White - for a lot on Henry Street being non -conforming in a Residence A Planning Board's Minutes August 28, 1985 Page 4 John Todesco, Jr - to construct an addition at 12 Park Avenue, being an expansion of an existing non -conforming lot in a Residence A Zone. William G. McGrane - to construct an addition to an existing single family at 796 Maple Street being non -conforming in an Agricultural Zone. Peter & Mary Ann DeTrolio Jr. - for a Special Permit for the installation of a propane gas dispensing station at 428 Elm Street being an expansion of an ex- isting non -conforming use. Winslow B. Schurman, Jr. - for a lot on Mill street being non -conforming in an Agricultural Zone. A letter from Edward Broderick, The Broderick Corporation, requesting that the Planning Board calculate the bond estimate for Camelot at Mansfield. 3. Review commercial site plan - D'Angelo's - Chauncy Street John Parmentier, Dunn Engineering, stated that this lot is 33,268 square feet which will be used for a retail and restaurant building for D'Angelo's on Chauncy Street. He stated that he has had a meeting with Joseph Zeneski, DPW Director, and has agreed to incorporate Mr. Zeneski's comments on this site plan; he also will agree to the Planning Consultant's comment regarding landscaped buffer be- tween the two properties rather than erecting a fence. The Board had a concern about the access to this property. Mr. Parmentier stated that this will only have one access which will be 24 feet wide. Planning Consultant Mannarino stated that he believes the access will be adequate because it is only serving one establishment. Mr. Parmentier stated that he has two handicapped parking spaces in the front of the building and one in the back, but he can move the one in the back to the front of the building so it is more accessible to the front door and the sidewalk as suggested by Planning Consultant Mannarino. Mr. Parmentier submitted a site plan with the revisions on it to the Planning Board. *Planner Flynn entered the meeting. Motion: To send a positive recommendation on the site plan for D'Angelo's to the Inspector of Buildings with the changes that are required from the comments of the various department heads. (Genatossio - Doucette - All in favor) 4. Jack Dwyer - Town Counsel The Planning Board requested that Jack Dwyer, Town Counsel, attend this meeting to discuss Foxboro Terminals. The Board questioned whether other factors could be looked at other than those which are under the Water Protection District of the Zoning Bylaw because this also falls under the Special Permit section of the Bylaw. Mr. Dwyer stated that, in his opinion, as far as the Planning Board is concerned with this Special Permit, the only issues that they can consider are those issues which fall under the Water Protection District of the Bylaw, and that the approval/disapproval of this permit should be based only on the water quality factors. Planner Flynn stated that she believes there should be additional issues which the Board can consider other than those which fall under the Water Protection District. Mr. Dwyer stated that he will review this issue further and send a letter to the Planning Board on this issue. Planning Consultant Mannarino stated that the engineer has all the comments on this plan and he has not addressed any of them as yet. Motion: To send a letter to the applicant of this plan requesting him to attend the September 11, 1985, Planning Board meeting to discuss these comments. it _____,__ n ............... .. _ A 1 1 1- 4 w.,,l Planning Board's Minutes August 28, 1985 Page 5 Planner Flynn stated that she has been unable to obtain the covenants for Ryan and Elliott which Mr. Juliano has stated he has in his possession; she would like Jack Dwyer, Town Counsel, to look at these covenants when they are obtained. Motion: To send a letter to Mr. Juliano requesting him to send the Planning Board a copy of the covenants for Ryan & Elliott in order that they can have them reviewed by Town Counsel. (Genatossio - Fiore - All in favor) 5. Review "Green Acres" definitive subdivision plan - Maple Street Planning Consultant Mannarino and. Joseph Zeneski, DPW Director, havereviewedthese revised plans. Planning Consultant Mannarino had a concern over the berm and whether this would prove to be a maintenance problem for the Town. Joseph Zeneski stated that he believes the Town has an easement so he does not see any problems. He stated that since there is such a problem with flooding in this area now, the drainage for this subdivision should be completed before the houses are built; he suggests that a construction schedule be drawn up to assure that this is done in the proper amount of time; if it is not, the Town will have to take the money and have the work done themselves. Planning Consultant Mannarino stated that this would have to be approved by Town Counsel before it can be agreed upon by the Board and the Developer. Planner Fiore stated that it also has to be written up so that it is not too sequential in the case that one item is not completed, it will not throw the whole schedule off timing. Planner Genatossio stated that Planning Consultant Mannarino's comment concerning the soil survey is not on the plans. Michael Trowbridge, Engineer, stated that the results from the soil sur- vey are on the plan even though the plans are dated August 16, 1985, and the survey was completed on August 17, 1985; the only revision they were waiting for was the comments from this survey. Planner Genatossio also stated that the applicant should change the street names back to the names that were originally approved because the neighbors have requested this to be done. Motion: To have the applicant change the street names back to the original names that were approved in the original subdivision. (Doucette - Genatossio - Flynn - Bachman - Brugliera) (Fiore opposed to this motion.) Joseph Zeneski, DPW Director, stated that the roadway width of this subdivision should be waived from the 30 -foot requirement to 25 feet due to the fact that this is within the water protection district. The applicant has also requested this waiver. Motion: To reduce the roadway width from the 30 -foot requirement to 25 feet as requested by the applicant and recommended by the DPW Director due to the fact that this subdivision is within the Aquifer Protection District. (Doucette - Genatossio - Flynn - Brugliera) (Bachman and Fiore opposed to this motion.) Planners Bachman and Fiore felt that this waiver of the roadway pavement would be a negligible difference; Planner Bachman stated that he feels that since this road could be extended in the future, the Board should require that the roadway width be 30 feet. Planning Consultant Mananrino stated that this roadway cannot be extended because there is all wetlands behind here and he feels that 25 feet is wide enough for the roadway pavement and that it would be a waste of resources to put such a wide road for only a certain number of houses. Planner Bachman stated that the Board should vote on the plan first and then go back and vote on any waivers that may be requested. Planning Consultant Mannarino stated that all waivers must be part of the subdivision approval. The deadline for the Planning Board's decision on this plan is September 9, 1985, so the Board should Planning Board's Minutes August 28, 1985 Page 6 vote on the plan this week. Planner Bachman felt that the Board should have time to review the plan and then they can vote on it next week. Motion: To vote on the "Green Acres" definitive subdivision plan next week in order that the concerns of the Board concerning the bond issue can be put into writing. (Bachman - Fiore - FAILED) Planner Flynn stated that the Board should vote on the plan this week because if there is no quorum next week, the applicant will have his plan approved by de- fault with no conditions from the Planning Board. Motion: To approve the definitive plan for "Green Acres" subdivision with the following conditions: 1. The comment from Planning Consultant Mannarino regarding the poorly drained soils shall be delineated on the plans according to Russ Wilder's letter. 2. The street names shall be changed to the original street names which were approved in the original subdivision plan. 3. The roadway improvements shall follow the schedule of the DPW Director. 4. The roadway width shall be waived from the 30 -foot requirement to 25 feet. 5. Any other items that the Board has received from the various department heads shall be incorporated on the plan. (Genatossio - Flynn - Brugliera - Doucette - Fiore) (Planner Bachman was opposed to this motion due to the waiver of the roadway pavement.) 6. Review covenant for "Vankoert Farms" subdivision plan - Franklin Street The Walmark Corporation submitted a "Form I" Covenant for the Planning Board to review and approve. Planning Consultant Mannarino stated that everything seems to be in order. Motion: To approve the covenant for "Vankoert Farms" subdivision plan. (Genatossio - Doucette - Brugliera - Flynn) (Fiore and Bachman could not vote on this motion because they did not vote on the original approval because they were not present at the public hearing.) 7. Review covenant for "Mansfield Manor Estates" subdivision plan - Fruit Street Stanley Zola submitted a "Form I" Covenant for the Planning Board to review and approve. Planning Consultant Mannarino stated that everything seems to be in order. Motion: To approve the covenant for "Mansfield Manor Estates" subdivision plan. (Genatossio - Fiore - All in favor) Planning Board's Minutes August 28, 1985 Page 7 8. Review six (6) variance applications John F. Taylor, Jr. - Thornton Road This variance request is for a lot on Thornton Road having less than 15,000 square feet, less than 100 feet frontage with a proposed structure having less than a 15 foot sideyard, less than a 30 foot front yard and less than a 40 foot rear yard, all of which are non -conforming in a Residence A Zone. The applicant of this variance is John F. Taylor, Jr. The land is presently vacant and the proposed use would be a 24 foot by 32 foot single family home. The grounds for a variance is that the area surrounding the locus is mostly made up of small lots containing single family homes in an area designated agricultural and that failure to grant this variance would result in a hard- ship, financial or otherwise, to the applicant. A portion of this lot is in Mansfield and a portion of the lot is in Norton. The applicant states that this lot is already non -conforming, but that the lot was there prior to zoning. Motion: To send a favorable recommention to the Zoning Board of Appeals on the application of John F. Taylor, Jr., for a lot on Mill Street. (Doucette - Genatossio seconded for discussion - FAILED) Planner Genatossio stated that she has a concern about what the hardship is. Planning Consultant Mnanarino stated that if this is an existing non -conforming use, the applicant should provide the Board with a letter stating that a title search has been done on this land and that he doesn't own any land adjacent to this parcel. The Board felt that if this was in existence prior to zoning, there should be a note placed on the plan that states this. Motion: To send a negative recommendation to the Zoning Board of Appeals due to the fact that the Board does not have certification that this lot was in existence prior to zoning. (Doucette - Fiore - All in favor) Winslow B. Schurman, Jr. - Mill Street This variance request is for a lot on Mill Street having less than 120 feet frontage, which is non -conforming in an Agricultural Zone. The applicant of this variance is Winslow B. Schurman, Jr. The land is presently vacant and the proposed use would be a 44 foot by 26 foot single family dwelling. The applicant states that the lot contains approximately 2.5 acres. The proposed house would be set several hundred feet from the street and would not have a negative impact on surrounding parcels. The Zoning Board of Appeals has sent a letter to the applicant stating that this lot will require approval of the Planning Board under the Subdivision Control Laws; the Planning Board will also send the applicant a letter stating this fact. Motion: To send a letter to Winslow B. Schurman, Jr., stating that the Planning Board must hold a public hearing before approving/disapproving this request because this is considered to be a subdivision of a lot and falls under the Subdivision Control Laws. (Fiore - Genatossio - All in favor) Peter DeTrolio - Elm Street This request is for a Special Permit for the installation of a propane gas dispensing station at 428 Elm Street, being an expansion of an existing non- conforming use. The applicants are Peter and Mary Ann DeTrolio, Jr. There is no additional building proposed on this lot which is currently used as Planning Board's Minutes August 28, 1985 Page 8 a variety store, the proposed use would be a variety store with the addition of a propane gas dispensing station in back portion of lot. This would not be substantially more detrimental than the existing non -conforming use to the neighborhood. This propane tank is already in existence. Planning Consultant Mannarino stated that this request was granted through a variance before, but was then brought to court, the judge made a determination that since this was already a non -conforming use, a Special Permit had to be granted - not a variance; so now the applicant has made a request for a Special Permit. Motion: To send a favorable recommendation to the Zoning Board of Appeals stating that the Board feels that the granting of this Special Permit would not be substantially more detrimental than the ex- isting non -conforming use to the neighborhood. (Fiore - Flynn - Doucette - Brugliera) (Genatossio and Bachman were opposed to this motion.) Kenneth R. White - Henry Street This variance request is to place a single family dwelling on a lot on Henry Street containing less than 15,00 square feet, with a proposed dwelling having less than 30 feet front yard and less than 40 foot rear yard, all of which are non -conforming in a Residence A Zone. The land is presently vacant and the proposed use is for a 32 foot by 24 foot single family dwelling. The applicant of this request is Kenneth R. White. The grounds for a variance is that the shape and topography of the lot (dimensions) make it unusable unless the var- iance is granted. The Planning Board stated that it should be written on the plan that this existed before zoning and that it is presently non -conforming. Motion: To send a negative recommendation to the Zoning Board of Appeals due to the fact that the Board does not have certification that this lot was in existence prior to zoning and there is no documen- tation as to its non -conforming status. (Flynn - Genatossio - All in favor) John Todesco, Jr. - Park Avenue This variance request is to construct an addition to an existing single family dwelling at 12 Park Avenue being an expansion of an existing non -conforming lot in a Residence A Zone. The applicant of this variance request is John Todesco, Jr. The extent of the proposed alterations is a new addition with an eight (8) foot cellar, family room, master bedroom and bath; the size would be 19 feet by 30 feet. Motion: To send a favorable recommendation to the Zoning Board of Appeals stating that the Board does not feel that the granting of this variance would be detrimental to the surrounding neighborhood. (Fiore - Bachman - Brugliera - Doucette) (Genatossio and Flynn opposed to this motion.) William G. McGrane - Maple Street This variance request is to construct an addition to an existing single family dwelling at 796 Maple street having a sideyard dimension less than 25 feet, which is non -conforming in an Agricultural Zone. The present use of the property is a single family home, the extent of the proposed alterations is a two -car garage with a storage area. The grounds for the variance is that the two -car garage is too close to the abutter under the current regulations. There was noplanwith this variance application. Motion: To send a negative recommendation to the Zoning Board of Appeals due to the lack of information. (Doucette - Fiore - All in favor) Planning Board's Minutes August 28, 1985 Page 9 9. Review a new subdivision plan off Fruit Street - Hallett Crossing Edward Marcheselli, applicant, stated that this is a proposed six (6) lot definitive subdivision off Fruit Street which will have a small cul-de-sac. Lots 47 and 48 are partially in Norton so the Norton Planning Board will also have to approve this subdivision. Planning Consultant Mannarino stated that he has not had a chance to go through the checklist as yet because this plan has just been submitted, but he will go through it and the Board can review this plan next week; he also stated that a public hearing must be held on this proposal. The Board will hold the public hearing on Wednesday, September 25, 1985. A memorandum will be sent to all department heads for comments on this subdivision plan. 10. "Austin Farms" definitive subdivision plan The Planning Board received a request from Ronald Bonvie, applicant, to extend the time for the Planning Board's decision on the definitive plan of "Austin Farms" until October 1, 1985. Motion: To approve the extension request until October 1, 1985, for the definitive plan of "Austin Farms". (Doucette - Fiore - All in favor) 11. Environmental Impact Statement The Planning Board received a letter from the Easton Planning and Zoning Board ':. requesting a copy of the Environmental Impact Statement which was conducted in the Franklin/Winter/Maple Street area. Motion: To send a copy of the Environmental Impact Statement to the Easton Planning and Zoning Board along with the follow-up letter from Fay, Spofford & Thorndike. (Doucette - Flynn - All in favor) 12. Planning Consultation Hours The Board received a letter from Joseph S. Mannarino, Planning Consultant, submitting his planning consultation hourly breakdown for the week of August 11, 1985. Motion: To approve of the payment for 13 hours for the planning consultation services of Joseph Mannarino for the week of August 11, 1985. (Flynn - Fiore - All in favor) The Board received a letter from Joseph S. Mannarino, Planning Consultant, submitting his planning consultation hourly breakdown for the week of August 21, 1985. Motion: To approve of the payment for 12 hours for the planning consultation services of Joseph Mannarino for the week of August 21, 1985. (Flynn - Fiore - All in favor) 13. Environmental Impact Statement The Board received an invoice from Fay, Spofford & Thorndike, Inc. regarding the payment of the contract for their services to conduct an Environmental Impact Study for proposed new developments in the Franklin/Maple/Winter Streets area. Planning Consultant Mannarino stated that the Board should hold off on payment of this contract until all the developers send the Town Manager their letters. Motion: To approve the payment of $20,500 to Fay, Spofford & Thorndike, Inc. providing that the developers send their letters to the Town Manager. (Genatossio - Doucette - All in favor) Planning Board's Minutes August 28, 1985 Page 10 14. Camelot at Mansfield Subdivision - The Broderick Corporation The Planning Board received a letter from Edward Broderick, The Broderick Cor- poration, requesting that the Board calculate the bond estimate for the first 650 feet of roadway for Lancelot Lane in the Camelot at Mansfield Subdivision. Mr. Broderick stated that by not calculating this bond, a real hardship is being inflicted upon him, he also stated that he will be willing to double the amount of the bond to cover the lighting changes. Chairman Brugliera stated that he has talked to Anthony Durbano, Chairman of the Conservation Commission, because the Planning Board voted to wait until the Conservation Commission has set out an Order of Conditions before calculating this bond; he stated that the Commission has closed the hearing, but has not taken a vote on this order. Motion: To not take any action on calculating this bond until the Board receives the Order of Conditions from the Conservation Commission. (Fiore - Doucette - All in favor) Planner Flynn asked why the Planning Board hasn't looked at this plan yet; Chairman Brugliera stated that the Board was waiting for the Conservation Commission to review the plan to see if they were going to make any changes. There was also a question from the Board members as to whether Mr. Broderick would have to submit this plan for approval again because no work has been done in this subdivision since its approval in 1974. According to the Sub- division Regulations, Section III. C., lb., the roadways and utilities are required to be finished in a two-year period of time. The Planning Board also discussed whether this subdivision was still in effect because it is over 10 years old. Motion: To send Edward Broderick a letter stating that the Planning Board will not calculate the bond estimate or take any action on Camelot Estates until they receive an Order of Conditions from the Conser- vation Commission. (Genatossio - Flynn - All in favor) 15. Around the Table Planner Bachman stated that the Downtown area should be looked into more closely because it is very crowded with parking for the apartments in this area. The Board agreed with looking into the parking in the Downtown area. Planner Genatossio stated that she has a concern regarding the inspection of septic systems since there is currently no full-time Health Agent. Planning Consultant Mannarino stated that the Building Inspector has been appointed as Deputy Health Agent by the Board of Health for emergency situations only. Planner Genatossio stated that the Planning Board should send the Board of Health a letter stating that they have concerns about the septic systems in the Water Protection District and who will be inspecting the installation of these systems. Motion: To send a letter to the Board of Health stating that .the Planning Board has a concern with the installation of septic systems in the Water Protection District and who will be inspecting these installations since there is no full-time Health Agent at the present moment. (Genatossio - Doucette - All in favor) Planner Genatossio also stated that she has a concern about the Subdivision Regulations and the fact that the Planning Board has not had a chance to work on these regulations because they have been so inundated with work; she would like the Board to form a subcommittee to review the regulations and then report back to the Planning Board. Chairman Brugliera stated that the problems with Planning Board's Minutes August 28, 1985 Page, 11 having a subcommittee is that those members which are a part of this subcommittee may agree on certain things, but the rest of the Board members may not agree. Planning Consultant Mannarino stated that the Board should have a small agenda next week and then hold a workshop to review these regulations. Planner Genatossio also stated that Plainville has been allowing retention basins in their subdivisions and some people in this area do not want them allowed because of their size, so now Plainville is looking into leaching basins and she requested that Mansfield look into the same solution. Planning Consultant Mannarino stated that Joseph Zeneski, DPW Director, could look into this issue and suggest changes that will be necessary in the regulations to allow these basins. 16. Public Discussion A woman in the public stated that the Board was very concerned about "Green Acres" and the type of impact that it would have on the surrounding area, but what she is concerned about is the proposal by Foxboro Terminals and the impact that it would have on the surrounding area should it be approved; she wants to know if any type of study could be done on this proposal. Chairman Brugliera stated that there are studies that can be done, but the time in which to act on this proposal is a big element and the only reason that the Board had a hearing at all was because this proposal is in the Water Protection District. Chairman Brugliera also stated that if this proposal should be approved, the people can appeal it to the Town boards. Russell Simmons, 171 North Main Street, asked the Board what must be done to put a two-year moratorium on all building in the Town of Mansfield. Planner Flynn - informed Mr. Simmons that he would have to begin a petition and put this article on the warrant for the Town Meeting. 17. Around the Table Planner Fiore states that he has a concern about Foxboro Terminals and the roadway that is currently on this property and what is going to happen to it; he would like the Board to ask Town Counsel about it. Motion: To ask Town Counsel what is going to have to be done with the roadway that presently exists on the property that is proposed for Foxboro Terminals. (Fiore - Doucette - All in favor) 18. Date of Next Meeting is Wednesday, September 4, 1985, at 7:30 P.M. 19. Meeting adjourned at 11:00 P.M. CLERK DATE
