdivision as the Planning Board had requested. He stated that the pavement width of East Street ranges from 24 to 26 feet and that the natural features are not shown on the plan as the Board requested because they will all be removed if this plan is approved. The Board informed him that even if all these features are to be removed, they must be shown on the plan. There was also a question from the Board as to the scale which is 1" = 50', Mr. Field stated that he would like to keep the scale as it is, but will change it if the Board requests. The Board informed him that it can stay at the present scale, but when it goes to the definitive stage, the scale must be 1" = 40'. Mr. Field also stated that this proposed subdivision is not within the 100 -year flood zone. 6. Review revisions to "Austin Farms" definitive subdivision plan - off Winter Street, deadline October 1, 1985 Clerk Doucette read the comments from the Planning Consultant and the Police Chief. Planner Flynn stated that she believes the Police Chief should be sent a copy of the Environmental Impact Study along with a letter thanking Manning Board's Minutes 1September 18, 1985 Page 5 3' him for his comments and stating that the Board had many of the same concerns, but this study addressed those comments differently. Motion: To send a copy of the Environmental Impact Study to the Police Chief along with a letter thanking him for his comments on the "Austin Farms" definitive subdivison plan and stating that the Planning Board had many of the same concerns, but these concerns were addressed in the study and that this study is for informa- tional purposes only. (Flynn - Doucette - All in favor) Joseph Zeneski, DPW Director, stated that he has not had a chance to put his comments in writing, but he will do this as soon as possible and return the comments to the Board who in turn will give them to the applicant so that his concerns can be addressed, but, he stated that this revised plan is quite an improvement over the original submission, but there are also some areas that are still incomplete. Ronald Bonvie, applicant, stated that most of the issues have been addressed in this revision and that he will address any issues that have not been addressed, but he stated that there are some issues which have to be addressed with the Board. He stated that he would like to be put on the Board's agenda as soon as possible so that the Board can act on this plan in an expedient manner. The Board stated that he will be put on the agenda for October 2, 1985, to discuss this plan. 7. Sandra Levine Ms. Sandra Levine entered the Board's meeting and stated that the Board of Selectmen will be holding a hearing next week concerning Foxboro Terminals and would like to know what time the Planning Board is going to have the en- gineer at their meeting so that the Board of Selectmen can question him on any issues that arise at their meeting. Chairman Brugliera stated that Fox- boro Terminals will be in at approximately 9:00 P.M. Motion: To send Richard Merrikin, Engineer, a letter stating that the Planning Board has scheduled him to attend their meeting on September 25, 1985, at 9:00 P.M. (Genatossio - Flynn - All in favor) 8. Around the Table The Planning Board received a letter from Steven Wright, Treasurer of the Harrington & Matto Company, Inc., requesting a favorable recommendation to be sent to the Building Inspector in order that a permit may be issued to remove approximately 16,000 cubic yards of excess top and subsoil from the site of Chambers Court. Chairman Brugliera stated that the applicant must fill out and return an Earth Removal Application before the Board can make a recommen- dation. The Board received a letter from Jospeh S. Mannarino, Planning Consultant, regarding his planning consultation hourly breakdown for the week of September 1, 1985. The total is 10 hours. Motion: To pay Joseph Mannarino, Planning Consultant, for the Planning Consultation Services for the week of September 1, 1985. (Fiore - Boldrighini - All in favor) The Board received a letter from Bertram M. Cook, Inspector of Buildings, \ attaching a signed statement regarding the estimated quantity of surplus material Planning Board's Minutes September 18, 1985 Page 6 to be generated from the Nissan Motors Facility on Plymouth Street and he would like the Board to make their recommendation as soon as possible. Motion: To send a letter to Bertram M. Cook, Inspector of Buildings, giving him permission to grant approval to remove approximately 7500 cubic yards of material from the Nissan Motors Facility on Plymouth Street. (Doucette - Boldrighini - All in favor) Planner Boldrighini had a concern over how the Planning Board was going to get the comments from the Board of Selectmen regarding the hearing which they are holding on Foxboro Terminals if it is the same night that the Board is going to be discussing it. Planner Flynn stated that the Planning Board should only take the comemnts that they receive from the Selectmen just as a comment would be taken from the public. Planner Bachman asked what the status of Westview Woods definitive subdivision was; Chairman Brugliera stated that he has not heard from Jack Dwyer, Town Counsel, and that he is on 24-hour notice as to the date of that court case. Clerk Doucette had a concern regarding the status of the hiring of a new Planning Director. Chairman Brugliera stated that the Town Manager has notified him that he will be offering this position to one of the candidates, but Chairman Brugliera stated that he would rather wait to see if the job is accepted before announcing the person's name. Clerk Doucette stated that he has a concern regarding the resignation of the ~ DPW Director and he would like to know if the Town if going to hire him as a consultant; he also stated that the Board should write a letter to the Town Manager and the Selectmen stating that this position should be filled immedi- ately. Motion: To write a letter to the Board of Selectmen and the Town Manager stating that the Planning Board feels that Joseph Zeneski should be appointed as a consultant until the Town of Mansfield hires a new Town Engineer and that the Planning Board feels this position should be filled as soon as possible. (Flynn - Boldrighini - All in favor) Planner Bachman had a concern about this because he feels that is Mr. Zeneski is going to work for an engineering firm and a person comes in to the Planning Board and he is working on a different plan for that person in another town, he feels that this would be a conflict of interest. Planner Flynn stated that if this situation should ever arise, Mr. Zeneski would have to refrain from commenting on the plan. Planner Flynn stated that the Board should write a letter to Foxboro Terminals Company, Inc. thanking them for their invitation to visit the facility located at 208 North Street in Foxboro, but stated that the Planning Board is unable to visit at this time. Motion: To send a letter to David Petri, Foxboro Terminals Company, Inc., thanking him for his invitation to visit the facility located at 208 North Street in Foxboro, but stated that the Board will be unable to visit at this time. (Flynn - Doucette - All in favor) Manning Board's Minutes September 18, 1985 Page 7 Planner Flynn stated that last week the Planning Board discussed the Camelot at Mansfield Subdivision, but the tape recorder was shut off in the middle of the conversation, so she would like to know what the Board decided to do on this plan. She stated that the Board has written the applicant letters stating that he may need another hearing, but that is where it was left. Planner Genatossio stated that the Board has not even looked at the plan and they should write a letter to him stating that once he gets his Order of Conditions from the Conservation Commission he should come into a Planning Board meeting with a plan so that it can be reviewed. Motion: To send Edward Broderick, applicant, a letter stating that he should attend a Planning Board meeting with a plan when he gets his Order of Conditions from the Conservation Commission so that the Planning Board can review this plan. (Doucette - Bachman - All in favor) Chairman Brugliera stated that the Board has sent letters to the applicant of Canoe River Estates regarding the problems that exist down there and nothing has been done to correct these problems. He would like the bond estimate looked up in order that the Board may discuss what steps to take next on this subdivi- sion. Chairman Brugliera stated that the deadline for the Cabot Pond restoration pro- ject is October 15, 1985, and nothing has been done yet; he feels that the Board should take measures on this project. Planner Fiore stated that he be- lieves the Board should wait until the actual deadline is up before taking any action. This deadline will be placed on the pending business list for the Planning Board. 9. Public Discussion Ms. Karen Galanti stated that she is submitting an article for the warrant for Town Meeting to increase lot sizes in the Water Protection Zone and she would like the Planning Board's support for this article. Chariman Brugliera explained to Ms. Galanti that the article has to first go to the Selectmen who will then send it to the Planning Board, a public hearing will be scheduled and then the Planning Board will make their recommendation which will be submitted at the Town Meeting. Planner Flynn stated that the Board would also like to first review this petition because there may be concerns with it. Mr. Donald Ploof, 330 Gilbert Street, approached the Board and stated that he would like the Board to write a letter regarding his company, Baystate Energy Service Inc., because he would like to relocated from Mansfield to Taunton and he needs a letter which states that if this business should leave Mansfield it will not negatively effect the Town due to the number of jobs which will be lost and that land is not available in the Town in his financial range. It should also be noted that Mr. Ploof was denied a variance on his property to expand his business and that the land has been rezoned, he is presently a non- conforming use and because of these reasons he is unable to expand his business the way he wishes. Mr. Ploof needs this letter because he is applying for UDAC funds. The Board agreed to write this letter for Mr. Ploof. 10. Around the Table Clerk Doucette asked when the Board was going to complete the work on the Sub- division Regulations. Planner Genatossio stated that the Board should review these changes one more time and then schedule a date for a public hearing; she Planning Board's Minutes September 18, 1985 Page 8 ¢ also stated that the Board is still waiting for further comments from the DPW Director and the Planning Consultant. She felt that the Board should have both of these individuals present at the next workshop for the Subdivision Regulations. Planner Bachman felt that the Board should wait to review these regulations until the new Planning Director begins working for the Town. The Board disagreed with Planner Bachman. Motion: To schedule a meeting to finalize the revisions for the Subdivision Regulations and to inform Joseph Mannarino, Planning Consultant, of this date in order that he may attend the meeting. (Boldrighini - Doucette - All in favor) \` A memorandum will be sent to Joseph Zeneski, DPW Director, requesting him to obtain all the information regarding retention and detention 'basins before the date of this meeting and have his recommendations ready for the Board to review. Chairman Brugliera stated that the joint meeting between the Board of Selectmen, the Planning Board, the Conservation Commission and the Zoning Board of Appeals to discuss industrial zoning which was scheduled for October 9, 1985, has been postponed until October 16, 1985, and he also stated that the Board should not schedule any other business for this night. 11. Date of Next Meeting is Wednesday, September 18, 1985, at 7:30 P.M. 12. Meeting adjourned at 9:45 P.M. WERK DATE
